TITLE: ZONE 8 LOCAL FACILITIES MANAGEMENT PLAN (INFO) RECOMMENDED ACTION: Receive information regarding the affects of litigation on the park requirements associated with Zone 8 of the Local Facilities Management Plan (LFMP). ITEM EXPLANATION; During the January Commission meeting, it was requested that staff review the affects of litigation surrounding Zone 8 LFMP with respect to park dedication requirements. The affect of pending litigation will essentially delay the developer's contribution of the following park requirements for Zone 8. 1. The development of 6.7xacres which is currently identified in the CIP Budget and funded with Public Facility Fees (PFF). L^OA c^q. 7.000 Gx//w>^v\ poKk. 2. Staffs ability to discuss and negotiate the dedication of park property to meet the park requirements based upon projected population of the Kaufman and Broad development. The subject property was the issue discussed as part of the 11+/- acres on the north shore of the Agua Hedionda Lagoon and as identified in the Northwest Quadrant Park Enhancement Report. 3. In lieu of the aforementioned parkland dedication, the collection of PIL fees will be delayed and may affect the City's ability to acquire and/or develop (in a timely fashion) the property identified as the future community park in the Northwest Quadrant Park Enhancement Report (Magnolia acquisition). FISCAL IMPACT; No loss in fiscal impact in terms of park acquisition or development is anticipated to occur. However, the funding and hence, development will be delayed. 48
