SUBJECT: ZC-213 -ECI<E -Request for a change of zone from
L-C (Limited Control) to CT (Tourist Commercial) on
property generally located on the northwest corri.er
of Paseo Del Norte and Palomar Airport Road.
As the Planning-Commission will recall,. this item was continued
from the July 9, 1980·, meeting pending t~e approval of a
General Plan Amendment on the property by the City Council.
This amendment changed the. land use designation of the property
from NRR (Non-Residential Reserve) to TS (Travel Service
Commercial) and was approved on August 5, 1980. The proposed
zone change to CT is consistent with the TS land use designation.
RECOMMENDATION
It is recor.rrnended that the Planning Commis;:ion ADOPT Resolution
No. 1669, recommending APPROVAL of ZC-213 to the City Council
'9hanging the zone from L-C to CT based on the findings contained
therein.

. As the Planning Comnission will recall, a General Plan Arren&r.ent
(GPA 50 (B)) v.>as reco~....nded for approval to the Cit.y Council on
June 19, 1980 changing the existing NRR (Non-Residential Reserve)
designation to'l'S (Travel Services). 'Ihe requested zone change .to
CT--0 is consistent with the TS designEition of the General Plan.
II. ANALYSIS

DISCUSSION
'J.'he TS (rrravel Services) designation of the General Plan is intended
to provide for travel oriented uses on major regional corridors.
'lhe C-T zone also allows for travel and tourist oriented uses and
j_s the-rrost · c.,umpc1tible zone with the TS designation. Given the
intent of the appl:i.cm1t to develop his pro~rty as a notel, rest-
aurants, service station and related cornrr~-:rcial facilities and the
Gener?l Plan desi9na tion of rrs, the Cl' zone w:>ul<l be tJ1e nnst
ideally suited for the site and is consistent wlth the· General
l'lnn.

'.rhe site is 15.31 acres in size and relatively flat. As shown on
the location map, there are two buildable areas on the lot. 'file
smaller of the twv to the north abuts the southern l:oundary of Car
Country, and the other locat.ed to the south is adjacent to Palomar
Airf:ort Road. The applicant has suJ::mitted a preliminary site plan
indicating the use of the northern rortion of the site as a dinner
oriented restaurant and the southern :r;ortion as a 108 unit notel, a
restaurant (Pea Soup .Andersons} and a service station. A pre-
liminary site plan will be on display at the Planning carmission
. meeting for the Conmission' s infonna.tion. Staff has found that the
site is suitable in size and shape to acconm:xlate the proposed
uses.
In terms of adjacent land uses, the Dixon Ford Car l)ealership abuts
the site to the north, a vacant parcel and flower field are to the
e.ast, I-5 and a mixture of industrial and COITIT',erical uses are to
the west, and a restaurant and service station to the south. M:)st
uses in tjle vicinity of l-5 and Palomar Airport Road are travel
service orient.::.--.a., thus the prop::,sed use of the applicant's site as
a m:>tel and restaurant is compatible with surrounding land uses.
Surrounding zoning includes C-2 to the north, R-A-10,000 to the
east, C-2 to the south, and P-M and .c-2 to_ the west. A C-T zope
·. district would allow uses vhlch are compatible with uses allowed b1
t11e surrounclLng zones. Staff has found that the er zone and land
uses allowed under the CT zone are compatible with adjacent land
uses and zoning.
III. RECOMMENDATION
It is recom:n2l1ded that the -Planning Conmission AOOJ?T R~solution No.
1669 , recommending APPROVAL of ZC 213 to the Cit.-y Council based on-
the findings contained therein.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF A ZONE CHANGE FROM L-C (LIMITED
CONTROL) TO CT-Q (COMMERCIAL TOURIST WITH A
Q OVERLAY) ON PROPERTY GENERALLY LOCATED ON·
THE NORTHWEST CORNER OF PALOMAR AIRPORT ROAD
AND PASEO DEL NORTE.

WHEREAS, a verified application for certain property, to wit:
That portion of Lots G and Hof Rancho Agua Hedioha, Map
No. 823, County of San Diego, filed November 16, 1896.
has been filed with the City of Carlsbad, and referred to the
Planning Commiss1on; and
WHEREAS, said.application constitutes a request as provided
by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on· the 9th day of J'uly,

WHEREAS, at said public hea~ing, upon hearing and considering
all testimony and arguments, if any, of all persons desiring to
' ·be heard, said Commission considered all factors relating to the
Zone Change; and
, NOW, THEREFORE, BE I'I' HEREBY RESOLVED by the Planning
Commission as follows:
That the foregoing recitations are true and correct.

That based on the evidence presented at the public hearing,
the Commission recommends APPROVAL of ZC-213, based on the
following findings and subJect to the following conditions:
Findings:
1) The proposed change of zone to CT-Q is consistent with the
General Plan designation of TS for the reasons stated in
the st~ff report.

The site is· physically suitable for the type of uses
allowed in the CT-Q zone for the reasons stated in the
staff report.
The applicant has agreed and is required by the inclusion of
an appropriate condition to pay a public facilities fee.
Performance of that contract and payment of the fee.will
enable ·this body to find that public facilities wili be
available concurrent with need as required by the General
Plan.·
The proposed change of ·zone will not cause any substantial
environmental impacts, and therefore, ~he Planning Director
has issued a Declaration of Negative Environmental Impact for
the project dated May 29, 1080, Log No. 707.
The proposed change of zone is consistent with all other
elements of the General Plan.
Conditions
1) A change of zone from LC to CT-Q shall be for that property
as shown on Exhibit "A" dated .May 20, 1980.
14 2 ) This project is approved upon the express condition that
the applicant shall.pay a public facilities fee as required
by City Council Policy No. 17, dated August 29, 1979, on
file with the City Clerk and incorporated herein by
reference, and acdording to· the agre~ment executed by the
applicant for payment of said fee a copy of that agreement
_dated June 11, 1980, is on file with the City Clerk and is
incorporated herein by reference. If said fee is not paid

as promised, this application will not be consistent wi'th
the General Plan and approval for this project shall be.void.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Plan~ing Commission of the City of Carlsbad, California, held on
