_. RECOMMENDED ACTION:
Adopt Resolution No. 1234 approving the dedication of an underground electric easement to San Diego Gas and Electric Company for service to the Twin D Recycled Water Pump Station, Project No. 3889A.
ITEM EXPLANATION:
Included in the Encina Basin Water Reclamation Program, Phase I1 Project (Phase II) are three recycled water pump stations: Twin D, Calavera, and Bressi. These pump stations are used to provide pressure for the recycled water customers throughout the City.
The Twin D Recycled Water Pump Station (Twin D RWPS) is a critical component of the Phase II project providing recycled water produced at the Carlsbad Water Recycling Facility (CW RF) for use by customers located at higher pressure zones in addition to providing a storage supply for Mahr Reservoir and the āCā Reservoir. This facility will also be capable of transferring water from the higher-pressure zones back to the lower elevations. The Twin D RWPS will be located on a District owned parcel which is generally located south of Poinsettia Lane on the east side of Black Rail Road.
The Carlsbad Municipal Water District is negotiating an agreement with San Diego Gas and Electric (SDG&E) for the extension and construction of underground electric facilities to the Twin D RWPS.
The electric facilities extension has been requested by the District to provide electric service to the Twin D RWPS. To receive electrical service to the site, an easement must be provided to SDG&E by the District.
Staff has reviewed the easement document and recommends that the Board of Directors approve
the dedication of this electric easement to San Diego Gas and Electric Company.
FISCAL IMPACT:
There are no anticipated fiscal impacts with granting this easement to SDG&E.

A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD
MUNICIPAL WATER DISTRICT (CMWD) APPROVING THE
DEDICATION OF AN UNDERGROUND ELECTRIC EASEMENT TO
SAN DIEGO GAS & ELECTRIC COMPANY FOR SERVICE TO THE
TWIN D RECYCLED WATER PUMP STATION, PROJECT NO. 3889A.
WHEREAS, the Board of Directors of Carlsbad Municipal Water District has determined
it necessary, desirable, and in the public interest to construct the Twin D Recycled Water Pump
Station for the Encina Basin Water Reclamation Program, Phase It Project, Project No. 3889A;
and
WHEREAS, the Twin D Recycled Water Pump Station will be located on property owned
by the Carlsbad Municipal Water District; and
WHEREAS, San Diego Gas and Electric requires an easement from the Carlsbad
Municipal Water District for periodic inspection and maintenance of its electric facilities; and
WHEREAS, the Board of Directors of the Carlsbad Municipal Water District has
determined it to be in the public interest to grant this easement to San Diego Gas and Electric
Company; and
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
Water District (CMWD) of the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the grant deed of underground electric easements to San Diego Gas and
Electric Company, which is on file with the Secretary and is incorporated by this reference,
is approved.

3. That the President is authorized to execute the grant deed of underground electric
easement to San Diego Gas and Electric Company and the Secretary is hereby authorized to
cause the original easement document to be recorded in the Office of the County Recorder of
San Diego County, State of California.
PASSED, APPROVED AND ADOPTED at a special meeting of the Carlsbad Municipal
Water District held on the 18th day of JANUARY , 2005 by the following vote, to wit:

EASEMENT
CARLSBAD MUNICIPAL WATER DISTRICT, A MUNICIPAL WATER DISTRICT
ORGANIZED AND EXISTING UNDER THE MUNICIPAL WATER ACT OF 1911, AS
AMENDED, hereinafter called "Grantor", grants to S AN DIEGO GAS & ELECTRIC
COMPANY, a corporation, hereinafter called "Grantee", an easement and right of way to erect,
construct, change the size of, improve, reconstruct, relocate, repair, maintain and use facilities
consisting of (1) Underground electric facilities, and appurtenances for the transmission and
distribution of electricity, (2) Underground communication facilities, and appurtenances, (3)
Pipelines and appurtenances for any and all purposes, together with the right of ingress thereto
and egress therefrom over said easement and over other practical routes across Grantor's land
situated in the County of San Diego, State of California described as follows:
That portion of the North Half of the Southwest Quarter of the Southeast Quarter of
Section 22, Township 12 South, Range 4 West, San Bernardino Meridian and more particularly
described in a Deed recorded July 21, 1958 in Book 7174, Page 298 as Document No. 116507,
of Official Records of said County of San Diego.
The easement in the aforesaid land shall be more particularly described as follows:
That certain strip of land, including all of the area lying between the exterior sidelines,
which sidelines shall be three (3) feet, measured at right angles, on each exterior side of each and
every facility installed, the approximate location being shown and delineated as "Utility
Facilities" on the Exhibit "A", attached hereto and made a part hereof.
In order to provide adequate working space for Grantee, Grantor shall not erect, place or
construct, nor permit to be erected, placed or constructed any building or other structure, park
any vehicle, deposit any materials, plant any trees and/or shrubs within eight (8) feet of the front
of the door or hinged opening of any above ground facility installed within this easement.

Grantor grants to Grantee the right to erect and maintain on Grantor's property immediately
adjacent to this easement retaining walls andor protective barricades as may be necessary for
Grantee's purposes.
Grantor will exercise only such reserved rights in said land as will not interfere with or
prohibit the free and complete use and enjoyment by Grantee, its successor or assigns, of the
rights hereby granted. Grantee shall have the right to assign any or all rights granted in this
easement in whole or in part to other companies providing utility or communication services.
Grantee shall have the right to top, cut, remove, or trim interfering plants and trees, and to keep
said easement free from and to prevent any person, including Grantor and successors and assigns,
from erecting, placing, or storing on said easement any flammable or other hazards and any
structures, objects, or earth filldcuts or other obstructions.
Upon receipt of written request from Grantor, this easement will be quitclaimed by
Grantee, provided that the facilities have been removed.
The legal description for this easement was prepared by San Diego Gas & Electric
Company pursuant to Section 8730 of the Business and Professions Code, State of California.
