SUBJECT: SUP 88-02(B}/CUP 92-0S{A} -CMWD STORAGE TRAILER-Request for a
Special Use Permit Amendment and Conditional Use Permit Amendment to allow
the placement and use of a storage trailer in the CMWD maintenance yard,
located east of El Camino Real between Palomar Airport Road and Faraday
Avenue, in Local Facilities Management Zone 5.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolutions No. 3953 and 3954,
APPROVING Special Use Permit Amendment SUP 88-02(B) and Conditional Use Permit CUP
92-08(A), based upon the findings and subject to the conditions contained therein.
II. INTRODUCTION
This request involves the placement of an approximately 670 square foot mobile office in the
existing Carlsbad Municipal Water District maintenance yard. The trailer would be used for
storage and inventory of parts. A Special Use Permit Amendment is needed since the site is
proximate to the El Camino Real scenic corridor and a Conditional Use Permit Amendment is
required to locate and use the additional, accessory public utility building. The site is zoned
Industrial with a Qualified Development Overlay (M-Q), however no Site Development Plan is
required for expansion -of less than 1,000 square feet. The site is only partially visible from El
Camino Real and has operated as a maintenance yard for over five years without incident. Staff
has no issues with the proposal.
III. PROJECT DESCRIPTION AND BACKGROUND
The Carlsbad Municipal Water District is requesting an amendment to their Special Use Permit
and Conditional Use Permit to allow the placement and use of a mobile office trailer for parts
storage and inventory space. The site is designated PI, or Planned Industrial in the General Plan
and is zoned M-Q, Industrial with a Qualified Development Overlay. The site is currently
occupied by the Carlsbad Municipal Water District offices, both in permanent and modular
structures, and their maintenance and storage yard. The project site is located just north of the
intersection of Palomar Airport Road and El Camino Real and gains access off of El Camino
Real via a driveway serving the Coast Waste Management site and the City Hiring Center. No
significant natural features exist on the site.

The Water District first occupied the site in 1990 through a Special Use Permit and Site
Development Plan (SUP 88-02/SDP 88-12, Planning Commission Resolutions No. 2803 and
2829, copies attached). An SUP was required because the site is located within the El Camino
Real Scenic Corridor and an SDP was necessary due to the Q zoning. In 1993, due to space
constraints, the Water District requested approval for a 960 square foot modular office through
an SUP amendment and a Conditional Use Permit (SUP 88-02(A)/CUP 92-08, Planning
Commission Resolutions No. 3486 and 3487, copies attached). All approved improvements
except for the modular offices have been installed and/or occupied and no operational issues of
concern have arisen. The current proposal would amend the most recent approvals, by adding an
additional public utility building to the site.
The trailer is already located on the western side of the project site, within the maintenance yard.
Measuring 12 feet wide, 56 feet long and 14 feet high, the trailer would be used for parts storage
and inventory. A small porch area would be added to the trailer to create a staging area for the
storage and inventory operations. The trailer would not expand the type or intensity of uses on
the project site, rather it offers a more secure location for inventorying parts.
The CMWD Storage Trailer project is subject to the following land use plans, policies, programs
and zoning regulations:
A. General Plan;
B. McClellan-Palomar Airport Comprehensive Land Use Plan;
C. Industrial Zone (Chapter 21.32 of the Zoning Ordinance);
D. Qualified Development Overlay Zone (Chapter 21.06 of the Zoning Ordinance);
E. Scenic Preservation Overlay Zone (Chapter 21.40 of the Zoning Ordinance);
F. Conditional Use Ordinance (Chapter 21.42 of the Zoning Ordinance);
G. Growth Management Ordinance (Chapter 21.90 of the Zoning Ordinance); and
H. Zone 5 Local Facilities Management Plan.
IV. ANALYSIS
The recommendation of approval for this project was developed by analyzing the project's
consistency with the applicable policies and regulations listed above. The following analysis
section discusses compliance with each of these regulations/policies utilizing both text and
tables.

