Maerkle Pump Station Upgrade Project No. 5009-B.
ITEM EXPLANATION:
accepting bids and awarding contract for the construction of
Maerkle Dam reservoir and its auxiliary facilities are located in the northeast part of the City and are a
critical part of the potable water supply system for the City. Maerkle Dam reservoir (formerly known as
Squires Dam reservoir) was initially constructed in 1963. In the late 1980's and early 1990's, various
auxiliary facilities were added, including a 10 million gallon concrete storage tank, transmission
pipelines, a 33.5 million gallons per day pump station, and chlorination facilities.
In May 2007, staff commissioned a study to evaluate all the facilities at Maerkle Dam reservoir.
The study report identified 20 priority items that need replacement to meet current code requirements
for health and safety and to maintain reliability of this water supply source. These items were
presented to the Board via Agenda Bill No. 645 on December 11, 2007, and are summarized in
Exhibit 2. Additional agenda bills will be presented to the Board for consideration when the plans and
specifications are completed and appropriate implementation schedule windows are identified.
The Maerkle Pump Station Upgrade Project involves high priority items 2 and 19. Item 2 replaces and
upgrades electrical components at the pump station, such as variable frequency drives, switches, soft
starters, controls, relays, lights, etc. The existing pumps were constructed in 1992. The existing units
are requiring increased attention to remain operable and have reached the end of their useful life. To
minimize the risk of pump failure and inability to deliver water, the existing electrical components need
to be replaced. Item 19 provides for improvements at the two existing gates to the site to provide for a
more secure site.
On July 28, 2009, the Board adopted Resolution No. 1366 approving plans and authorizing to
advertise for bids. On September 17, 2009, seven (7) bids were received. The bids are summarized
in Table 1.
The lowest responsive bidder, Neal Electric Corporation dba: Nealectric, Inc. submitted a bid in the amount
of $188,850. Staff has completed the review of all contract documents and has determined that they are in
order. Therefore, staff recommends that Neal Electric Corporation dba: Nealectric, Inc. be awarded the
contract.
ENVIRONMENTAL IMPACT:
This project is a Class 2 categorical exemption (replacement or reconstruction of existing structures or
facilities) and is, therefore, exempt from environmental review pursuant to Section 15302 of the
California Environmental Quality Act (CEQA).

FISCAL IMPACT:
Table 2 shows the current status of the Maerkle Facilities Improvements Project No. 5009. These
expenditures are for all the items shown as completed in Exhibit 2.

The Engineer's Estimate for the construction of the pump station upgrade project was prepared by
Krieger and Stewart Inc. in January 2009, and totals $331,000. The engineer's estimate is based on
bid data for similar projects received by CMWD in 2008 and 2007, with adjustments for current
conditions. The significant decrease in the bid amount as compared to engineer's estimate can be
attributed to the current economic conditions and reduction in costs for materials. The total
construction cost is shown in Table 3.

Sufficient funds exist in the Water Replacement Fund to construct these improvements. There are
also sufficient funds for the remaining items in Exhibit 2.
This project was advertised with prevailing wage requirements because it is a CMWD project and not
subject to the City of Carlsbad charter regulations.

2 A RESOLUTION OF THE BOARD OF DIRECTORS OF
CARLSBAD MUNICIPAL WATER DISTRICT (CMWD),
3 ACCEPTING BIDS AND AWARDING THE CONTRACT FOR THE
CONSTRUCTION OF MAERKLE PUMP STATION UPGRADE
4 PROJECT NO. 5009-B.
5 WHEREAS, the Board has determined it necessary and in the public interest to construct
6 the electrical component at Maerkle Pump Station and update the entrance gates to the site; and
7 WHEREAS, on July 28, 2009, through the adoption of Resolution No. 1366, the Board
8 approved the plans and specifications for furnishing of all labor, materials, tools, equipment,
transportation, and other expenses necessary and incidental to the construction of the Maerkley
Pump Station Upgrade Project No. 5009-B; and

WHEREAS, seven (7) sealed bids were received September 17, 2009, for the project; and
11
WHEREAS, the lowest responsive, responsible bid for the project was submitted by Neal
12 Electric Corporation dba: Nealectric, Inc. in the amount of $188,850; and
13 WHEREAS, there are sufficient funds in the Water Replacement Fund to complete the
14 project.
15 NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board
16 of Directors of the City of Carlsbad, California, as follows:
17 1. That the above recitations are true and correct.
18 2. That the bid in amount of $188,850 submitted by Neal Electric Corporation dba:
Nealectric, Inc. is herby accepted and that the President is hereby authorized to execute a contract19
with Neal Electric Corporation dba: Nealectric, Inc. for the construction of the Maerkle Pump Station
20
Upgrade Project No. 5009-B, in accordance with the plans, specifications, and contract
21
documents referred to herein.
22 3. That the Executive Manager is hereby authorized to approve construction change
23 orders up to $40,000 for Project No. 5009-B.
24 4. That the award of contract is contingent upon the bidder submitting the lowest
25 responsive bid executing the required contract and submitting the required bonds and insurance
26 policies, as described in the contract, within twenty (20) days of adoption of this resolution. The
27 Executive Manager may grant reasonable extensions of time.
