RECOMMENDED ACTION:
Adopt Resolution No.1269 accepting bids and awarding a contract for the
"D" Reservoir- Black Rail Road Improvements, Project No. 3954, and appropriation of funds.
ITEM EXPLANATION:
The "D" Reservoir - Black Rail Road Improvements Project will install public improvements fronting
the "D" Reservoir property along the eastern portion of Black Rail Road generally south of
Poinsettia Lane. As a condition of approval of the Conditional Use Permit (CUP 03-15) for the
Twin "D" Recycled Water Pump Station, this project includes the widening of the portion of
Black Rail Road fronting District property to collector street standards, installation of curb and gutter,
construction of site retaining walls, right-of-way landscaping, and the undergrounding of existing
overhead utilities along the property frontage. The undergrounding agreements with San Diego Gas
& Electric and Pacific Bell Telephone Company were approved under a separate agenda item.
The Engineering Department received five (5) sealed bids for the frontage improvements as follows:

The Engineer's Estimate for the combined project was $125,000. Portillo Concrete, Inc., submitted
the lowest bid in the amount of $169,360. Staff has reviewed the bids and has found them to be in
order. Staff recommends that the Board award the contract for the construction of the "D" Reservoir
- Black Rail Road Improvements Project to Portillo Concrete, Inc.
ENVIRONMENTAL REVIEW:
On October 1, 2003, the Planning Commission adopted a Negative Declaration and approved a
Conditional Use Permit (CUP 03-15) by Planning Commission Resolution No. 5443.
FISCAL IMPACT:
This agenda item is awarding a construction contract for the "D" Reservoir - Black Rail Road
Improvements Project in the amount of $169,360 and is comprised of $154,860 for street widening
improvements and $14,500 for right-of-way landscaping. All bids submitted exceed the Engineer's
Estimate for this project. The increase in cost above the Engineer's Estimate is primarily due to the
significant rise in costs for concrete, asphalt, steel and fuel for equipment, in addition to increases in
other construction materials. As a result of the current economy, requesting new construction bids
will not result in a lower construction cost. Under a separate agenda item, the agreements for
converting the overhead utilities to underground facilities were approved. Based on the current bid
proposal for the remaining frontage improvements, an additional appropriation is necessary to
complete this project as shown in Table 1.

Because the improvements included in this bid are being constructed to comply with the conditions
placed on the Twin "D" Recycled Water Pump Station Project by CUP 03-15 staff has not included
any alternatives or options for the Board to consider that would reduce the cost or scope of this
project. If the Board desires to explore alternatives to the construction of the improvements
described in this agenda bill, staff will initiate an amendment process based upon the Board's
direction. Any proposed amendment to CUP 03-15 will be presented to the Planning Commission for
consideration. The Planning Commission's decision would be final unless it was appealed to the
City Council.

A RESOLUTION OF THE BOARD OF DIRECTORS OF
CARLSBAD MUNICIPAL WATER DISTRICT (CMWD) ACCEPTING
BIDS AND AWARDING A CONSTRUCTION CONTRACT FOR THE
"D" RESERVOIR - BLACK RAIL ROAD IMPROVEMENTS,
PROJECT NO. 3954. AND APPROPRIATION OF FUNDS.

WHEREAS, the Board of Directors of Carlsbad Municipal Water District has determined

it necessary, desirable, and in the public interest to construct the "D" Reservoir - Black Rail Road
7
Improvements, Project No. 3954; and
8
WHEREAS, five (5) sealed bids were received by the City of Carlsbad for the construction
9
of the "D" Reservoir - Black Rail Road Improvements, Project No. 3954; and
10
WHEREAS, the low bid received by Portillo Concrete, Inc., in the amount of $169,360 was
11
determined to be the lowest responsive bid by staff; and
12
WHEREAS, the estimated project cost for the "D" Reservoir - Black Rail Road
13
Improvements Project is $367,000; and
14
WHEREAS, the appropriation totaling $295,000 for the "D" Reservoir - Black Rail Road
15
Improvements Project is insufficient to complete the project;
16
WHEREAS, additional funds in the amount of $72,000 are needed to complete the project.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
18 Water District (CMWD) of the City of Carlsbad, California, as follows:
19 1 . That the above recitations are true and correct.
20 2. That the bid submitted by Portillo Concrete, Inc., in the amount of $169,360, for the
construction of the "D" Reservoir - Black Rail Road Improvements, Project No. 3954, is hereby
22 accepted and the Executive Manager is hereby authorized and directed to execute a contract
therefore.
3. That the award of this contract is contingent upon Portillo Concrete, Inc., executing
the required contract and submitting the required bonds and insurance policies, as described in
the contract, within twenty (20) days of adoption of this resolution with the understanding that
the Executive Manager may grant reasonable extensions of time.

4. That the Executive Manager is hereby authorized to approve construction change
orders up to $25,000 for Project No. 3954.
5. That an additional $72,000 shall be appropriated from the Water Replacement
Fund to Project No. 3954.
PASSED, APPROVED AND ADOPTED at a special meeting of the Carlsbad Municipal
Water District held on the 21st day of February , 2006 by the following vote, to wit:
