SUBJECT: CDP 00-62 - HAMILTON RESIDENCE - Request for approval of a Coastal
Development Permit to allow for the construction of a single-family residence
within the City's Coastal Zone located at 2335 Pio Pico Drive between Yourell
Avenue and Forest Avenue within Local Facilities Management Zone 1.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 5001
APPROVING Coastal Development Permit CDP 00-62 based upon the findings and subject to
the conditions contained therein.
II. INTRODUCTION
Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the construction of a single-
family home within the City's Coastal Zone requires the processing and approval of a Coastal
Development Permit (CDP). The CDP application was reviewed for consistency with LCP
policies and implementation. The proposed residence is consistent with the Mello II segment of
the city's LCP and is conditioned to pay the required Inclusionary Housing impact fee. There are
no unresolved issues. The staff recommended approval with conditions is supported by the
analysis as follows.
III. PROJECT DESCRIPTION AND BACKGROUND
Project Site/Setting: Infill lot located on the west side of Pio Pico Drive between Yourell
Avenue and Forest Avenue located outside the appeal area of the coastal zone. See attached map
for site location. The lot area is .235 acres (10,291 square feet).
Proposed Residential Construction: New 3,164 square foot residential structure with 348 square
foot attached one car garage and detached 546 square foot combination two car garage/workshop.
The two story residence will be constructed of wood framing with stucco siding and a decorative
composition shingle roof.
Proposed Grading: The proposed fill of 395 cubic yards requires a grading permit issued by the
Engineering Department. The grading activities shall be completed by October 1st. Grading
activities may be extended to November 15th upon written approval of the City Engineer,
obtained in advance, and only if all erosion control measures are in place by October 1st.
Impact on Coastal Resources: None.

As shown on the Coastal Development Compliance Table below, the proposed development is in
compliance with all applicable regulations. Building permits may be issued subject to the
conditions contained in Planning Commission Resolution No. 5001.

Review of Required Coastal Findings
1. Conformance with the Certified Local Coastal Program and all applicable policies.
The project is located in the Mello II Local Coastal Program Segment.
The project proposes the construction of a new two story single-family residence in an
area designated for single-family residential development. As discussed below, the
project complies with the applicable Local Coastal Program provisions. The LCP Land
Use Plan designates the subject site for RLM (Residential Low Medium) density
development, which allows 3.2 du/ac. Based on a density of 3.2 du/ac, the lot could
accommodate one dwelling unit.
The proposed residence will be located on the west side of Pio Pico Avenue, between
Yourell Avenue and Forest Avenue. The two-story residence is consistent with the
surrounding development of one-and two-story structures. The two-story residence will
not obstruct views of the coastline as seen from public lands or the public right-of-way or
otherwise damage the visual beauty of the coastal zone. No agricultural uses currently
exist on the site, nor are there any sensitive resources located on the undeveloped
property. The proposed residence is not located on an area of known geologic instability
or flood hazard. No public opportunities for coastal shoreline access are available from
the subject site since it is not located between the first public road and the ocean, and no
public access requirements are conditioned for the project. The residentiary designated
site is not suited for water-oriented recreation activities.

2. Coastal Overlay Zones.
The subject site is located in the Coastal Resource Protection Overlay Zone, however,
due to its location and the absence of slopes steeper than or equal to 25% inclination
and/or native vegetation, additional submittals, standards or requirements do not apply.
Construction of the project will adhere to the City's Master Drainage and Storm Water
Quality Management Plan and Grading Ordinance to avoid increased runoff and soil
erosion.
V. ENVIRONMENTAL REVIEW
This project is exempt from CEQA per the exemptions listed below:
1) Section 15303 of CEQA exemptions (Class 3) exempts the construction of single-
family residences in urbanized areas from environmental review.
A Notice of Exemption will be filed by the Planning Director upon project approval.
