ITEM EXPLANATION:
Calavera Hills II, LLC, is the developer for College Boulevard Reach B and C and Cannon Road
pipelines plus pressure reducing stations at the request of the District as a part of the water and Reach 3. They will be constructing 16-inch and 12-inch diameter potable water and recycled water

As a condition of project approval, Calavera Hills II, LLC, is required to construct within College Boulevard Reach B and C and Cannon Road Reach 3, the water and recycled water pipelines. The pipeline plans are shown on City Drawing No. 390-9, Sheets 37 through 41 and City
cost estimate of $1,800,000 for the water and recycled water pipeline improvements.
Drawing No. 404-7, Sheets 1 through 33. Calavera Hills II, LLC, has provided a reimbursement
District Ordinance No. 26 provides for a reimbursement agreement on facilities greater in size than what is required to serve the development. Calavera Hills II, LLC, has agreed to construct the
water and recycled water pipeline improvements through a reimbursement agreement with the District.
ENVIRONMENTAL REVIEW:
An Environmental Impact Report (EIR 98-02), was certified by the City Council on January 15, 2002 by Resolution No. 2002-016. These CEQA documents identify no environmental impact related to the activities referenced in the reimbursement agreements.
FISCAL IMPACT
The total cost for the work covered by the reimbursement agreements is estimated at $1,800,000 and will be paid from the projects as shown below:

Water Connection Fee Funds totaling $750,000 were appropriated in the 2002-03 Capital
project costs are estimated at $900,000; therefore, an additional appropriation of $l50,000 is

The 16" and 12" recycled water pipelines are part of Phase II of the Encina Basin Water
Reclamation Project. The complete project includes a new 4 mgd advanced tertiary treatment
facility as well as necessary transmission and distribution systems. The total recycled water project
will cost approximately $37 million of which Council previously appropriated $15.8 million from the
Recycled Operations Fund for pressure reducing stations and various pipeline improvements
available from the initial appropriation for this reimbursement. including the recycled pipeline in this reimbursement agreement. There are sufficient funds

A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD MUNICIPAL WATER DISTRICT (CMWD) TO
APPROVE AND AUTHORIZE EXECUTION OF A
REIMBURSEMENT AGREEMENT WITH CALAVERA HILLS 11, LLC, FOR WATER AND RECYCLED WATER PIPELINE
IMPROVEMENTS WITHIN COLLEGE BOULEVARD REACH B
AND c AND CANNON ROAD REACH 3, PROJECT NOS. 38781,
38871, AND 38921.
WHEREAS, Calavera Hills II, LLC, is the developer of the College Boulevard Reach B
and C and Cannon Road, Reach 3 project; and
WHEREAS, at the request of the Carlsbad Municipal Water District (CMWD), 16-inch and
12" diameter pipeline and two pressure reducing stations were designed by P&D Consultants and
Daniel Boyle Engineering in College Boulevard Reach B and C and Cannon Road Reach 3: and
WHEREAS, Calavera Hills 11, LLC, has requested the Board of Directors to approve a
reimbursement agreement for the costs of constructing pipeline and pressure reducing station
improvements: and
WHEREAS, an Environmental Impact Report (EIR 98-002) was approved for the
College Boulevard Reach B and C and Cannon Road Reach 3, including utilities by the
City Council on July 15,2002; and
WHEREAS, the total cost for the 16-inch and 12" diameter domestic water and recycled
water pipeline and two pressure reducing station improvements is $1,800,000; and
WHEREAS, an additional $150,000 is needed to construct the domestic pipelines: and
WHEREAS, there are sufficient funds available in the Water Connection Fee Fund to
appropriate the funds needed for the pipeline improvements.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
Water District (CMWD) of the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the agreement between the District and Calavera Hills II, LLC, for the
reimbursement of costs for domestic water and recycled water pipeline and pressure reducing
station improvements within College Boulevard and Cannon Road is hereby approved and the
President is authorized to execute said agreement on behalf of the District.

3. That an appropriation in the amount of $150,000 is approved from the Water
:onneetion Fee Fund for the domestic water pipelines.
