SUBJECT: CUP 02-04/CDP 02-06 -NEXTEL WIRELESS TELECOM FACILITY -
Request for approval of a Conditional Use Permit and a Coastal Development
Permit to allow installation, operation and maintenance of an unmanned wireless
telecommunications facility located at 720 Macadamia Drive in the C-2 Zone,
within the Coastal Zone, and in Local Facilities Management Zone 22.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolutions No. 5195 and 5196
APPROVING CUP 02-04 and CDP 02-06 for a period of five (5) years based on the findings
and subject to the conditions contained therein.
II. INTRODUCTION
This application is a request for a Conditional Use Permit (CUP) and a Coastal Development
Permit (CDP) to allow Nextel of California to install, operate and maintain an unmanned
wireless telecommunications facility consisting of three sectors of four panel antennas, for a total
of twelve antennas and an equipment enclosure. The proposed unmanned wireless
telecommunications facility will be located at the Fairfield Inn at 720 Macadamia Drive.
Quasi-public utility facilities are permitted in the General Commercial (C-2) zone by conditional
use permit and all required conditional use permit and coastal development permit findings can
be made for the proposed telecommunications facility.
ID. PROJECT DESCRIPTION AND BACKGROUND
The proposed Conditional Use Permit and Coastal Development Permit are requested to install a
Nextel Wireless telecommunications facility at the subject site. The unmanned facility, which
will be located at the Fairfield Inn, will consist of three sectors of antennas, each sector
containing four antennas, for a total of 12 panel antennas and an equipment cabinet. The panel
antennas divided into three sectors will be mounted on the north, south and east facades of the
building. The antennas will be mounted behind new screening built to match the exterior of the
building and within the parapet wall and will not be visible from the exterior of the building.
The proposed 10' X 20' equipment enclosure is to be located at the eastern comer of the
building. It is designed to look like the building's equipment room extension. The design of the
equipment enclosure will match the existing enclosure located on the subject property's "A"
building.
The subject site is also located in the Mello I Segment of the Coastal Zone. The project is also
reviewed for consistency with the Coastal Development regulations.

Nextel is a nationwide wireless carrier licensed by the Federal Communications Commission
(FCC) to provide mobile telephone, two-way radio, paging, data services and wireless internet
access for the public and private sectors including all emergency services to the community. The
proposed facility is necessary for the development of this portion of the network and will allow
the customers better access to Nextel's network of services.
IV. ANALYSIS
The proposed project is subject to the following regulations:
A. General Commercial Zone (C-2) (Chapter 21.28 of the Carlsbad Municipal Code);
B. Conditional Use Permit Regulations (Chapter 21.42 of the Carlsbad Municipal Code);
C. City Council Policy Statement: Policy 64 -Wireless Communication Facilities;
D. Mello I Segment of the Local Coastal Program, Coastal Development Procedures, and
the Coastal Resources Protection Overlay Zone (Chapter 21.201, 21.203, and 21.205);
E. Growth Management (Chapter 21.90 of the Carlsbad Municipal Code).
The recommendation for approval of this conditional use permit and coastal development permit
was developed by analyzing the project's consistency with the applicable City regulations and
policies. The project's compliance with each of the above regulations is discussed in detail in the
sections below.
A. General Commercial Zone
The proposed development is consistent with all applicable development standards and
guidelines required by the C-2 zone for setbacks, coverage, storage areas and architecture since
the installation of the new antenna will be located within an existing building and the equipment
building meets all setback requirements. The proposal does not increase the lot coverage, floor
area, or parking demand for the site. The proposed panel antenna will be mounted within the
parapet of the existing building walls similar to the existing antennas, and will be covered with a
fiberglass screen painted to match the existing stucco finish and structure and therefore integrated
into the architecture. The new equipment enclosure is located near the rear of the building and is
designed to match the other enclosure on the site.
B. Conditional Use Permit Regulations
Conditional uses such as cellular communications facilities possess unique and special
characteristics which make it impractical to include them as permitted uses "by right" in any of
the various zoning classifications (i.e., residential, commercial, office, industrial). The authority
for the location and operation of these uses is subject to Planning Commission review and the
issuance of conditional use permits. The following required conditional use permit findings for
the proposed telecommunications facility can be made:

1. The proposed use is: a) necessary and desirable for the development of the community in
that the community benefits of wireless communications include improved
telecommunications service for emergency services and individuals; b) consistent with
the General Plan in that the Commercial land use designation does not preclude the
provision of quasi-public utility uses; and c) not detrimental to permitted uses in the
Commercial zone in that the use is integrated into the existing commercial building and
requires no significant changes to the site design or function;
2. The proposed site is adequate in size and shape to accommodate the use in that the
existing and proposed panel antennas are mounted within the parapet of the existing
building and the equipment room is located within an existing landscape area;
3. All features necessary to adjust the requested use to the existing use are provided in that
the wall mounted antennas are located between the building walls and are covered with a
fiberglass screen painted to match the building; and
4. The street system serving the proposed use would not be impacted by the proposed
conditional use in that additional vehicle trips are limited to occasional equipment
maintenance by service personnel.
C. City Council Policy Statement: Policy 64 -Wireless Communication Facilities
The City Council adopted policies regarding prioritization for the location of Wireless
Communications Facilities (WCF) on October 3, 2001. The guidelines state that wireless
facilities should be located on buildings and structures, not on vacant land. In addition, WCFs
should locate, in order of priority, on industrial, commercial, public, other non-residential, public
utility, park, or community facility property.
Design guidelines of the policy state that all aspects of a WCF, including the supports, antennas,
screening methods, and equipment should exhibit "stealth" design techniques so they visually
blend into the background or the surface onto which they are mounted. The policy encourages
co-location wherever feasible and appropriate.
The project complies with this policy in that the proposed antennas will be installed within the
parapet wall and will not be visible from outside. The equipment enclosure is also designed as
such that it seems as an extension of the building and is painted to match the exterior of the
building.
Since there is another carrier's antennas also located on the subject building, the applicant
submitted an RF emissions report to ensure that the combined RF emissions will not exceed the
FCC's guidelines. The report indicates that the cumulative or combined RF emissions of AT&T
and Nextel antennas are within the applicable Maximum Permissible Exposure (MPE) limits.
D. Mello I Segment of the Local Coastal Program
The site is located within the Mello I segment of the City's Coastal Zone and is subject to the
corresponding land use policies and implementing ordinances. These policies and ordinances
emphasize topics such as preservation of agriculture and scenic resources, protection of

environmentally sensitive resources, provision of shoreline access, and the prevention of
geologic instability and erosion. The site is currently developed and the proposed facility will be
located within an existing building and the equipment building will be integrated into an existing
landscape area. No agricultural or environmentally sensitive lands exist on site. Since the
project site is located approximately one-half mile from the Pacific Ocean, no shoreline
development regulations apply. No scenic resources exist on or near the developed site. Given
the above, the project is consistent with the Mello I land use policies and the applicable
implementing ordinances.
E. Growth Management
The site is located within Local Facilities Management Zone 22. The installation of the
additional panel antenna on the building will not result in increased public facilities demands;
therefore, the proposal will not exceed performance standards for public facilities.
V. ENVIRONMENT AL REVIEW
The construction and installation of small new equipment facilities or structures is a Class 3
Categorical Exemption under the California Environmental Quality Act (Guidelines Section
15303). The FCC requires compliance with radio frequency power density standards
(ANSI/IEEE C95.l-1992) for the general public; therefore, the project would not have a
significant impact on the environment.
In light of the above, a Notice of Exemption will be filed by the Planning Director upon project
approval.
