ITEM EXPLANATION:
The Calavera Dam is an earth-fill dam that impounds waters from the Calavera Creek watershed to
form Lake Calavera. At present, the Calavera Dam’s outlet works are inoperable and are in need of
remedial improvements. At this time, the ultimate repair project is being coordinated through the
environmental permitting process and is anticipated to be ready for public bidding in Spring 2006
with construction completion anticipated in Summer 2007.
As a result of the dam’s outlet works being inoperable, the District’s maintenance and operations
staff are unable to control the water surface levels of Lake Calavera retained by the Calavera Dam.
In order to actively manage the Calavera Dam during the 2005/2006 rainfall season, staff is
developing a short-term pumping plan to draw down the reservoir level in advance of accumulative
rainfall effects so that the reservoir‘s storage capacity can be increased and discharge of dam
storage through the spillway channel can be conducted in a controlled manner.
Staff has requested proposals for short-term pump rentals from Rain for Rent and Baker Pumps.
One proposal for the pump rental was received by Rain for Rent.
The rented pump will utilize the latest technologies and will be capable of discharging 4,500 gpm in
advance of cumulative rainfall events. The pump rental equipment includes the suction and
discharge piping, a fluid spill containment membrane, and sound attenuation.
Historically, the surface levels of Lake Calavera have varied from 1964 to 21 7-ft above mean sea
level (amsl). At present, the surface level is approximately 208-ft amsl. During last year’s rainfall
season, the dam experienced two separate spillway flow events. These flow events were the first
occurrence since 1993. The rented pumps would be used to prevent, or reduce, the potential of a
spillway flow. Operation of the rental pump will not exceed the historical range of this facility and will
be activated only to increase the storage capacity of the reservoir and to avoid discharges through
the spillway channel during rainfall events.
ENVIRONMENTAL REVIEW:
This short-term project is categorically exempt from the environmental review process under the
provisions of the California Environmental Quality Act (CEQA), Section 15269 (c). The Planning
Director has filed a Notice of Exemption of November 18, 2005.

The mobilization and demobilization costs are estimated and will be confirmed once the work is
conducted. Additionally, the fuel expense is variable to the amount of use. Funding from the
Council Contingency Fund is recommended for the rental expenses.

A RESOLUTION OF THE BOARD OF DIRECTORS OF
CARLSBAD MUNICIPAL WATER DISTRICT (CMWD),
APPROPRIATING FUNDS FOR TEMPORARY PUMP RENTAL
EXPENSES FOR THE CALAVERA DAM.
WHEREAS, the Board of Directors of Carlsbad Municipal Water District has determined
it necessary, desirable, and in the public interest to rent a temporary pump to control the water
surface level of the Calavera Dam; and
WHEREAS, proposals for short-term pump rentals have been solicited; and
WHEREAS, one (1) proposal has been received for the temporary pump rental from
Rain for Rent; and
WHEREAS, this short-term project is categorically exempt from the environmental
review process under the provisions of the California Environmental Quality Act (CEQA),
Section 15269 (c); and
WHEREAS, the estimated pump rental and operations costs for the temporary pump
system is $50,000; and
WHEREAS, funding from the City Council Contingency Fund in the amount of $50,000 is
iecessary; and
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
JVater District as follows:
1. That the above recitations are true and correct.

Honorable Mayor and City Council
The consent calendar for tonight's meeting includes an item for rental of a pump and associated
expenses to draw down the water level of Lake Calavera.
We do not object to this project.
We do not object to the city processing this illegally as exempt from CEQA .
(The city created the emergency condition- by not repairing the dam in a timely manner, by not having
an adequate drainage system in place to protect the downstream area from damage during times of high
rainfall,and by not processing a MND in a timely manner- any of these actions would have precluded the
need for temporary pumping of the lake as an emergency measure.)
We do object to the way this is being done- with no conditions specified that assure that there will be no
adverse impacts from this project.
Our specific concerns include:
- potential need for a Stream Alteration permit
According to telephone conversation on December 5,2005 with Tamara Spear of the CA Department of
Fish and Game, there has been no consultation with their agency about this project, and such a project
may require a Stream Alteration Permit.
- no HMP consistency concurrence by the USFWS
According to Ben Frater with the USFWS staff have been conferring about the project to repair the dam- but the city has not reported this plan to pump the lake. According to Mr. Frater "pumping of a wetland
is not a benign activity and could have adverse impacts." He further stated that the city is obligated to,
at a minimum, review and report on consistency with the HMP and this has not been done.
- lack of specific project conditions that assure no adverse impacts
Simply stating in a staff report that the rental pump includes a fluid spill membrane and sound
attenuation does not constitute any enforceable environmental protection. Other items of concern are
not even addressed. Such conditions would be addressed in a CEQA document. Identifying this as
exempt from CEQA does not eliminate the city's responsibility to do this project correctly. These
conditions are not specified in the agenda bill or resolution and according to the project manager many of
them are still being evaluated . Where are the controls on this projectjmpacting wetlands, in core habitat owned by the city? How can you make sure that Rancho Carlsbad will not experience further
erosion- like they did last year when newly installed drainage controls did not work like the engineers said
they would?
At a minimum project conditions should include:
- restrictions on volume and velocity of pumping to assure there will be no adverse downstream hydrologic impacts
- guidelines on maximum drawdown levels, how this will be determined in the field, and how this will be
coordinated with rainfall projections
- protection from fuel spills in the staging area,storage area, and during operation
.
- protection from vandalism or injury in this area of high public use, including many unsupervised
children
- restrictions on noise levels taking into account the proximity to wetland and upland avian species during the nesting season as well as the nearby residences.
- protection of fish and other aquatic species from entering pump inlet
We suggest you authorize staff to move forward with this equipment rental, but require that they report
back with more detailed plans on how this project will be carried out and with specific conditions to protect these very special natural resources prior to placing such equipment next to Lake Calavera.
