Recommended Action
Adopt a Resolution accepting bids and awarding a contract to Ferreira Coastal Construction Co.
for an amount not to exceed $9,487,655 for construction of the Recycled Water Phase Ill
Pipeline Expansion Segment 5, Project No. 5208-B, and the Miscellaneous Pipeline
Replacements, Project No. 3904 (Project).
Executive Summary
The Project is part of the Carlsbad Municipal Water District's (CMWD) $37 million Phase Ill
Recycled Water Program (Program). The majority of the Project will provide recycled water to
customers along El Camino Real, north of Chestnut Avenue, Tamarack Avenue, Marron Road,
and Cannon Road (Recycled Water Project, Project No. 5208-B). Additionally, the Project
includes replacement of potable water mains (Potable Water Project, Project No. 3904) within
the Carlsbad Palisades and Flower Fields Homeowners Associations to meet current CMWD
standards. These water mains will be replaced under the Miscellaneous Pipeline Replacements,
Capital Improvement Program (CIP) No. 3904.
Carlsbad Municipal Code subsections 3.28.080(C) and (G) require City Council approval to
award Public Works contracts when the value exceeds $175,000. The bid amount for this
Project is $9,487,655. Staff recommends accepting bids and awarding a contract to Ferreira
Coastal Construction Co.
Discussion
CMWD started its Recycled Water Program in 1990 with Phase I. The Carlsbad Water Recycling
Facility (CWRF) was constructed beginning in 2002 as part of Phase II expansion. In 2008, at the
completion of Phase II, recycled water production was approximately 4 million gallons per day
(mgd). In 2012, Phase Ill began with preparation of a feasibility study, which recommended an
expansion of the CWRF to 7 mgd, 18 miles of new pipeline, and construction of a 1.5-million-
gallon storage tank. Currently, only the storage tank and 6 miles of pipeline remain to be
constructed.

The Recycled Water Project includes construction of approximately 29,500 linear feet of 6-inch
diameter polyvinyl chloride (PVC) recycled water pipeline and services. This work includes
installation of pipelines along Tamarack Avenue from Skyline Road to Kirkwall Avenue, Kelly
Drive, Marron Road, Haymar Drive, and El Camino Real from Chestnut Avenue to Haymar Drive.
In addition to the work on Segment 5, the Recycled Water Project includes approximately 1,400
linear feet of 8-inch diameter and 500 linear feet of 6-inch diameter PVC recycled water
pipeline and services along Cannon Road for Segment 2 and a reach of Segment 7 in the
Calavera Hills area. Recycled water served from these pipeline segments will be used for
landscape irrigation.
The Potable Water Project includes construction of approximately 1,850 linear feet of 8-inch
diameter and 4,100 linear feet of 6-inch diameter PVC potable water pipeline and services. The
water main improvements will be completed in the vicinity of the Segment 5 recycled water
work and will be included in this Project to minimize construction impacts to residents and
capitalize on construction savings due to economies of scale. The improvements will be
completed within the Carlsbad Palisades development near Tamarack Avenue and El Camino
Real, and throughout the development on Flower Fields Way off Avenida de Anita.
On July 17, 2017, through the adoption of Resolution No. 1601, the CMWD Board approved
plans and specifications and authorized the secretary of the Board to advertise to receive bids
for the Project.
On Aug. 29, 2018, 11 sealed bids were received for construction of this Project as shown in the
following table:

Ferreira Coastal Construction Co. submitted the lowest bid in the amount of $9,487,655. The
engineer's estimate of the construction cost of the Project was $10,100,000. A summary of the
bid schedules is shown in the table below:

The construction contract contains general performance standards, referenced technical
specifications, and includes a one-year warranty period. A five percent retention will be
withheld from each progress payment until final acceptance of the Project. The construction
contract includes liquidated damages which may be assessed in the amount of $3,000 per day
for each day in excess of the time specified for completion of the work.
Staff has completed review of the bid documents and has determined that Ferreira Coastal
Construction Co. is the confirmed low bidder. Ferreira Coastal Construction Co. submitted a list
of similar projects to show their capabilities and qualifications to perform the specified work.
Staff recommends that Ferreira Coastal Construction Co. be awarded the contract.
Fiscal Analysis
The estimated total cost of the Recycled Water Project is $9,281,658 and it will be funded by
the Clean Water State Revolving Fund (SRF) via Recycled Water Ill Pipelines Program, CIP No.
5208. The estimated total cost of the Potable Water Project is $2,817,763 and it will be funded
by the Miscellaneous Pipeline Replacements Program, CIP No. 3904. The total estimated cost of
the Project is $12,099,421 and includes the following: construction contract, contingency for
change order management, construction management and inspection, engineering support for
contractor shop drawings, requests for information and meetings, and community outreach. A
summary of the available funds and estimated construction costs are shown in the tables
below:

