DATE: | 10/20/08 STAFF: | ELLIOTT UPDATE ON CHASE FIELD CONCESSION STAND INFO ACTION RECOMMENDED ACTION : Receive staff report regarding Chase Field Concession Stand. ITEM EXPLANATION : Chase Field Concession Stand consists of 850 square feet, which has been actively used by Carlsbad's youth baseball, softball, and football activities for the past 30-plus years. Volunteers originally constructed the stand with improvements done in 1980s from City funds. In 2001, the City determined that the facility was in need of replacement and proposed replacing the existing single-story building with a 2,692 square foot, two-story building. Use of the new building would continue to be for restrooms, concessions, and storage. In addition to the renovation plans, the project included the installation of two batting cage facilities. Carlsbad Youth Baseball organization reviewed the plans and was in agreement with the project. On November 20, 2000, the City's Parks and Recreation Commission reviewed and approved the project. And, on February 7, 2001, the City's Planning Commission adopted Resolution No. 4907 approving CUP 00-16 for the project so it could go out to bid. It was estimated that the project would cost $160,000. Five bids were received, opened, witnessed, and recorded on December 18, 2001. The bids ranged from $442,989 to $539,300. In accordance with Section 22038 of the Public Contract Code staff recommended rejection of the bids due to the lowest bid being well over the $160,000 and the uncertainty of the facility during the master planning of Pine/Chase Park Complex. Staff then met with representatives from Carlsbad Youth Baseball (CYB) organization, the primary user of the facility, to discuss cosmetic modifications to the existing building. CYB agreed to the modifications and staff completed the upgrades, at a cost less than $30,000, in January 2002. Over the years the laws regarding food sales has tightened. In October 17, 2007, staff met with the County Health Department to inspect the Chase Field Concession Stand in order to identify areas of the building that would need to be modified in order to bring it up to code for permitting. The sale of pre-packaged food and open food items were addressed. If selling pre-packaged food/drink no permits or food handling certifications/food handling manager certification would be required. The building would not need any modifications. At the time of the building review, staff was informed of several areas that would need to be addressed prior to obtaining a building permit in order to sell open food product. No costs were obtained due to the extensive amount of work that would be required. In May 2008, staff again contacted the Health Department to get clarification on the sales of open food by youth sports organizations and it was determined that these leagues could sell to their participants, participants' families and friends without obtaining a permit. They could not sell to outside consumers. Signs could be posted stating that fact in order to alleviate the need to provide proof of participation. Staff recommends that youth sports organizations post signs when selling concessions stating that sales are only for their organization's participants, families, and friends; no outside consumers allowed.