A. General Plan
The proposed CMWD storage trailer is consistent with the applicable policies and programs of
the General Plan. Particularly relevant to the commercial coach are the Land Use, Circulation
and Public Safety Elements. Table 1 below indicates how the project complies with these
particular elements of the General Plan.

B. McClellan-Palomar Airport Comprehensive Land Use Plan
The project site is located within the Airport Influence Area for McClellan-Palomar airport and is
subject to the restrictions of the Comprehensive Land Use Plan. The proposed industrial/utility
expansion could exist in areas subjected to noise levels ofup to 70 dBA, whereas the project site
is located outside of the 60 dBA aircraft noise contour. The 14 foot high building is much lower
than surrounding development and does not represent a protrusion into any flight paths. The
proposed storage trailer is therefore consistent with the McClellan-Palomar Airport
Comprehensive Land Use Plan.
C. Industrial Zone (Chapter 21.32 of the Zoning Ordinance)
The project site is zoned M-Q, or Industrial with a Qualified Development Overlay. The M zone
contains very few development standards that are applicable to the proposed storage trailer. No
side yard requirements exist and front and rear yards are only required when adjacent or
proximate to residentially designated properties. The building height maximum is 35 feet, with
few exceptions, while the storage trailer is approximately 14 feet high. An employee eating area
has already been provided in conjunction with the previous office building improvements on site.
Industrial offices and supply yards are an allowed use in both the C-M and M zone. Therefore
the proposed CMWD storage trailer is consistent with the provisions of the M -Industrial Zone.

D. Qualified Development Overlay Zone (Chapter 21.06 of the Zoning Ordinance)
The project site has a Qualified Development Overlay Zone and is subject to Chapter 21.06 of
the Carlsbad Municipal Code. Typically a site development plan is required for all new or
remodeled buildings with a Q overlay. Section 21.06.040, however, cites the uses or
improvements that are exempt from the site development plan processing requirements. One of
these exemptions is for buildings less than one thousand square feet in area in commercially or
industrially zoned lots. Since the CMWD site is zoned M-Q and the storage trailer is
approximately 670 square feet, the project is exempt from the processing requirements of a site
development plan.
E. Scenic Preservation Overlay Zone (Chapter 21.40 of the Zoning Ordinance)
The project site is also located within the El Camino Real scenic corridor and subject to the
provisions of the Scenic Preservation Overlay Zone in the form of the El Camino Real Scenic
Corridor standards. The CMWD site lies within Area 4, which cautions that tall buildings
combined with small setbacks from the roadway, may cause a tunnel effect along the scenic
corridor. The standards reflect this concern by requiring a 35 foot building height maximum and
a minimum of 30 foot setback from the roadway. Since the trailer is only 14 feet high and over
150 feet from El Camino Real, the proposed project is consistent with the Scenic Preservation
Overlay Zone and the applicable scenic corridor guidelines.
F. Conditional Use Ordinance (Chapter 21.42 of the Zoning Ordinance)
Since the project involves the placement and use of an additional accessory public utility
building, a Conditional Use Permit Amendment is required pursuant to Section 21.42.010(2)(1).
The four findings required for a CUP involve compatibility and harmony of the use with the
project site and its existing and future surroundings. Since the project site is already a
maintenance yard in an industrially zoned area, the use of the trailer for the relative innocuous
operations of parts inventory and storage will not be detrimental to existing or future uses in the
area. The maintenance yard is more than adequate to support the trailer since the trailer is
already in place and no space constraints exist. Since there is virtually no increased traffic due to
the trailer, the street system serving the project site remains adequate. All findings required for a
CUP can be met by the project, therefore the proposed storage trailer is consistent with the
Conditional Use Ordinance;
G. Growth Management Ordinance (Chapter 21.90 of the Zoning Ordinance)
Since the CMWD Storage Trailer project involves no residential uses, many of the facilities
regulated by the Growth Management Ordinance are not affected. Table 2 below and the
attached Local Facilities Impact Assessment Form show the project's compliance with the
applicable growth management facility requirements.

