Services UPDATE ON THE POSEIDON DESALINATION PROJECT DEPT. HEAD CITY ATTY. CITYMGR. (jj RECOMMENDED ACTION: Accept the report from Poseidon Resources on the status of the proposed desalination project, and direct staff, as necessary. ITEM EXPLANATION: In June 2000, Poseidon Resources came before the Carlsbad Municipal Water District Board asking for the Board's approval and endorsement of a study to be conducted by Poseidon and its consultants on the feasibility of constructing a 25 to 50 million gallon per day seawater desalination plant in Carlsbad. The Water Board approved Poseidon's request (Resolution 1093, 6/27/00), an action that set into motion the process that unfolded during the succeeding four years. After four years of study, investigation, negotiation and review the CMWD Board entered into a Water Purchase Agreement with Poseidon Resources that would provide the residents and businesses in the CMWD service area with 100% of their daily potable water supply from the future desalination plant (CMWD AB 557 - Resolution 1226, 09/28/04). Following the completion of the Water Purchase Agreement, Poseidon Resources began work on a revision of the Precise Development Plan (PDP) associated with the Cabrillo Power Station property, and an Environmental Impact Report (EIR) for the desalination project. On June 13, 2006, the City Council and Carlsbad Housing and Redevelopment Commission, in a joint meeting, approved both the PDP and EIR for the project (AB 18,602). Since June 2006, Poseidon Resources has continued its efforts by working with other regulatory agencies, developing more detailed project designs, bringing a development team together, and entering into additional water purchase agreements with other public agencies. During the past year, Poseidon cleared several significant hurdles including the receipt of a discharge permit from the Regional Water Quality Control Board and a Coastal Development Permit (subject to a number of conditions) from the California Coastal Commission. The State Lands Commission has tentatively scheduled consideration of Poseidon's application for a lease of the intake and outfall property for February 26, 2008, in Los Angeles. On January 14, 2008, the City received a notice that Surfriders and the Planning and Conservation League (PCL) have filed a Petition for Writ of Mandamus with the California Superior Court challenging the Coastal Commission's actions. Recently, the Mayor requested a full briefing on the current status of the desalination project. The last update was provided on April 24, 2007. Peter MacLaggan, Senior Vice President for Poseidon Resources, has been invited to present a detailed update on the project to the Council at this February 12, 2008 meeting. At this time, the Board may hear the presentation from Poseidon Resources, and if necessary, direct staff to take any actions deemed necessary. FISCAL IMPACT: None. ENVIRONMENTAL IMPACT: None.
