AGENDA OF: October 7, 1998 ItemNo.@ Application complete date: June 25, 1998 Project Planner: Jeff Gibson Project Engineer: Mike Shirey SUBJECT: CDP 98-42 -SEASIDE ESTATES -Request for a Coastal Development Permit to allow for the construction of 44 single-family homes on previously subdivided lots in the R-1-10,000-Q Zone on property generally located along the west side of A viara Parkway between Camino De Las Ondas and Plum Tree Road within Specific Plan 203 and Local Facilities Management Zone 20. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4400 APPROVING CDP 98-42 based on the findings and subject to the conditions contained therein. II. INTRODUCTION The project applicant is requesting approval of a Coastal Development Permit for architecture and building placement of 44 single-family homes on previously approved (Sambi Seaside Heights -CT 92-02(A)) and graded single-family lots in the R-1-10,000-Q Zone. The project also includes minor grading and retaining walls associated with the expansion of some of the pad areas of these lots. The site is located within the Coastal Zone and is subject to approval of a Coastal Development Permit by the Planning Commission. The project complies with City standards, is consistent with Specific Plan 203, and all the necessary findings can be made for the approvals being requested. In conclusion, staff believes that the project has addressed all issues and, therefore, warrants approval. III. PROJECT DESCRIPTION AND BACKGROUND Pacific Heritage Development is requesting approval of a Coastal Development Permit to allow the construction of 44 single-family homes on 10,000 sq. ft. and larger single-family lots which were previously subdivided and graded as part of the Sambi Seaside Heights project -(CT 92- 02(A)). The project also includes minor grading and retaining walls associated with the expansion of pad areas for some of the residential lots. The project site is located along the west side of A viara Parkway between Camino De Las Ondas and Plum Tree Road. The original Sambi Seaside Heights project approvals also included a Site Development Plan (SDP 92-06(A)) which approved land use, project design, and lot layout, a Hillside Development Permit (HDP 92-03(A)) for hillside grading and a Coastal Development Permit for grading and land subdivision within the Mello II segment of Carlsbad's Local Coastal Program. The project site is currently graded consistent with these previous project approvals and all surrounding 0 CDP 98-42 -SEASIDE E~ATES October 7, 1998 Page 2 infrastructure has been constructed, including public streets, sewer, water, and drainage facilities. Architecture and building placement for this single-family project were, however, not proposed or approved through the original project applications. Accordingly, the project was conditioned to require Planning Director approval of the architecture and placement of the single family homes on the approved lots consistent with the standards of the R-1 Zone, Specific Plan 203, and the architectural standards/guidelines of the Hillside Ordinance. As shown on attachments "A" -"X", the project includes four different product types (each with different front elevations) which range from 3,376 square feet to 5,115 square feet in area and include two, three, and four-car garages. The homes are one and two-stories and range between 21 to 28 feet in height. Architectural features include sectional wood garage doors with glass windows, corbels and stone veneer, painted shutters, wrought iron railings, wood pot shelves, recessed windows with trim, hip and gabled roofs, earthtone colored stucco walls with wood and stone trim, and concrete s-tile roofing. Concurrent with this Coastal Development Permit application request, a Site Development Plan Amendment (SDP 92-06(E)) application has been processed for approval of project architecture and building placement by the Planning Director. A Hillside Development Permit Amendment (HDP 92-03(C)) application has also been processed for approval through the Planning Director for minor project encroachment (construction of retaining walls ranging from 4 -5 feet in height) into existing manufactured slopes located in the rear yards of around 30% of the project residential lots for the purpose of increasing the rear yard pad areas. The project is located in the Coastal Zone and all development requires a Coastal Development Permit. This Coastal Development Permit application (CDP 98-42) is required for the placement and architecture of the proposed units on the single-family lots and for the minor lot grading associated with the expansion of the lot pad areas for the residential units. The proposed project is subject to the Mello II segment of the Local Coastal Program. IV. ANALYSIS The recommendation of approval for this project was developed by analyzing the project's consistency with the Mello II segment of the Local Coastal Program. The following analysis discusses project compliance with the Mello II segment. Mello II Segment of Carlsbad Local Coastal Program A Coastal Development Permit for the Sambi Seaside Heights project, which included the subdivision of single-family lots, infrastructure location, and grading was issued by the California Coastal Commission based on findings of project consistency with the Mello II Coastal Resource Protection Overlay Zone and Coastal Agricultural Overlay Zone policies. The project was graded in compliance with the approved Coastal Development Permit. The approved project was conditioned to mitigate impacts to sensitive coastal resources including riparian and coastal sage scrub habitat. The required project resource mitigation, including receipt of various Federal and State permits and the purchase of mitigation credits from the Carlsbad Highlands CDP 98-42 -SEASIDE ER TES October 7, 1998 Page 3 Mitigation Bank have already been implemented. The Sambi project developer has also paid the required "Agricultural Conversion Mitigation Fee" to the California Coastal Conservancy. This proposed project must receive approval of a second Coastal Development Permit for the placement and architecture of the proposed units to ensure compliance with the R-1-10,000 Zone and for the minor lot grading associated with the expansion of rear yard pad areas on some of the residential lots. As shown on the following table, the project complies with all applicable R-1 Zone development standards. STANDARD REQUIRED PROPOSED Lot Coverage Maximum40% <40% Front Yard Setback 20' Minimum 20' Street Side Yard Setback 10' Minimum 10' Side Yard Setback 10% of Lot Width 10% of Lot Width Rear Yard Setback 2 x Required Side Yard 2 x Required Side Yard Building Height Maximum-30' Maximum-28' Additionally, the proposed minor lot grading (into existing rear yard manufactured slopes) and retaining wall construction for the purpose of increasing the rear yard pad areas is consistent with the policies of the Mello II Local Coastal Program in that the slopes are manufactured and therefore not subject to the steep slope preservation policies of the Mello II segment, no sensitive coastal resources will be impacted by the proposed minor grading, and adequate drainage and erosion control measures have been incorporated into the project. V. ENVIRONMENTAL REVIEW The Planning Director has determined that the proposed residential project is pursuant to and in conformance with Specific Plan 203 for which a Program Environmental Impact Report was prepared and certified, therefore, the project is exempt under Section 15182 of the California Environmental Quality Act.
