SUBJECT: CUP 03-23/CDP 03-33 -POINSETTIA VILLAGE WIRELESS -Request for
approval of a Conditional Use Permit and Coastal Development Permit to allow
the installation, operation and maintenance of an unmanned wireless
communication facility located at 7130-7140 Avenida Encinas in the C-2-Q Zone
and in Local Facilities Management Zone 9.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolutions No. 5594 and 5595
APPROVING Conditional Use Permit CUP 03-23 for a period of five (5) years, and Coastal
Development Permit CDP 03-33, based on the findings and subject to the conditions contained
therein.
II. INTRODUCTION
This application is a request for a Conditional Use Permit (CUP) and Coastal Development
Permit (CDP) to allow Cinglular Wireless to install, operate and maintain an unmanned Wireless
Communication Facility (WCF) consisting of 8 equipment cabinets and 12 antennas that are
entirely concealed within a new architectural cupola in the Poinsettia Village Shopping Center in
the C-2-Q zone. The General Plan designates the commercial center for Travel Recreation
Commercial and Local Shopping Center (TR-L) uses. Quasi-public utility facilities are permitted
in any zone by Conditional Use Permit. All required conditional use permit findings have been
made for the proposed wireless telecommunication facility.
III. PROJECT DESCRIPTION AND BACKGROUND
The proposed CUP and CDP are requested to allow the installation of a Cingular Wireless WCF
at the Poinsettia Village shopping center located on the southeast comer of A venida Encinas and
Poinsettia Lane. The proposed facility consists of 8 equipment cabinets and a total of 12
antennas that will be entirely hidden behind a new architectural cupola that is textured and
painted to match the existing building surface. The antennas will be installed in the upper level
of the cupola and the equipment cabinets will be installed in the lower level. The height of the
cupola is 45-feet which is within the allowed height allowance for architectural projections.
Currently there is one existing Verizon WCF located within a tower feature in the shopping
center, and on January 21, 2004, the Planning Commission approved an AT&T WCF to be
located on the Ralph's building.

Cingular Wireless is a nationwide wireless carrier licensed by the Federal Communications
Commission (FCC) to provide personal communications services to the community. The
proposed WCF is necessary to reduce capacity and coverage deficiencies in the vicinity of the
site.
The proposed project is subject to the following regulations:
A. Conditional Use Permit Regulations (Chapter 21.42 of the CMC);
B. City Council Policy (64)-Wireless Communication Facilities; and
IV.
A.
C. Mello I Local Coastal Program.
ANALYSIS
Conditional Use Permit Regulations
Conditional uses such as WCFs possess unique and special characteristics that make it
impractical to include them as permitted uses "by right" in any of the various zoning
classifications (i.e. residential, commercial, office, industrial). The authority for the location and
operation of these uses is subject to Planning Commission review and the issuance of conditional
use permits. Staff has reviewed the proposed project and found that all the necessary findings
can be made to approve the CUP. The required findings and satisfaction of these findings are
provided below.

B. City Council Policy 64 -Wireless Communication Facilities
The project is also consistent with City Council Policy 64 Wireless Communication Facilities.
The proposed location in a commercial shopping center is a preferred location, and the stealth
design (i.e., entirely hidden behind a new architectural cupola to be textured and painted to match
the existing building) will completely limit the facility's visibility to the public.
C. Mello I Local Coastal Program
The policies of the Mello I Local Coastal Program are applicable to the project. The proposed
facility will be entirely hidden behind a new architectural cupola to be textured and painted to
match the existing building surface. The height of the structure is 45 feet which is consistent
with Chapter 21.28.030(d) -allowed height protrusions in the C-2 zone. Therefore, the project
will not degrade or obstruct any coastal view and is not subject to the policies or development
standards applicable to alteration of the physical environment.
V. ENVIRONMENTAL REVIEW
The construction and installation of small new equipment facilities or structures is a Class 3
Categorical Exemption under the California Environmental Quality Act (Guidelines Section
15303). The FCC requires compliance with radio frequency power density standards
(ANSI/IEEE C95 .1-1992) for the general public; therefore, the project would not have a
significant impact on the environment. A Notice of Exemption will be filed by the Planning
Director upon project approval.
