SUBJECT: CUP 00-04/CDP 00-04 -SPRINT PCS-CAR COUNTRY -Request for a
Conditional Use Permit and a Coastal Development Permit to allow the
installation of a telecommunications facility at the Car Country commercial site.
The site is located at 1050 Auto Center Court in the C-2 Zone and in Local
Facilities Management Zone 3.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolutions No. 4837 and 4838
APPROVING Conditional Use Permit CUP 00-04 and Coastal Development Permit 00-04
based on the findings and subject to the conditions contained therein.
II. INTRODUCTION
Sprint PCS is requesting approval to install an unmanned telecommunications facility, consisting
of antennas and equipment, within a rooftop tower and exterior wall at the Car Country
commercial site. If approved, the facility will better Sprint PCS' ability to provide mobile
communications coverage in central Carlsbad and along the Interstate 5 corridor. This request is
one of several existing facilities by Sprint PCS in North County. The Federal Communications
Commission has licensed the utility to provide service in San Diego County and beyond. The
zoning of the site allows, by conditional use permit, public and quasi-public utility facilities such
as the proposed wireless telecommunication facility. Staff recommends approval of the
requested CUP and CDP as the necessary findings for it can be made.
III. PROJECT DESCRIPTION AND BACKGROUND
Occupying a position above Cannon Road, the Car Country commercial site borders open space-
zoned land (the strawberry fields) to the north, Gemological Institute of America to the east, and
car dealerships to the south and west. The project site is within the General Commercial zone and
the Carlsbad Car Country Specific Plan.
The facility consists of "panel type" and Global Positioning System (GPS) antennas and
equipment installations. Thrpe antennas are proposed within a rooftop tower that accents the
northwest side of the buildjng and a fourth is proposed within a south facing wall. The tower
was built as an architectural enhancement with brick, windows and a roof to match the rest of the
building. The tower is fully enclosed, approximately 23 feet square, and 30 feet high from
ground level at the tallest point. The panel antennas located within the tower will be entirely
screened by opaque windows and will not be visible to any public right-of-way. The south

facing antenna will be entirely screened by a fiberglass screen wall covered in a material to
match the overall wall. The power equipment is proposed behind the same brick screen wall on
the roof.
This project is subject to the following regulations:
A. C-2, General Commercial Zone (Chapters 21.28 of the Zoning Ordinance);
B. Qualified Development Overlay Zone (Chapter 21.06 of the Zoning Ordinance);
C. Carlsbad Car Country Specific Plan (SP207);
D. Conditional Use Permit regulations (Chapter 21.42 of the Zoning Ordinance);
E. Coastal Development Regulations (Chapter 21.201 of the Zoning Ordinance);
F. Growth Management.
IV. ANALYSIS
Staff developed its approval recommendation after analyzing the project's consistency with the
applicable City regulations listed above. A discussion on the compliance with each of the
regulations follows.
A. General Commercial Zone
The proposed facility is consistent with all development standards of the General Commercial
zone. Its location inside the rooftop tower and existing building walls complies with setback, lot
coverage, and building height requirements and does not require additional parking.
Zoning Ordinance conditional use permit regulations (Section 21.42.010 (2)(J)) allow accessory
public and quasi-public utility facilities in all zones by approval of a conditional use permit
(CUP). Required CUP findings can be made for the proposed wireless communication facility as
it is a desirable public convenience and is compatible with its surroundings.
B. Qualified Development Overlay Zone
The Zoning Ordinance designates the project site with a "Q" Overlay Zone because of its
sensitive location. However, additions of no more than 1,000 square feet to commercial
buildings in commercial zones are exempt from the Overlay Zone provisions. The facility,
proposing no expansion to a commercially zoned building, is also exempt.
C. Carlsbad Car Country Specific Plan
The Car Country commercial site is within the Carlsbad Car Country Specific Plan boundaries.
The specific plan is silent regarding telecommunications facilities; however, this use has been
allowed previously within the specific plan based on the nature of the use and the allowance of
the use typically within the C-2 zone with a Conditional Use Permit.
D. Conditional Use Permit Regulations
Conditional land uses such as wireless telecommunication facilities possess unique and special
characteristics that make it impractical to include them as permitted uses "by right" in any of the

various zoning classifications. Accordingly, the Zoning Ordinance requires conditional use
permits and Planning Commission public hearing review to address the aesthetic, operation,
location, and other concerns potentially attributable to these land uses.
As part of the Planning Commission's consideration to approve a conditional use permit, several
findings must first be made. A summary of how the project meets the findings follows.
1. The requested facility is desirable because it will provide safety and convenience benefits
to the public by expanding and improving a mobile communication system.
2. The proposal is consistent with the General Plan, Zoning Ordinance, and Carlsbad Car
Country Plan because:
• it will not be visible to the surrounding area;
• it is not precluded by the commercial land use designations of the project site
as they allow quasi-public utility uses with a conditional use permit;
• it will not interfere with the circulation, design, or operation of Car Country in
general or existing uses nearby because it is installed within the existing
building, and;
• it is consistent with all applicable development standards.
3. The existing tower and building walls can accommodate all antennas and equipment and
enable them to be hidden from view.
4. No visible modifications are required to the tower to enable facility installation.
5. The proposed use will not generate a traffic impact because it is unmanned and requires
only monthly maintenance.
E. Coastal Development Regulations
The site is located within the Mello II segment of the City's Coastal Zone and is subject to the
corresponding land use policies and implementing ordinances. These policies and ordinances
emphasize topics such as preservation of agriculture and scenic resources, protection of
environmentally sensitive resources, provision of shoreline access, and the prevention of
geologic instability and erosion. The site is currently developed and the proposed facility will be
located entirely within an existing structure. No agricultural or enviroiimentally sensitive lands
exist on site. Since the project site is located approximately one mile from the Pacific Ocean, no
shoreline development regulations apply. No scenic resources exist on or near the developed
site. Given the above, the project is consistent with the Mello II land use policies and the
applicable implementing ordinances.
F. Growth Management
Local Facilities Management Plan Zone 3 includes Carlsbad Car Country. Installation of the
facility in the existing commercial building and monthly facility maintenance visits will not

result in increased public facilities demands; therefore, the proposal will not exceed performance
standards for public facilities.
V. ENVIRONMENTAL REVIEW
The proposal is exempt from the California Environmental Quality Act (CEQA). CEQA Section
15301 exempts minor alterations to existing buildings involving negligible or no expansion of
use beyond that previously existing. Additionally, as Sprint PCS must comply with FCC
regulations, radio frequency emissions from the proposed facility are not considered a health
hazard.
