SUBJECT: CDP 00-48 - SISSON SECOND DWELLING UNIT - Request for approval of
a Coastal Development Permit to allow for the construction of a 638 square foot,
second dwelling unit above an existing garage within the City's Coastal Zone
located at 411 Tamarack Avenue within Local Facilities Management Zone 1.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 4921
APPROVING Coastal Development Permit CDP 00-48 based upon the findings and subject to
the conditions contained therein.
II. INTRODUCTION
Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the construction of a second
dwelling unit within the City's Coastal Zone requires the processing and approval of a Coastal
Development Permit (CDP). The CDP application was reviewed for consistency with LCP
policies and implementation. There are no unresolved issues. The staff recommended approval
with conditions is supported by the analysis as follows.
III. PROJECT DESCRIPTION AND BACKGROUND
Project Site/Setting: Existing single-family lot and home located at 411 Tamarack Avenue as
shown on the attached location map. The lot area is 0.70 acres (30,492 square feet).
Proposed Residential Construction: New second dwelling unit, totaling 638 square feet, added as
a second story to the existing four-car garage.
Proposed Grading: No grading is required to construct the second-story second dwelling unit
and, therefore, a grading permit will not be required for this project.
Impact on Coastal Resources: None

IV. ANALYSIS
As shown on the Coastal Development Compliance Table below, the proposed development is in
compliance with all applicable regulations. Building permits may be issued subject to the
conditions contained in Planning Commission Resolution No. 4921.

Review of Required Coastal Findings
1. Conformance with the Certified Local Coastal Program and all applicable policies.
The project is located in the Mello II Local Coastal Program Segment.
The project proposes the construction of a second dwelling unit in an area designated for
single-family development. As discussed below, the project complies with the applicable
Local Coastal Program provisions. The LCP Land Use Plan designates the subject site
for high-density development of 15 to 19 dwellings per acre. Affordable Housing Policy
1-1 of the Mello II LCP allows for development of second dwelling units subject to
compliance with all applicable LCP provisions, with the exception of base density.
The proposed second dwelling unit is architecturally compatible with the primary unit
and garage building and is consistent with the surrounding single and multifamily
development. The second-story unit will not obstruct any views of the coastline from
public lands or public rights-of-way or otherwise damage the scenic beauty of the coastal
zone. No prime agricultural lands exist within the project area and no sensitive resources
on the developed single-family property. No grading is required for the project and no
geologic instability or off-site erosion is anticipated with the project.
2. Conformance with public access and recreation policies of Chapter 3 of the Coastal Act.
There are no public access or coastal recreational opportunities on the subject property
since it is located over 0.5 miles from the Pacific Ocean and is bounded by a public street
(Tamarack Avenue) and the North San Diego Railroad right-of-way.

3. Coastal Overlay Zones.
The subject site is located in the Coastal Resource Protection Overlay Zone, however,
due to its location and the absence of slopes steeper than 25% inclination and/or native
vegetation, additional submittals, standards or requirements do not apply. No grading is
required for the construction of the second dwelling unit.
V. ENVIRONMENTAL REVIEW
This project is exempt from CEQA pursuant to Section 15303 of CEQA exemptions (Class 3)
exempts the construction of second dwelling units in urbanized areas from environmental review.
A Notice of Exemption will be filed by the Planning Director upon project approval.
