RECOMMENDED ACTION:
Adopt Resolution No. 1163 authorizing payment to SBC Pacific Bell for the relocation
of telephone facilities located within the Carlsbad Water Recycling Facility property,
Project No. 3675-3.
ITEM EXPLANATION:
The Carlsbad Water Recycling Facility (CWRF) is a 4.0 million gallon per day advanced tertiary
treatment facility and is an integral part of Phase II of the Encina Basin Water Reclamation Program.
The CWRF is located along Avenida Encinas adjacent to the south boundary of the Encina Water
Municipal Water District (CMWD) Board of Directors on May 14, 2002 by Resolution No. 1149.
Pollution Control Facility. The construction contract for the CWRF was awarded by the Carlsbad
which is located adjacent to Avenida Encinas on the CWRF property. The telephone feeder line
Construction of the CWRF requires the relocation of an existing overhead telephone feeder line
will be relocated by SBC Pacific Bell to underground duct banks to be constructed within
Avenida Encinas.
SBC Pacific Bell has agreed to complete the telephone feeder or facilities relocation work within
120 days after receiving payment from CMWD in the fixed amount of $1 13,513.84.
Staff recommends authorizing payment to SBC Pacific Bell in the amount of $113,513.84 for the
relocation of the telephone facilities.
ENVIRONMENTAL IMPACT:
A Mitigated Negative Declaration was prepared for the Phase II project. This was approved by
thecity Council on January 25, 2000 under Case No. EIA 99-09, Coastal Development Permit
No. 99-45 and Conditional Use Permit No. 9923 were approved for the Carlsbad Water Recycling
Facility on August 22, 2001 by the Planning Commission. The United States Department of the
Interior completed their review of the Phase II project for compliance with the National Environmental
Policy Act (NEPA) and formally approved the NEPA on March 1,2002.
FISCAL IMPACT:
The Phase II project is being financed through a combination of local, State, and Federal funding
programs. On January 23, 2002, the State Water Resources Control Board approved a $31 million low-interest loan and a $5 million grant for the Phase II project.
The CWRF is a part of the Phase II project (shown below) and is eligible for State loans and grants.
CWRF which includes the cost of relocating the existing electric and telephone facilities. The initial
Funds totaling $12.5 million were appropriated on February 12, 2002 for the construction of the
cost estimate for utility relocation was $175,000, actual cost is $1 13,513.84.

A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD
MUNICIPAL WATER DISTRICT (CMWD) AUTHORIZING PAYMENT TO
SBC PACIFIC BELL FOR THE RELOCATION OF TELEPHONE
FACILITIES WITHIN THE SITE OF THE CARLSBAD WATER RECYCLING FACILITY, CITY PROJECT NO. 3675-3.
WHEREAS, the Board of Directors of the Carlsbad Municipal Water District of Carlsbad,
California, appropriated funding in the amount of $12.5 million for the construction of the Carlsbad
Water Recycling Facility (CWRF) on February 12, 2002 by Resolution No. 1139; and
WHEREAS, the Board of Directors awarded the construction contract for the Carlsbad
Water Recycling Facility (CWRF) on May 14, 2002 by Resolution No. 1149; and
WHEREAS, the existing SBC Pacific Bell telephone facilities located within the CWRF site
conflict with the layout of the proposed facility; and
WHEREAS, SBC Pacific Bell agrees to relocate the existing overhead telephone lines,
that conflict with the layout of the proposed facility, offsite to below grade duct banks within
Avenida Encinas for a fixed fee of $1 13,513.84; and
WHEREAS, there are sufficient funds available to pay SBC Pacific Bell to relocate the
conflicting telephone facilities; and
WHEREAS, it is in the best interest of the District to pay SBC Pacific Bell the fixed fee of
$1 13,513.84 for the relocation of the telephone facilities.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Carlsbad
Municipal Water District, as follows:
1. That the above recitations are true and correct.
2. That sufficient funds are available to pay SBC Pacific Bell to relocate the existing
overhead telephone lines, that conflict with the layout of the proposed facility, offsite to below

3. That the Finance Director is hereby authorized to pay SBC Pacific Bell a fixed fee
,f $1 13,513.84 for this telephone facilities relocation work.
PASSED, APPROVED AND ADOPTED at a special meeting of the Carlsbad Municipal
