DOG PARK STATUS REPORT
RECOMMENDED ACTION:
Accept and file staff report.
ITEM EXPLANATION:
During the May meeting, the Commission requested a status update on the Dog Park. The
Recreation Director will provide that information and be available to answer specific questions.
Attached as Exhibit-I, is the most recent correspondence from the Planning Department outlining
pending issues relating to the need for Carlsbad Municipal Code amendments, Environmental
review and documentation,Conditional Use Permit and public input.
To date, a Park design tias been prepared and submitted as part of Councils consideration and
direction to proceed through the Planning Department for further processing at the Planning
Cofnmission. As the memo from the Planning Department states, prior to consideration by the
Planning Commission a Municipal Code revision must .address the issue to allow dogs at the
subject site. Consequently, staff will be submitting that amendment for review with the City
Attorneys Office in the near future. Once the amendment is approved by City Council, the CUP
process can proceed by the Planning Department and Planning Commission.

CONDITIONAL USE PERMIT (CUP 00-07) - LARWIN DOG PARK
Our ofice has received the Recreation Department's application package for a CUP to establish a
temporary dog area at Larwin Park. This memo is to advise you of processing, and other, issues.
I. Carlsbad Municipal Code (CMC) Amendment and the Conditional Use Permit (CUP)
At the City Council meeting, where the temporary dog park concept was considered, it was
highlighted that Section 11.32.020 of the CMC currently prohibits dogs in public parks. At the
meeting, Council directed staff to return to them with a CMC amendment to allow dogs on the
subject site, and to refer the matter to the Planning Department for the processing of a CUP and the
associated environmental review. The Planning Commission can not allow, through the conditional
use permitting procedure, a use which is expressly prohibited by the CMC. The CMC amendment,
which would allow dogs at the park subject to a CUP, will need to occur prior to bringing any CUP to
the Planning Commission. It is our understanding that the Recreation Department will take the lead
on the CMC amendment.
c 2, Environmental Review and Documentation
Planning staff will be responsible for environmental analysis and documentation. Environmental
review will occur for each part of the project - the CMC amendment and the CUP. A preliminary
environmental analysis of the project indicates that any potential environmental impacts (Le. noise,
odor, water quality, traffic etc.) are either insignificant, or can be mitigated to a level of insignificance.
As you know, as part of the preliminary analysis the Recreation Department contacted several cities
in the area regarding their dog parks. It was reported by those cities that no significant
environmental issues exist. Therefore, planning staff intends to initiate the process for potential
adoption of a Mitigated Negative Declaration for this project. Please provide us with details on the
proposed CMC amendment (Le. will the CMC amendment be applicable to Latwin Park only, what
and where are the CMC text proposed changes). Once provided we will begin preparing the
environmental documents for the required 30 day public notice.
3. Public Input
The proposed project represents a new type of recreational use/park facility for the City, and could
prompt diverse and significant community opinion. A certain degree of community input should be
sought.
