RECOMMENDED ACTION:
Accept and file.
ITEM EXPLANATION;
During the November Commission meeting, the Commission directed staff to respond to
Commission inquiries regarding the Carlsbad Unified School District Board agenda item
relating to school playfield use. Staff has prepared the attached memo identifying the
inquiries and staff comments relating to those issues.

PARKS AND RECREATION COMMISSION INFORMATION REQUEST
During the November 19, 1990 Parks and Recreation Commission
meeting, the Commission requested that staff investigate and
respond to the following concerns relating to several items on the
agenda :
Concerns Raised;
1. Public use of school facilities on Sundays and closure
of fields for maintenance.
2. Signs stating "No Playing After Dark" at Mission Estancia
Elementary School.
3. Use of Aviara Oaks Elementary School playfield (Joint Use
Agreement) .
4 . Design and use of Aviara Junior High School and
communication issues.
5. Hitting golf balls into the ocean.
l. Use of school facilities on Sundays
Due to the unscheduled use by outside groups; staff developed,
departmental policy #32. This policy requires organized user
groups to submit a use permit and obtain approval prior to use
of any school facility. The policy also limits use by any one
group to every other Sunday.
On October 24, 1990 the C.U.S.D. Board of Trustees approved the
Department's policy and additionally recommended the following:
a. Post signs in English and Spanish regarding use of fields
(signs have been posted as of November 16, 1990) .
b. Requested that the City submit the master calendar of
those groups utilizing the school facilities to the
District office (information sent as of November 29,
1990) .

c. That the District continue to work with the City
regarding the unauthorized organized leagues utilizing
the Districts facilities on Sundays.
d. That the District implement a policy regarding closing
the fields for a (30) day rest period during the school
year.
2. Signs stating "No Playing After Dark"
According to the E.U.S.D. Superintendent, the signs were put
up at all their school sites for safety and liability reasons.
This restriction does not create a negative impact on our
recreational programming.
As a part of the City Council Goals and Objectives staff has
contacted the Encinitas School District requesting that we
enter into a joint use agreement of the Mission Estancia
Elementary School playfields. This request is being processed
through the Districts' office at this time.
3. Use of Aviara Oaks Elementary School playfields
Staff, on several occasions, prior to the design and
development of the Aviara Oaks Elementary School playfield,
had discussed joint planning efforts between the City and
C.U.S.D. with the Business Manager, John Blair, and Manager
of Facility Operations, DeWayne Feasel. Although the primary
function for this playfield is to serve and meet the needs of
the elementary school children, Parks and Recreation staff
requested that consideration be given in an effort to also
meet additional community recreational needs. Staff was not
given an opportunity to review the Districts proposed plans.
In reviewing the finished product of the schools playground
as it is laid out today, staff has determined it may not be
in the best interest of the City on entering into a joint use
agreement because of safety concerns, drainage culvert,
grading, and insufficient size of the softball field.
District officials have indicated that it was a design issue
and that they were going to wait until the playfield grass
has germinated before taking any action of retrofiting.
The Board of Trustees also directed their staff to not enter
into a joint use agreement with the City until the landscaping
has had a chance to mature, approximately one (1) year.

Therefore, until the safety concerns are rectified and the
landscape is in a mature state, staff is not proposing to
enter into a joint use agreement with the District at this
time.
4. Designs and communication issues regarding the Aviara Oaks
Junior High School
In addressing the current Aviara Oaks playf ield situation with
C.U.S.D. staff, Parks and Recreation Department staff has
reiterated several times to be included in the design and
possible development of the future junior high school
playfield. This issue is scheduled to be addressed by the
City/School District Coordinating Committee at the next
possible meeting. One reason for delay in the Coordinating
Committee meetings to date has been a change in members on
both the City Council and the School Board. However, this
issue is paramount to department staff in terms of providing
for optimum recreation facilities which is clearly defined as
a goal of the Parks and Recreation Element.
5. Hitting golf balls into the ocean
There are no known rules on hitting golf balls into the ocean.
According to the local State Recreation and Beach Director
it's a common sense issue. "The State would not allow such
an activity due to safety and liability issues. The beach is
not the place to practice golf".