H. Zone 5 Local Facilities Management Plan
The CMWD site lies within Local Facilities Management Zone 5. There are no special
development requirement in the zone plan that apply to the mobile office since it is temporary in
nature and will not be connected to the sewer system. Since all public improvements and
facilities necessary to serve the proposed storage trailer are in place, the project is consistent with
the Zone 5 Local Facilities Management Plan.
V. ENVIRONMENTAL REVIEW
The proposed storage trailer represents a new, small accessory structure appurtenant to the
primary CMWD operations. According to Section 15303(e) of the State CEQA Guidelines,
new, small accessory structures are exempt from environmental review. Therefore, the Planning
Director will issue a Notice of Exemption upon final project determination.

NO. SDP 88-12, FOR A WATER DISTRICT OPERATION CENTER ON
PROPERTY GENERALLY LOCATED EAST OF EL CAMINO REAL BETWEEN
PALOMAR AIRPORT ROAD AND FARADAY DRIVE

WHEREAS, a verified application has been filed with the City of
Carlsbad and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request as provided
by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code, the
Planning Commission did, on the 1st day of March, 1989, consider said request
on property described as:

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of
the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.

APPROVES SDP 88-12, based on the following findings and subject to the
following conditions:

Findings:
I. The site plan is environmentally sensitive, orderly, attractive, and
compatible with existing and future surrounding land use by exceeding all
requirements of the M-Manufacturing Zone. Site grading is minimized.
More than minimum parking and landscaped setbacks are provided.
2. The Site Plan is consistent with the Comprehensive Land Use Plan for
Palomar Airport by not impacting the 50:l approach slope and runway clear
zone.
3. The project is consistent with all City public facility policies and
ordinances since:

The Planning Commission has, by inclusion of an appropriate
condition to this project, ensured building permits will not be
issued for the· project unless the City Engineer determines that
sewer service is available, and building cannot occur within the
project unless sewer service remains available, and the Planning
Commission is satisfied that the requirements of the Public
Facilities Element of the General Plan have been met insofar as they
apply to sewer service for this project.
School fees will be paid to ensure the availability of school
facilities in the Carlsbad School District.
c. Park-in-lieu fees are required as a condition of approval.
d. All. necessary public improvements have been provided or will be
required as conditions of approval.
4. The proposed project is compatible with the surrounding future land uses
since surrounding properties are designated for office/industrial
development on the General Plan.
5. This project is consistent with the City's Growth Management Ordinance as
it has been conditioned to comply with any requirement approved as part
of the local Facilities Management Plan for Zone 5.
Conditions:
1. Approval is granted for SOP 88-12, as shown on Exhibits "A -F", dated
February 2, 1989, incorporated by reference and on file in the Planning
Department. Development shall occur substantially as shown unless
otherwise noted in these conditions.
2. The developer shall provide the City with a reproducible 24" x 36", 100
scale mylar copy of the Site Plan as approved by the Planning Commission.
The Site Plan shall reflect the conditions of approval by the City. The
Plan copy shall be submitted to the City Engineer prior to issuance of
building permits or improvement plan submittal, whichever occurs first.

