RECOMMENDED ACTION:
Adopt Resolution No. 1335 accepting bids and awarding contract for the construction of
Maerkle Disinfection Facilities Chlorine Gas Scrubbers Replacement, Project No. 5009-A.
ITEM EXPLANATION:
Maerkle Dam reservoir and its auxiliary facilities are located in the northeast part of the City and are a
critical part of the potable water supply system for the City. Maerkle Dam reservoir (formerly known as
Squires Dam reservoir) was initially constructed in 1963. In the late 1980's and early 1990's, various
auxiliary facilities were added, including a 10 million gallon concrete storage tank, transmission
pipelines, a 33.5 million gallon per day pump station, and chlorination facilities.
In May 2007, staff commissioned a study to evaluate all the facilities at Maerkle Dam reservoir.
The study report identified 20 priority items that need replacement to meet current code requirements
for health and safety and to maintain reliability of this water supply source. These items were
presented to the Board via Agenda Bill No. 645 on December 11, 2007 and are summarized in Exhibit
2. Additional agenda bills will be presented to the Board for consideration as the plans and
specifications are completed and appropriate implementation schedule windows are identified.
This project involves high-priority items 11 and 12, which replace the existing wet chlorine gas
scrubbers with new dry chlorine gas scrubbers. The existing chlorine gas scrubbers were constructed
in 1992. The existing units are requiring increased attention to remain operable and have reached the
end of their useful life. To minimize the risk of chlorine gas release to the surrounding areas, the
existing scrubbers need to be replaced with new scrubbers.
On June 24, 2008, Carlsbad Municipal Water District (CMWD) Board adopted Resolution No. 1327
approving plans and authorizing to advertise for bids. On August 12, 2008, seven (7) bids were
received. The bids are summarized below.

The lowest responsive bidder, Socal Pacific Construction Corporation, submitted a bid in the amount
of $508,000. The Engineer's Estimate for the project was $550,000.
Staff has completed the review of the contract documents and has determined that they are in order.
Therefore, staff recommends that Socal Pacific Construction Corporation be awarded the contract.
ENVIRONMENTAL IMPACT:
This project is a Class 2 categorical exemption (replacement or reconstruction of existing structures or
facilities) and is, therefore, exempt from environmental review pursuant to Section 15302 of the
California Environmental Quality Act (CEQA).
FISCAL IMPACT:
Based on the construction bid from Socal Pacific Construction Corporation of $508,000, the total
project cost is summarized below.

A RESOLUTION OF THE BOARD OF DIRECTORS OF
3 CARLSBAD MUNICIPAL WATER DISTRICT (CMWD),
ACCEPTING BIDS AND AWARDING THE CONTRACT FOR THE
4 CONSTRUCTION OF MAERKLE DISINFECTION FACILITIES
CHLORINE GAS SCRUBBERS REPLACEMENT, PROJECT NO.
5 5009-A.
6 WHEREAS, the Board has determined it necessary and in the public interest to construct
7 the chlorine gas scrubbers at Maerkle disinfection facilities; and
8 WHEREAS, on June 24, 2008, through the adoption of Resolution No. 1327, the Board
g approved the plans and specifications for furnishing of all labor, materials, tools, equipment,
transportation, and other expenses necessary and incidental to the construction of the Maerkle
Disinfection Facilities Chlorine Gas Scrubbers Replacement Project, No. 5009-A; and
WHEREAS, seven (7) sealed bids were received on August 12, 2008 for the project; and

WHEREAS, the lowest responsive, responsible bid for the project was submitted by Socal
13 Pacific Construction Corporation in the amount of $508,000; and
14 WHEREAS, there are sufficient appropriated funds in the Water Replacement Fund to
15 complete the project.
16 NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board
17 of Directors of the City of Carlsbad, California, as follows:
18 1 • That the above recitations are true and correct.
19 2. That the bid amount of $508,000 submitted by Socal Pacific Construction
20 Corporation is herby accepted and the President is hereby authorized to execute a contract with
Socal Pacific Construction Corporation for the construction of the Maerkle Disinfection Facilities
Chlorine Gas Scrubbers Replacement, Project No. 5009-A, in accordance with plans,

specifications, and contract documents referred to herein.

3. That the Executive Manager is hereby authorized to approve construction change
24 orders up to $51,000 for Project No. 5009-A.
25 4. That the award of contract is contingent upon the bidder submitting the lowest
26 responsive bid executing the required contract and submitting the required bonds and insurance
27 policies, as described in the contract, within twenty (20) days of adoption of this resolution. The
28 Executive Manager may grant reasonable extensions of time.
