ITEM EXPLANATION: The Lightning Soccer Club is requesting (Exhibit 1) the Parks and Recreation Commission consider their request to not create a skinned infield on the baseball/softball field overlay located at the southeast corner of the existing soccer field at the Aviara Oaks site. In order to provide advanced development of the Aviara Oaks activity play fields, the City of Carlsbad entered into agreements with the State of California, Carlsbad Unified School District, La Costa Youth Organization and Lightning Soccer Club (formerly Leucadia/La Costa Soccer Club). During negotiations with all organizations, the attached map (Exhibit 2) was used to define development strategies. Based upon our departments philosophy of providing multi-use play fields to maximize available resources, the baseball/softball field overlay at the southeast corner of the "^ccer field was designated to be skinned in order to maximize field use during the baseball ^eason. Although the vast majority of the soccer field depicted on the master plan will remain turf, the Lightning Soccer Club is requesting that the City not skin the infield on the southeast field in order that the seasonal soccer play will remain entirely on a turfed surface. Furthermore, Lightning Soccer has indicated that they understood the infield would remain grass and therefore not affect the turfed soccer field. (Exhibit 3) In an attempt to satisfy the skinned infield needs for seasonal baseball play and the turfed surface needs of seasonal soccer play, staff has tried to reconfigure the field layouts by moving backstops and resituating the existing soccer field. Although in staff's opinion the impact of the skin infield will be minimal, a reconfiguration of the fields will not avoid the encroachment of the skinned infield upon the soccer field. EXHIBITS: 1. Whereas, in order to promote the health and general welfare of the Carlsbad Community, there is a need for community groups to assist in the development and maintenance of sport fields on City and/or Carlsbad Unified School District (District) land for the youth of Carlsbad. Whereas, the District is the owner of certain undeveloped real property, commonly referred to as "Aviara Oaks Middle School.". Whereas, Leucadia/La Costa sponsors, organizes and conducts sport activities participating in recreation programs where field play is scheduled by the City's Community Services Department. Now, therefore, based on good and valuable consideration and in consideration of promises contained herein, Leucadia/La Costa Soccer Club agrees as follows: 1. Leucadia/La Costa Soccer Club agrees to contribute annually for a two- year period $7,500 of private contribution, where funds will be used for the development of Phase III (turfed soccer field) and for maintenance costs. These maintenance costs include water, mowing, fertilization, irrigation repair, and general turf maintenance. Maintenance costs not covered by this agreement include litter control/removal, field marking, portable rest room facilities, which shall be the responsibility of the youth 048 EXHIBIT 4 organization. This $7,500 payment shall be due in March of each year, beginning in 1995. 2. Leucadia/La Costa Soccer Club does hereby agree and understand that even though they have provided funds and improvements to the City for the development and maintenance of the Aviara Oaks Middle School athletic fields, that Leucadia/La Costa Soccer does not have exclusive use of this facility. However, notwithstanding the above in consideration for Leucadia/La Costa Soccer providing the funds for the maintenance and improvement of the fields, the District and the City of Carlsbad hereby agree that the Leucadia/La Costa Soccer Club shall have priority consideration of the fields for soccer use, subject to District events and programs. Use of the fields at other times, including that by Leucadia/La Costa Soccer, shall first be through and in accordance with the permit system utilized by the Carlsbad Community Services Department. All other use given third priority shall be in accordance with District procedures for use of District facilities. 4. Leucadia/La Costa Soccer Club agrees to indemnify, defend, and hold District and City harmless from and against any and all claims arising from any breach or default in performance of any obligation on Leucadia/La Costa Soccer Club's part to be performed under the terms of this agreement, or arising from any act, neglect, fault or omission of Leucadia/La Costa Soccer Club or its agents, contractors, employees, servants, or volunteers, and from and against all costs, attorney's fees, 049 expenses and liabilities incurred in the connection with such claims or any action or proceeding brought thereon. 5. The term of this agreement shall be for two (2) years renewable on a year to year basis thereafter by mutual agreement. In Witness thereof, the parties hereby have executed the agreement as noted. CA 92008-1989 • (619) 434-2825 • FAX (619) 434-7185 ® Amendment fl to Agreement dated 9 February 1995 between City of Carlsbad 6 Leucadia/La Costa Soccer Club Hereinafter referred to as the Agreement Leucadia/La Costa soccer Club (currently now known as Lightning Soccer Club, Hereinafter referred to as "Lightning") and the City of Carlsbad, hereinafter referred to as "City" mutually agree to modify the Agreement between City and Lightning as follows: 1. Lightning will pay up to $6.650.00 for the material required to plant the 5 acre cite for the development of Phase III (turfed soccer field). This fee will be due and payable to J. D. Flannigan Stolon Planting Service, hereinafter referred to as "Fiannigan's" consistent with their quotation dated 7 Mar 95 provided to J. Rodriguez of the Parks and Recreation Dept in Carlsbad. 2. Lightning will also agree to pay for a forklift rental from Hawthorne Rentals should it be determined necessary by Flannigan or City based on availability of the city forklift. The maximum rental period authorized is one (l) day. 3. Lightning, at their expense, will also agree to provide a fence around the turfed soccer field for a period up to sixty (60) days in order to protect the field from trespass. 4. City agrees to provide all labor and material necessary to prepare the turfed soccer field prior to the scheduled planting of the stolons. The current scheduled date for planting is 2QApr 95 (7AM). City also agrees to provide ae a minimum four (4) workmen to ride on the planter to feed the sod.5. City agrees to examine the condition of the turfed soccer field during the 90 day period following the planting for damage, uniform growth of the turf, and proper irrigation. The City will contact Fiannigan's to replant any poor growth areas where Fiannigan's will provide the material and the City will provide the labor. 6. As an inducement for the above financial liability by Lightning, city agrees to forgo the $7,500 that was committed to be paid in March 1995. The remaining $7,500 scheduled to be paid in March 1996 will still be a committed liability of the Lightning. All other terms and conditions of the Agreement are considered to be unchanged.