3. This project is approved upon the express condition that building permits
will not be issued for development of the subject property unless the City
Engineer determines that sewer facilities are available at the time of
application for such sewer permits and will continue to be available until
time of occupancy. This note shall be placed on the final map.
4. The applicant shall pay park-in-lieu fees to the City, prior to the
issuance of a building permit as required.
5. The applicant shall provide school fees to mitigate conditions of
overcrowding as part of building permit application. These fees shall be
based on the fee schedule in effect at the time of building permit
application.
6. Water shall be provided to this project pursuant to the Water Service
agreement between th~ City of Carlsbad and the Costa Real Water District,
dated May 25, 1983.
7. This project shall comply with all conditions and mitigation required by
the Zone 5 Local Facilities Management Plan approved by the City Council
on August 4, 1987, incorporated herein and on file in the Planning
Department and any future amendments to the Pl an made prior to the
issuance of building permits. (CC Reso #9188)
General Planning and Legal Conditions:
8. If any condition for construction of any public improvements or
facilities, or the payment of any fees in lieu thereof, imposed by this
approval or imposed by law on this project are challenged this approval
shall be suspended as provided in Government Code Section 65913.5. If any
such condition is determined to be invalid this approval shall be invalid
unless the City Council determines that the project without the condition
complies with all requirements of law.
9. Approval of this request shall not excuse compliance with all sections of
the Zoning Ordinance and all other applicable City ordinances in effect
at time of building permit issuance.
10. Trash receptacle areas shall be enclosed by a six-foot high concrete wall
to match the building with gates pursuant to City standards. Location of
said receptacles shall be approved by the Planning Director. Enclosure
shall be of similar colors and/or materials to the project to the
satisfaction of the Planning Director.
11. All roof appurtenances, including air conditioners, shall be
architecturally integrated and concealed from view and the sound buffered
from adjacent properties and streets, pursuant to Building Department
Policy No. 80-6, to the satisfaction of the Directors of Planning and
Building.

12. An exterior lighting plan including parking areas shall be submitted for
Planning Director approval. All 1 ighting shall be designed to reflect
downward and avoid any impacts on adjacent homes or property.
13. No outdoor storage of material other than existing types of pipe supply
shall occur onsite unless required by the Fire Chief. In such instance
a storage plan will be submitted for approval by the Fire Chief and the
Planning Director.
14. The applicant shall prepare a detailed landscape and irrigation plan which
shall be submitted to and approved by the Planning Director prior to the
issuance of grading or building permits, whichever occurs first.
15. All parking lot trees shall be a minimum of 15 gallons in size.
16. All landscaped areas shall be maintained in a healthy and thriving
condition, free from·weeds, trash, and debris.
17. Building identification and/or addresses shall be placed on all new and
existing buildings so as to be plainly visible from the street or access
road; color of identification and/or addresses shall contrast to their
background color.
' 18. The project shall provide bus stop facilities at locations subject to the
satisfaction of the North County Transit District. Said facilities shall
at a minimum include a bench, free from advertising, and a pole for the
bus stop sign. The bench and pole shall be designed in a manner so as to
not detract from the basic architectural theme of the project and said
design shall be subject to the approval of the Planning Director and North
County Transit District.
19. The project shall attempt to develop a ride to work and home program for
its employees with the North County Transit District. Furthermore, the
project shall attempt to limit the staggering of worker shifts so as to
facilitate the success of said program.
20. The landowner shall submit a written request to the Planning Director and
receive written approval from both the Planning Director and the Airport
Land Use Comission (SANDAG) prior to any antenna, flagpole, structure or
object being placed on site which is not shown on Exhibits •A -f• dated
March 1, 1989.
21. The landowner shall comply with all conditions of the Mitigated
Declaration dated January 25, 1989 as shown in Planning Comission
Resolution 2804. Prior to the issuance of grading or building permits
for the project. The landowner shall submit to the Planning Director for
review and approval a proposed monitoring and reporting program pursuant
to Section 21081.6 of Public Resources Code. The program shall clearly
show the City how all conditions of Planning Resolution No. 2803 and 2804
will be complied with and how compliance will be verified by the City of

