DATE: 10/16/00 TITLE : INFO 0 ACTION Accept and file staff update. ITEM EXPLANATION : Staff will provide a brief update to the Commission on the progress of the development of a temporary Dog Park at Larwin Park. Attached is communication from the staff liaison at the Planning Department who is responsible for further processing of this issue through the Planning Commission. EXHIBITS: 1. The CC introduce the MCA relating to dogs in parks on 8/5 and had the second reading of the ordinance on 8/15. This was done without environmental review (ie CEQA), per the direction of the City Attorney's Office. The MCA will be effective on 9/15. In response to your question regarding the permitting process for the dog park ... Per the CC direction of 1/11/2000, and now that the MCA will soon be in place, I will begin processing the project with a conditional use permit. Per section 21 S0.040 of the CMC, CUPS are considered by the Planning Commission. Per the CMC, the Planning Commission renders the final decision, unless appealed to CC. Absent any language in the CMC requiring the CUP be processed differently, or any direction to process it otherwise, I will process the CUP as prescriberj in the CMC. Our department has a lead time of approximately 8 weeks for scheduling and preparing items for the Planning Commission. Plan on a meeting in November. In the next few weeks we will be conducting an analysis/environmental review of the project, which will result in the preparation of a staff report, a Mitigated Negative Declaration (the environmental document), and a planning staff recommendation of conditional approval. As soon as these documents are available, they will be transmitted to your office for comment. Its my understanding the Mark Steyaert will be the point of contact.