Next Steps
Once contract documents are fully executed and a purchase order is issued, staff will schedule a
pre-construction meeting with Ferreira Coastal Construction Co. and a Notice-to-Proceed will
be issued. The consultant cultural monitors for the Project have indicated that additional
monitoring may be required which could impact the construction schedule. The duration ofthe
construction contract is 375 working days, exclusive of rain days and change orders that may
extend the contract duration. Upon successful completion of the Project, staff will record a
Notice of Completion to release bonds.
Environmental Evaluation (CEQA)
On Nov. 27, 2012, CMWD adopted Resolution No. 1455 approving a Mitigated Negative
Declaration (MND) and Mitigation Monitoring and Reporting Program (MMRP) for the Phase Ill
Recycled Water Project (EIA 12-02). This Project is a sub-component (ES 5) of the Phase Ill
Recycled Water Project and is subject to the Mitigation Measures (MM) that are identified in
the MMRP.
On July 17, 2018, CMWD adopted Resolution No. 1601 approving an Addendum to the MND
and Supplemental Environmental Package which included extensions to Segment 5, the
Segment 7 reach and the Potable Water Project that were not originally analyzed in the MND
prepared for the Program.

The Project is within the scope of the prior environmental documents and no further
environmental documentation is required per CEQA Guidelines Section 15162. All applicable
mitigation measures contained in the prior environmental document have been incorporated
into the construction documents.
Public Notification
This item was noticed in accordance with the Ralph M. Brown Act and was available for public
viewing and review at least 72 hours prior to the scheduled meeting date. Prior to the start of
construction, the public will be notified of the construction activities using media methods such
as signage, email, website and other city c9mmunication channels. The construction contractor
will also be required to notify the public of construction activities via changeable message signs,
door hangers, letters to property owners, and/or "NO PARKING" signs, as applicable.

WHEREAS, the Carlsbad Municipal Water District (CMWD) Board of Directors of the City of
Carlsbad, California has determined it necessary, desirable, and in the public interest to install
approximately 1,400 linear feet of 8-inch diameter and 30,000 linear feet of 6-inch diameter polyvinyl
chloride (PVC) recycled water pipeline and 1,850 linear feet of 8-inch diameter and 4,100 linear feet of
6-inch PVC potable water pipeline; and
WHEREAS, on Nov. 27, 2012, CMWD Board Resolution No. 1455 approved an environmental
impact assessment that was conducted for the Phase Ill Recycled Water Program, and a Mitigated
Negative Declaration (MND) and Mitigation Monitoring and Reporting; and
WHEREAS, on May 16, 2018, Planning Commission Resolution No. 7296 approved a Coastal
Development Permit and Special Use Permit to construct the Project; and
WHEREAS, on June 11, 2018, California Coastal Commission issued a Coastal Development
Waiver (6-18-0345-W) to construct the Project; and
WHEREAS, on July 17, 2018, CMWD Board Resolution No. 1601 approved plans and
specifications, and authorized the secretary to the Board to advertise to receive bids for the
construction of the Recycled Water Phase Ill Pipeline Expansion Segment 5, Project No. 5208-B
(Project); and
WHEREAS, on July 17, 2018, CMWD Board Resolution No. 1601 also approved an Addendum to
the MND and Supplemental Environmental Package; and
WHEREAS, on Aug. 29, 2018, 11 sealed bids were received by CMWD for construction of the
Project; and
WHEREAS, the lowest responsible bid was submitted by Ferreira Coastal Construction Co. in the
amount of $9,487,655; and
WHEREAS, funds have been appropriated from the Recycled Water Phase Ill -Pipelines, CIP No.
5208 and Miscellaneous Pipeline Replacements, CIP No. 3904 and are sufficient for completion of this
Project; and

WHEREAS, subsection 3.28.040(()(5) of the Carlsbad Municipal Code authorizes the executive
manager to approve change orders in the amount equal to the contingency set at the time of project
award.
NOW, THEREFORE, BE IT RESOLVED by the CMWD Board of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.
2. That the bid in the amount of $9,487,655 submitted by Ferreira Coastal Construction
Co. for construction of the Recycled Water Phase Ill Pipeline Expansion Segment 5, Project No. 5208-B,
is accepted and the president of the Board is hereby authorized to execute a contract with Ferreira
Coastal Construction Co.
3. That the executive manager or designee is hereby authorized to approve construction
change orders up to $948,766.
4. That the award of this contract is contingent upon the bidder submitting the lowest
responsible bid, executing the required contract and submitting the required bonds and insurance
policies, as described in the contract, within 20 days of adoption of this Resolution. The executive
manager may grant reasonable extensions of time.
