TITLE:A o M C(C\ 5 - n o r ^^^^ RECEIPT OF DONATIONMTG.M'2-0-4^(ACTION) RECOMMENDED ACTION: Receive donation of $1,655 from the Friends of Carrillo Ranch and recommend acceptance by the City Council. ITEM EXPLANATION: The need for minor restoration work to the Dee Dee House structure at the Carrillo Ranch has recently been identified (Exhibit 1). The Friends of Carrillo Ranch have offered to donate $1,655 to the City of Carlsbad in order to fund the necessary repairs (Exhibit 2). According to City Ordinance No. 1295, donations over the amount of $500 must receive City Council approval. If the Commission concurs, staff will proceed towards City Council approval. EXHIBITS: 1. Letter to Parks and Recreation Director - September 11,1993. o< gen Oo 1 4^ — * September 8, 1993 TO: ASSISTANT CITY MANAGER VIA: Parks and Recreation Director FROM: Senior Management Analyst RESTORATION WORK AT CARRILLO RANCH A situation has recently been brought to the attention of the department which requires minor building restoration work to the Dee Dee House structure at the Carrillo Ranch. A crack in the adobe structure has occurred and should require immediate repair. The issue has been reviewed by Eagle Restoration and Builders who were the contractors for major restoration work last year which was made possible by a grant award from the State Office of Historic Preservation. Because of Eagle's close ties with the project, a window of opportunity between completion and start up of other contract projects and their expertise in adobe restoration work, they had originally offered to perform the work at a reduced cost of $1,300. The Purchasing Department recently forwarded the requisition and Letter of Agreement (LOA) to Eagle. In the LOA, a number of requirements necessary of a public works contract has required the company to increase their bid. Those requirements specifically are: 1. To pay prevailing wage. 2. Secure a City of Carlsbad Class B building permit, and 3. Obtain an insurance rider to name the City as additionally insured. The increase to their original bid is $355 for a total of $1,655. However, the $1,655 bid does not include the cost ($125 approximately) to obtain an insurance rider to name the City as additionally insured. With the original bid of $1,300, the Friends of Carrillo Ranch had offered to donate the money in order to fund the project. Somewhat hesitant, the "Friends" have now offered to fund the project at $1,655. However, with limited resources, they cannot fund over that amount. EXHIBIT 1 At this time, the remaining unfunded amount is $125 to purchase an insurance rider to name the City as additionally insured. The options to resolve this unfunded amount are: Waive the insurance requirement. Pay for the insurance rider with general funds. Pay for insurance rider with funds from the Carrillo Ranch Trust. Recommendation: Waive the insurance requirement to name the City as additionally insured. This minor restoration project has a low risk liability exposure to the City especially in light of the Ranch site currently not being open to the public. During the construction process there will be no public exposure and, therefore, no risk of public liability at the job site. An insurance rider would serve only to insure the future prospect of liability exposure as a result of Eagle's workmanship (i.e. the building collapsing on someone in future years). However, Eagle has previously provided an insurance rider during major restoration work completed in 1992, and the benefits of that rider policy would apply in a worst case scenario. In addition, Eagle's restoration work has exhibited a high degree of experience and professional craftsmanship in past projects at the Ranch, and they will submit a Certificate of Insurance ($1,000,000) to the City if allowed to proceed with the project at a cost of $1,655. We have three stipulations. (1) The work will be performed only by Eagle Restorations & Builders, Inc. of Sierra Madre; (2) there will be no invasion of the Carrillo Ranch Trust Fund for this project; and (3) the Agenda Bill sent to City Council .for acceptance will include recognition for the participants listed below: • Milford Wayne Donaldson, Restoration Architect (San Diego), for his pro bono consulting services and his personal appeal to the contractor for assistance at minimal cost; • Eagle Restorations (Sierra Madre), for greatly reducing the company's normal charges in the interest of historic preservation; and, • The Reuben H. Fleet Foundation (San Diego), for its financial contributions to the Friends in recognition of Carrillo Ranch's unique potential as an educational resource, thus making this grant possible. Although not a condition, we are hopeful you can arrange for the Engineering Department to provide oversight on a courtesy basis. We have the $1,655 in hand. When you are satisfied that the work has been completed as agreed and are ready to pay the contractor, please notify us and we will immediately remit the funds to the City. Thank you.