22. Any signs proposed for this development shall at a minimum be designed in
conformance with the City's Sign Ordinance and shall require review and
approval of the Planning Director prior to installation of such signs.
23. All outdoor storage areas either existing or future shall be enclosed with
screened fencing, the design of which shall be subject to the approval of
the Planning Director.
Engineering:
24. The developer shall obtain a grading permit prior to the commencement of
any clearing or grading of the site.
2 5. The grading for this project is defined as "cont ro 11 ed grading" by Section
ll.06.170{a) of the Carlsbad Municipal Code. Grading shall be performed
under the observation of a civil engineer whose responsibility it shall
be to coordinate site inspection and testing to ensure compliance of the
work with the approved grading plan, submit required reports to the City
Engineer and verify compliance with Chapter 11.06 of the Carlsbad
Municipal Code.
26. No grading shall occur outside the limits of the project unless a letter
of permission is obtained from the owners of the affected properties.
27. All slopes within this project shall be no steeper than 2:1.
28. Prior to hauling dirt or construction materials to any proposed
construction site within this project the developer shall submit to and
.receive approval from the City Engineer for the proposed haul route. The
developer shall comply with all conditions and requirements the City
Engineer may impose with regards to the hauling operation.
29. Additional drainage easements and drainage structures shall be provided
or installed as may be required by the City Engineer.
30. The owner of the subject property shall execute a hold harmless agreement
regarding drainage across the adjacent property prior to the approval of
any grading or building permit for this project.
31. Unless a standard variance has been issued, no variance from City
Standards is authorized by virtue of approval of this Site Plan.
32. The applicant shall agree to utilize reclaimed water, in Type I form, on
the subject property in all common areas as approved by the City Engineer.
33. Irrigation systems to accommodate future reclaimed water shall be designed
consistent with Title 17 of the California Administrative Code. Offsite
future reclaimed water distribution systems should be anticipated by the
installation of adequately sized sleeves at crossing points to minimize
street excavation.

34. Prior to certificate of occupancy the developer shall overlay and/or
repair those areas of the access road between El Camino Real and the
project entrance as directed by the City Engineer.
35. Prior to issuance of a Building Pennit the Developer shall make a cash
deposit to the City. Said deposit is to cover the cost of constructing
a standard full width raised median along the project frontage of El
Camino Real and extending approximately 250 feet southerly. The deposit
amount shall be based on construction estimates submitted by the developer
and approved by the City Engineer.
36. Prior to issuance of a Building Pennit the Developer shall sign an
agreement to pay their share of fees for undergrounding of existing
overhead utilitie~ along or across from the boundaries of the project.
37. Prior to the issuance of building permits, complete building plans shall
be submitted to and approved by the Fire Department.
38. Additional public and/or on site fire hydrants shall be provided if deemed
necessary by the Fire Marshal.
39. All required fire hydrants, water mains and appurtenances shall be
operational prior to combustible building materials being located on the
project site.
40. Proposed security gate systems shall be provided with "Knox" key operated
override switch, as specified by the Fire Department.
41. All fire alarm systems, fire hydrants, extinguishing systems, automatic
sprinklers, and other systems pertinent to the project shall be submitted
to the Fire Department for approval prior to construction.
42. Building exceeding 10,000 square feet aggregate floor area shall be
sprinklered or have four-hour fire walls with no openings therein which

adverse impacts, the Planning Director shall recommend that the Planning
Commission, after providing the permittee the opportunity to be heard, add
additional conditions to mitigate the significant adverse impacts. This permit may
be revoked at any time after a public hearing, if it is found that the use has a
significant detrimental affect on surrounding land uses and the public's health and
welfare, or the conditions imposed herein have not been met. This permit may be
extended for a reasonable period of time not to exceed 5 years upon written
application of the pennittee made no less than 90 days prior to the expiration
date. In granting such extension, the Planning Commission shall find that no
substantial adverse affect on surrounding land uses or the public's health and
welfare will result because of the continuation of the permitted use and that the
continued operatlon of the trailer as a temporaiy use is acceptable in lieu of a
permanent facility. If a substantial adverse affect on surrounding land uses or the
public's health and welfare is found, the extension shall be considered as an
original application for a conditional use permit. There is no limit to the number
of extensions the Planning Commission may grant.
All roof appurtenances, including air conditioners, shall be architecturally
