SUBJECT: CUP 03-26 -PILGRII\l CHURCH PCS FACILITY -Request for a
Conditional Use Pennit to allow for the installation of an unmanned \Vireless
Communication Facility (\VCF) consisting of three wireless panel antennas within
a new radio frequency transparent church cross and three ground mounted
equipment cabinets within a 120 square foot enclosed space on property located at
the northeast corner of Chestnut A Yenue and Monroe Street at 2020 Chestnut
Avenue in Local Facilities Management Zone 1.
I. RECOI\11\IENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 5620
APPROVING Conditional Use Pemnt No. CUP 03-26 based on the findings and subject to the
conditions contained therein.
II. INTRODUCTION
This application is a request for a Conditional Use Pennit (CUP) to allow an unmanned \VCF
consisting of three (3) panel antennas located within a new radio frequency transparent church
cross and an associated 120 square foot equipment area at the Pilgrim United Church of Christ of
Carlsbad located at 2020 Chestnut Avenue. The Conditional Uses section of the Carlsbad
:Municipal Code (21.42) allows \VCFs by Conditional Use Pem1it in all zones. All required
findings for the CUP can be made, and staff recommends approval of the proposed facility.
ID. PROJECT DESCRIPTION AND BACKGROUND
Sprint PCS is proposing a \VCF at the Pilgrim United Church of Christ of Carlsbad on Chestnut
A venue. The church is located at the northeast comer of the intersection of 1"1onroe Street and
Chestnut A venue. Generally the topography of the area falls away to the west and climbs to the
east. East and north of the church are single-fan1ily residences, to the west is Carlsbad High
School. and to the south is the Church of Christ of the Latter Day Saints. The facility will consist
of three panel antennas hidden inside a new church cross. made of radio frequency transparent
material. replacing the existing church cross. The associated equipment consists of three ground-
mounted cabinets located in a 120 square foot enclosed area adjacent to the sanctuary and
administration building. The equipment will be screened from public Yiew by a si.-...:-foot brick
veneer enclosure.
The applicant. Sprint PCS, has been authorized by the Federal Communications Commission
(FCC) to construct and operate a digital PCS network throughout California. The proposed site

was chosen by the applicant because the location and the elevation achieved by the new church
cross will enable Sprint to meet the capacity and coverage needs in this area
The proposed project is subject to the following regulations:
A. R-1 One Family Residential Zone (Chapter 21.10 of the Zoning Ordinance);
B. Conditional Use Permit regulations (Chapter 21.42 of the Zoning Ordinance);
C. Wireless Communication Facilities Policy (City Council Policy 64); and
D. Grmvth Management.
IV. ANALYSIS
Staff developed its approval recommendation after analyzing the project's consistency with the
applicable City regulations listed above. A discussion on the compliance with each of the
regulations follmvs.
A. R-1 One-Family Residential Zone
The proposed facility is consistent with all development standards of the One-Family Residential
zone. The WCF located inside the new church cross and the ground mounted equipment cabinets
located within the brick enclosure comply ,vith setback and lot coverage requirements and do not
require additional parking. The proposed cross is 40 feet tall. The height limit for residential
structures within the R-1 zone is 30 feet. Additional height may be permitted under Section
21.46.020 Allowed protrusions above height limits and Section 21.42.060 Building height and
lot area requirements of the Carlsbad Municipal Code. Neither code section specifies a
maximum height limit.
Section 21.46.020 permits structures that do not increase floor area such as flagpoles and
chimneys to exceed the residential structure height limit. Section 21.42.060 permits the Planning
Commission to make findings which allow structures to exceed the underlying zoning height
limit. In this case the cross may be permitted as a religious symbol.
The Zoning Ordinance Conditional Use regulations [Section 21.42.010 (16)] allows wireless
communication facilities, which must comply with City Council Policy Statement No. 64 in all
zones with a Conditional Use Permit. Required CUP findings (discussed in Section B below)
can be made for the proposed WCF as it is a desirable public convenience and is compatible with
its surroundings.
B. Conditional Use Permit Regulations
Conditional uses such as WCFs possess unique and special characteristics that make it
impractical to include them as permitted uses "by right" in any of the various zoning
classifications (i.e. residential, commercial, office, industrial). The authority for the location and
operation of these uses is subject to Planning Commission review and the issuance of a CUP.
Staff has reviewed the proposed project and found that all the necessary findings can be made to
approve the CUP. The required findings and satisfaction of these findings are provided below.

C. City Council Policy 64 -Wireless Communication Facilities
The project is also consistent with the location and design guidelines of City Council Policy
Statement No. 64 "Wireless Communication Facilities." The proposed location is preferred since
it is located at an existing church site in a residential area. Specifically, this type of location is
listed in City Council Policy Statement No. 64 under ··preferred" as l.g. The project design is
··stealth" and the equipment cabinets are entirely screened.
D. Growth :Management
The project is located in Local Facilities Management Plan Zone 1. Installation of the facility on
the existing church sanctuary building and monthly facility maintenance visits will not result in
increased public facilities demands; therefore, the proposal will not exceed performance
standards for public facilities.

V. ENVIRONMENTAL REVIEW
The proposal is exempt from the California Environmental Quality Act (CEQA). CEQA Section
15303 exempts construction and installation of small new equipment facilities or structures.
Additionally, as Sprint PCS must comply ,vith FCC regulations, radio frequency emissions from
the proposed facility are not considered a health hazard. A Notice of Exemption will be filed by
the Planning Director upon project approval.
