RECOMMENDED ACTION:
Adopt Resolution No.1383 ._ appointing one additional Carlsbad Municipal Water District
Director to the San Diego County Water Authority (SDCWA) Board of Directors.
ITEM EXPLANATION:
The County Water Authority Act provides for each member agency to have at least one representative
on the San Diego County Water Authority Board of Directors. In 1997, an amendment to the County
Water Authority Act (Act) changed the basis for calculating member agency vote entitlement from
assessed valuation of all property within the SDCWA service area to the total financial contribution of
each member agency. Total financial contribution includes all amounts paid to or on behalf of the
SDCWA and the Metropolitan Water District with respect to property located within the boundaries of
the member agencies. On January 1 of each year, the SDCWA Board of Directors reestablishes the
vote entitlements of member agencies based upon data from the recently completed fiscal year.
Member agencies may also designate and appoint one additional representative for each full five
percent of Water Authority assessed value within the member agency service area. The SDCWA
Board of Directors reestablishes the number of member agency representatives each year, based
upon the most recent assessed valuations which are certified by the County of San Diego Auditor and
Controller. Exhibits 2 and 3 list each SDCWA member agency's total financial contribution as of June
30, 2009 and each member agency's vote entitlement for Calendar Year 2010.
According to the assessed value provided by the County of San Diego Assessor's Office to the
SDCWA, Carlsbad Municipal Water District (CMWD) has exceeded the five percent valuation. As a
result, the President of the CMWD Board of Directors has designated and appointed Director
Blackburn as the additional CMWD representative to the Water Authority Board of Directors. Under
section 45-6 of the Act, the CMWD Board of Directors must consent to and approve the appointment.

None with this action.

APPOINTING A MEMBER TO THE SAN DIEGO COUNTY

c0 WHEREAS, an additional representative from the Carlsbad Municipal Water District may
be appointed to the San Diego County Water Authority; and

WHEREAS, the term of this appointment is for six years; and
n WHEREAS, the President of the Board of Directors can appoint a representative to
10 serve for a new term to expire six years from the date the representative is sworn in by the San
11 Diego County Water Authority; and
12 WHEREAS, no member of the Board of Directors may appoint or vote for his or her own
appointment; and
14 NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board
of the City of Carlsbad, California, as follows:

1. That the above recitations are true and correct.
