ENG I CITY MGR. k RECOMMENDED ACTION: Adopt Resolution No. 1186 Carlsbad Tract 98-1 4. to quitclaim existing waterline easements across a portion of ITEM EXPLANATION : Standard Pacific Corporation, a Delaware Corporation, has submitted a request to quitclaim that portion of a waterline easement that traverses over a portion of Carlsbad Tract 98-14 Thompsonflabata. These easements were for waterlines serving the agricultural uses on the property. These uses no longer exist and the waterlines will be removed with the development of CT 98-1 4. Staff concurs with the owner that the easements are no longer necessary and can be quitclaimed. ENVIRONMENTAL REVIEW: The proposed quitclaim is exempt from environmental review under the California Environmental Quality Act Section 15061 (b)(3), because it can be seen with certainty that there is no possibility that the quitclaim may have a significant effect on the environment. FISCAL IMPACT: This item has no fiscal impact to the City. The waterline easement was granted to the District for a no cost acquisition and the District will quitclaim the easement for a no cost return to the property owner.
