RECOMMENDED ACTION:
Adopt Resolution No. 1250 approving plans and specifications and authorizing the District Secretary to the Board to advertise for bids for the construction of the Mahr Reservoir Improvements, Project No. 3890.
ITEM EXPLANATION:
Mahr Reservoir is an existing earthen fill dam constructed in 1982 to store recycled water from the Meadowlark Reclamation Facility. It is located east of Rancho Santa Fe Road just south of Melrose Drive. Both Mahr Reservoir and the Meadowlark Reclamation Facility are owned and operated by Vallecitos Water District (VW D).
On August 5, 2003, the Carlsbad Municipal Water District (CMWD) entered into an agreement with Vallecitos Water District (VWD) to purchase up to 3.0 million gallons per day (mgd) of recycled water from the Meadowlark Reclamation Facility (MRF). As part of the agreement, CMWD is entitled
to use 32 MG of the storage volume in Mahr Reservoir. To meet water quality and operation storage needs for CMWD's Phase II recycled water system requires that certain improvements be made to Mahr Reservoir. These improvements include:

Removal of debris and fine grading of the interior area of Mahr Reservoir Reconfiguring and constructing a new inlet/outlet structure, piping, and remote controls Installation of an aeration system, disinfection system, and chemical treatment system
Constructing a control and chemical storage building and miscellaneous site work
VWD will operate and maintain Mahr Reservoir in accordance with an operations and maintenance manual prepared by CMWD.
ENVIRONMENTAL REVIEW:
The Mahr Reservoir project is a part of the Phase II project. A Mitigated Negative Declaration (MND) was prepared for the Phase II project. The Carlsbad City Council approved the MND on January 25, 2000 under Case No. EIA 99-09, Resolution No. 2000-37. The United States
Department of the interior completed its review of the Phase II project for compliance with the
National Environmental Policy Act (NEPA) and formally approved the finding of no significant
impact (FONSI) on March 1,2002.

The Mahr Reservoir Improvements project is part of Phase II of the Encina Basin Water
Reclamation Program. At this time, construction bids have been received on all but two of the 21
construction contracts that comprise the Phase II project. The other remaining project to be
advertised for bidding is the Supervisory Control and Data Acquisition (SCADA) system. The current
appropriation for Phase II is $49,676,268, as shown in Table 2. Adequate funds are appropriated
within the respective project fund accounts.

A RESOLUTION OF THE BOARD OF DIRECTORS OF
CARLSBAD MUNICIPAL WATER DISTRICT (CMWD),
APPROVING PLANS AND SPECIFICATIONS AND
AUTHORIZING THE DISTRICT SECRETARY TO ADVERTISE
FOR BIDS FOR THE CONSTRUCTION OF THE MAHR
RESERVOIR IMPROVEMENTS, PROJECT NO. 3890.
WHEREAS, the Board of Directors of Carlsbad Municipal Water District has determined
it necessary, desirable, and in the public interest to construct the Mahr Reservoir Improvements,
Project No. 3890; and
WHEREAS, an agreement was approved by Resolution No. 1188, dated August 5, 2003,
between Vallecitos Water District and CMWD for the purchase of up to 3.0 million gallons per day
(mgd) of recycled water beginning after the expansion of Meadowlark Reclamation Facility,
and for CMWD's continuous use of Mahr Reservoir for recycled water storage up to 32 million
gallons; and
WHEREAS, the plans and specifications for furnishing of all labor, materials, tools,
squipment, transportation, and other expenses necessary or incidental to said project have been
orepared and are on file in the Engineering Department of the City of Carlsbad and are
ncorporated by reference herein; and
WHEREAS, the Division of Safety of Dams has approved the proposed improvements;

WHEREAS, the State Water Resources Control Board has approved advertising of the
Wahr Reservoir Improvements based on their review of the plans and specifications; and
WHEREAS, the estimated project cost for the Mahr Reservoir Project is $2,326,125 and
:here are sufficient funds appropriated in the Phase II, Project No. 3890, to construct the
Mahr Reservoir Improvements Project; and
WHEREAS, a Mitigated Negative Declaration has been adopted by the City of Carlsbad
3ty Council by Resolution No. 2000-37, dated January 25, 2000, as required by the California
Znvironmental Quality Act for the Phase II Recycled Water Program approving the finding of no
significant impacts and there are no new impacts for the Mahr Reservoir Project.

NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
Water District as follows:
1.
2. That the plans, specifications, and contract documents, on file in the
City Engineer’s office, as described above for the Mahr Reservoir Improvements, Project No.
3890, are hereby approved.
That the above recitations are true and correct.
3. The District Secretary of the Carlsbad Municipal Water District is hereby authorized
and directed to publish, in accordance with State law, a Notice to Contractors Inviting Bids for the
construction of the Mahr Reservoir Improvements, Project No. 3890, in accordance with the plans,
specifications, and contact documents referred to herein.
PASSED, APPROVED AND ADOPTED at a special meeting of the Carlsbad Municipal
Water District held on the 28th day of JUNE , 2005 by the following vote, to wit:
