Staff will incur minor administrative costs to prepare the application. The Board has previously
approved funding for the planning and design of the facility by adopting Resolution No. 1547.
If accepted into the LRP program, MWD offers incentives in the form of monetary rebates per
acre-feet of water used. There are three options available:
• Sliding scale incentives over 25 years (up to $340/AF for 25 years)
• Sliding scale incentives over 15 years (up to $475/AF for 15 years)
• Fixed incentives over 25 years (up to $305/AF for 25 years)
Next Steps
Staff will prepare and submit the application to the San Diego County Water Authority. If
awarded funding, staff from CMWD and the Finance Department will make a recommendation
as to the most beneficial rebate program for CMWD and will return to the Board for approval of
a funding agreement.
Environmental Evaluation (CEQA)
A Final Environmental Impact Report (FEIR 03-05 SCH No. 2004041081) was prepared for the
Desalination Plant Project and certified by the City Council at its June 13, 2006 meeting in
compliance with the California Environmental Quality Act (CEQA) Guidelines Section 15090. In
2009, the City Council considered and approved an addendum to this FEIR. Flow control
facilities were considered in this first addendum, and it was acknowledged that an exact
location was not determined and would be subject to further review. Staff will review the
existing environmental documentation to determine if it is sufficient or if additional
environmental review will be required.
This action (applying for a grant) does not constitute approval of the Project under CEQA
Guidelines section 15352(a) because it does not commit the city to a particular course of action
regarding the Project.
Public Notification
This item was noticed in accordance with the Ralph M. Brown Act and was available for public
viewing and review at least 72 hours prior to the scheduled meeting date.

A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD
MUNICIPAL WATER DISTRICT (CMWD), AUTHORIZING AN APPLICATION TO
THE SAN DIEGO COUNTY WATER AUTHORITY AND METROPOLITAN WATER
DISTRICT OF SOUTHERN CALIFORNIA FOR INCENTIVE FUNDING UNDER THE
LOCAL RESOURCES PROGRAM FOR THE CARLSBAD 5 FLOW CONTROL
FACILITY, PROJECT NO. 5038.

WHEREAS, the Board of Directors of the Carlsbad Municipal Water District (CMWD) has
determined it necessary, desirable and in the public interest for CMWD to purchase desalinated water
from the San Diego County Water Authority (SDCWA) and to construct the Carlsbad 5 Flow Control
Facility, Project No. 5038 (Project) to further diversify CMWD's water portfolio and enhance supply
reliability; and
WHEREAS, on April 12, 2016, the CMWD Board adopted Resolution No. 1547 which authorized
the execution of a Uniform Contract between SDCWA and CMWD to purchase treated water from the
Carlsbad Desalination Plant; and
WHEREAS, the Metropolitan Water District of Southern California's (MWD) Local Resources
Program (LRP) provides incentive funding to water agencies located within MWD's service area for
development of local supply projects that replace existing demand on imported water deliveries; and
WHEREAS, MWD requires that water districts located within the SDCWA service area submit
applications for LRP funding through SDCWA; and
WHEREAS, staff believes the Project meets the requirements of MWD's Local Resources
Program.
NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board of the City
of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the executive manager, or designee, is hereby authorized and directed to sign and
file, for and on behalf of CMWD, an application for incentive funding under the Local Resources
Program established by the Metropolitan Water District of Southern California for the Carlsbad 5 Flow
Control Facility, Project No. 5038.

3. That CMWD authorizes the aforementioned representative, or designee, to certify that
CMWD has and will comply with all applicable regulatory requirements related to any funds received.
4. That the executive manager, or designee, is hereby authorized to negotiate and execute,
upon approval by the general counsel as to form and final approval of the contract by the Board of
Directors, a funding agreement and any amendments or change orders thereto and certify funding
disbursements on behalf of CMWD that are in substantial conformance, as determined by the office of
the general counsel, with this Resolution.

District of the City of Carlsbad on the 9th day of January, 2018, by the following vote, to wit:
