RECOMMENDED ACTION:
Refer item to the "Special Programs/Projects" sub-committee
to work with staff in review of the issues and alternatives,
as requested by City Council.
Return with recommendations by the March Commission meeting.
ITEM EXPLANATION;
At the January 10, 1989 Council meetings, Ordinance NS-51 was
introduced to amend the Municipal Code to prohibit dogs on
the beaches and parks. In addition, Council directed staff
to review alternatives and refer the matter to the Parks and
Recreation Commission for review and recommendations.
On January 17, 1989 Council adopted the Ordinance NS-51 and
it becomes effective June 1, 1989.

This agenda bill was prepared at the request of Council Member Kulchin in
esponse to a citizen's complaint. It suggests the Council consider amending
Carlsbad Municipal Code Section 11.32.030(11) to prohibit dogs from Carlsbad's
>arks and beaches. The amendment does not apply to any of Carlsbad's lagoons.
[n addition the prohibition does not apply to dogs accompanying an unsighted
jerson or dogs participating in shows or obedience classes authorized by the
Carlsbad Parks and Recreation Department or specified areas of parks and beaches
or dogs while assisting a peace officer in law enforcement duties. The code
presently allows dogs when they are on a leash. The ordinance, which is
attached, would eliminate the exception. If the Council concurs you action is

ORDINANCE NO.NS-51
AM ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA AMENDING TITLE 11,
CHAPTER 11.32 OF THE CARLSBAD MUNICIPAL CODE
BY THE AMENDMENT OF SECTION 11.32.030(11) TO
PROHIBIT DOGS FROM ALL CITY BEACHES AND PARKS
The City Council of the City of Carlsbad, California does
ordain as follows:
SECTION I: That Title 11, Chapter 11.32 of the Carlsbad
Municipal Code is amended by the amendment of Section 11.32.030(11)
to read as follows:
"(11) To ride or lead horses, or to hitch, fasten, lead,
drive or let loose any animal or fowl of any kind. Dogs are not
allowed in Carlsbad's parks or on Carlsbad's beaches.
Notwithstanding any other provisions of this chapter,
this section does not apply to the Batiguitos Lagoon, Buena Vista
Lagoon or Agua Hedionda Lagoon.
This prohibition does not apply to a dog accompanying an
unsighted person, dogs while assisting peace officers in law
enforcement duties, or to dogs participating in shows or obedience
classes authorized by the Carlsbad Parks and Recreation Department
on specified areas of parks or beaches."
EFFECTIVE DATE: This ordinance shall be effective June
1, 1989, and the City Clerk shall certify to the adoption of this
ordinance and cause it to be published at least once in the
Carlsbad Journal within fifteen days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council on the 10th day of January , 1989 ,
and thereafter
