SUBJECT: CUP 02-06 -CALLA \VAY /VERIZON \\'IRELESS -Request for approval of a
Conditional Use Permit to allow installation, operation and maintenance of an
unmanned wireless telecommunication facility located at 2180 Rutherford Road
in the C-M Zone, and in Local Facilities Management Zone 5.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 5255
APPROVING CUP 02-06 for a period of five (5) years based on the findings and subject to the
conditions contained therein.
Il. INTRODUCTION
This application is a request for a Conditional Use Permit (CUP) to allow Verizon Wireless to
install, operate and maintain an unmanned ,vireless telecommunications facility consisting of
twelve 4' tall panel antennas, one 2' microwave dish, one roof mounted GPS antenna and
equipment cabinets. The proposed unmanned wireless telecommunications facility ,vill be
located at the Callaway Golf building at 2180 Rutherford Road. Quasi-public utility facilities are
permitted in the Commercial-Light Industrial (C-iv1) zone by conditional use permit and the
required conditional use permit findings can be made for the proposed telecommunications
facility.
ID. PROJECT DESCRIPTION AND BACKGROUND
The proposed Conditional Use Permit is requested to install a Verizon Wireless
telecommunications facility at the subject site. The unmanned facility, which will be located at
the Callaway Golf building, ,vill consist oft\velve 4' tall panel antennas, one 2' microwave dish,
one GPS antenna and equipment cabinets. The equipment cabinets and the microwave dish will
be painted to match the existing building and the panel antennas will be installed behind the
existing equipment screening wall. The existing equipment screen ,vill be replaced by a
fiberglass screen, which will be of the same color and texture as the existing ,vall. The proposed
antennas will be mounted behind the new wall and will not be visible from the street or adjacent
properties. The new wall will be one foot higher at the western comer of the building and 2 1/2
feet higher at the eastern end than the existing wall to screen the antennas.
Verizon Wireless is a nationwide ·wireless carrier licensed by the Federal Communications
Commission (FCC) to provide mobile telephone, two-way radio, paging, data services and
wireless internet access for the public and private sectors including all emergency services to the
community. The proposed facility will provide wireless service to the surrounding commercial
and industrial areas.

IV. ANALYSIS
The proposed project is subject to the following regulations:
-
A. Heavy Commercial-Limited Industrial Zone (C-M) (Chapter 21.30 of the Carlsbad
Municipal Code);
B. Conditional Use Permit Regulations (Chapter 21.42 of the Carlsbad Municipal Code);
C. City Council Policy Statement: Policy 64 -Wireless Communication Facilities;
D. Comprehensive Land Use Plan for McClellan-Palomar Airport; and
E. Growth Management (Chapter 21.90 of the Carlsbad Municipal Code).
The recommendation for approval of this conditional use permit was developed by analyzing the
project's consistency with the applicable City regulations and policies. The project's compliance
with each of the above regulations is discussed in detail in the sections below.
A. Heavy Commercial-Limited Industrial Zone
The proposed development is consistent with all applicable development standards and
guidelines required by the C-M zone. There will be no change in building setbacks, coverage,
and architecture since the proposed facility will be located on the roof of an existing building.
The proposed antennas are to be installed behind the existing equipment screening walls which
are consistent with the height limit of 45 feet for intrusions for the C-M zone. The height of the
screening wall will be 43 '-6" at the eastern comer of the building and 42 feet at the western
comer. The proposal does not increase the lot coverage, floor area, or parking demand for the
site.
B. Conditional Use Permit Regulations
Conditional uses such as wireless communications facilities possess unique and special
characteristics which make it impractical to include them as permitted uses .. by right" in any of
the various zoning classifications (i.e., residential, commercial, office, industrial). The authority
for the location and operation of these uses is subject to Planning Commission review and the
issuance of conditional use permits. The following required conditional use permit findings for
the proposed telecommunications facility can be made:
1. The proposed use is: a) necessary and desirable for the development of the community in
that the community benefits of wireless communications include improved
telecommunications service for emergency services and individuals; and b) consistent
with the General Plan in that Planned Industrial land use designation does not preclude
the provision of quasi-public utility uses;
2. The proposed site is adequate in size and shape to accommodate the use in that the
proposed antennas will be mounted on the roof of an existing building, behind the
equipment screening wall and will not be visible from the street or adjacent properties;

3. All features necessary to adjust the requested use to the existing use are provided in that
the proposed roof mounted antennas will be located behind a fiberglass screen and will
not be visible from the street; and
4. The street system serving the proposed use would not be impacted by the proposed
conditional use in that additional vehicle trips are limited to occasional equipment
maintenance by service personnel.
C. City Council Policy Statement: Policy 64 -Wireless Communication Facilities
The City Council adopted policies regarding prioritization for the location of \Vireless
Communications Facilities (WCF) on October 3, 2001. The guidelines state that wireless
facilities should be located on buildings and structures, not on vacant land. In addition, WCFs
should locate, in order of priority, on industrial, commercfal, public, other non-residential, public
utility, park. or community faci}jty property.
Design guidelines of the policy state that all aspects of a \VCF, including the supports, antennas,
screening methods, and equipment should exhibit .. stealth" design techniques so they visually
blend into the background or the surface onto which they are mounted. The policy encourages
co-location wherever feasible and appropriate.
The project complies with this policy in that the proposed project will be located on an industrial
property and similar uses exist in the vicinity as well. The design and location of the antennas
and equipment cabinets exhibit a stealth design and antennas and equipment cabinets will not be
visible from the street and adjacent properties.
The applicant submitted an RF Emissions report to ensure that the RF emissions will not exceed
the FCC's guidelines. The report indicates that RF emissions of Verizon \Vireless antennas are
,vithin the applicable Maximum Permissible Exposure (MPE) limits.
D. Comprehensive Land Use Plan for l\fcClellan-Palomar Airport
The proposed project is in compliance ,vith the Comprehensive Land Use Plan (CLUP) for
McClellan-Palomar Airport. The subject property is located within the Airport Influence Area
and a small comer of the property is within the 60 CNEL noise contour. The proposed project is
an unmanned wireless facility and is consistent with the CLUP.
E. Growth Management
The subject site is located within Local Facilities Management Zone 5. The installation of the
proposed ,vireless facility at the roof of an existing building ,vith equipment cabinets will not
result in increased public facilities demands; therefore, the proposal '\\rill not exceed performance
standards for public facilities.

V. ENVIRONMENTAL REVIEW

The construction and installation of small new equipment facilities or structures is a Class 3
Categorical Exemption under the California Environmental Quality Act (Guidelines Section
15303). The FCC requires compliance with radio frequency power density standards
(ANSI/IEEE C95.l-1992) for the general public; therefore, the project would not have a
significant impact on the environment.
In light of the above, a Notice of Exemption will be filed by the Planning Director upon project
approval.
