SUBJECT: PCD 04-03/CDP 04-59 -VOLKSWAGEN EXP ANSI ON -Request for
approval of a Planning Commission Determination and Coastal Development
Permit to demolish a portion of the existing building and to remodel and expand
the existing Volkswagen/Subaru dealership within the Car County Specific Plan
area on a 3.23 acre site located at 5500 Paseo Del Norte in the C-2 zone, within
the Mello II Segment of the City's Coastal Zone, and Local Facilities
Management Zone 3.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolutions No. 6014 and 6015
APPROVING Planning Commission Determination PCD 04-03 and Coastal Development
Permit CDP 04-59, based on the findings and subject to the conditions contained therein.
II. INTRODUCTION
The applicant is requesting approval of a Planning Commission Determination (PCD) and a
Coastal Development Permit (CDP) to allow for a remodel and expansion of the existing
Volkswagen/Subaru dealership site located at 5500 Paseo Del Norte within the Car ~ountry
Specific Plan in the C-2 zone in Local Facilities Management Zone 3. Findings required to
approve the PCD and CDP can be made, and the project is consistent with the General Plan, the
Car Country Specific Plan, relevant Mello II Segment LCP policies and relevant zoning
regulations of the Carlsbad Municipal Code.
III. PROJECT DESCRIPTION AND BACKGROUND
The subject site is located within the original Car Country Specific Plan area on the east side of
Paseo Del Norte, south of Cannon road and north of the east-west segment of Car Country Drive.
The project requires approval of a Planning Commission Determination to find consistency with
the Specific Plan and approval of a Coastal Development Permit is necessary due to the project's
location within the Mello II Segment of the City's Local Coastal Program. The project is not
located within the Appeal Jurisdiction area, therefore the CDP is not appealable to the California
Coastal Commission.

Planning Commission Determination is required for the addition to insure that the development
standards and design guidelines of the Specific Plan are incorporated into the design of the
project.
The proposed construction includes demolition of the existing Volkswagen/Subaru showroom
and construction of a new show room with office/storage space on the second floor and
modifications to the service write-up area for the Volkswagen portion of the dealership and a
new showroom and service canopy for the Subaru dealership. The additions will increase the
building area by about 7,300 square feet for a building total of 30,627 square feet. The new
construction will occur on the west side of the building facing Paseo Del Norte and will be
attached to the existing building.
The site has two access points on Paseo Del Norte and one access point on the unnamed cul-de-
sac north of the site. Access to the site will remain unchanged. However, the site circulation will
be modified since there will be two separate service write-up areas. The project's traffic engineer
prepared a traffic queuing analysis for the project's new service drive. The analysis included
observations and traffic counts with the current operation and configuration of the service drive.
The analysis concluded that the addition of the service drive incorporated adequate queuing area,
improved the on-site circulation, and would not create conflicts along Paseo del Norte.
The proposal would result in a net loss of about 23 auto display spaces due to the construction of
the addition. However, parking calculations have been provided according to the standards in the
Specific Plan and show that adequate parking will be provided on site for customers and
employees. New and used vehicle storage will be provided both on site and off-site at the
approved vehicle storage lot at 5007 Avenida Encinas (CUP 02-32).
The Spanish style building is consistent with the Specific Plan requirements related to
architectural design and incorporates a stucco exterior, cornice element, arched windows with tile
accent and decorative stone wainscot and accent elements. The existing building's architectural
appearance will be improved with the removal of the mansard roof and addition of a cornice
element along the top of the parapet.
No upgrades are proposed for landscaping along Paseo del Norte and comprehensive landscape
improvements are not required for building additions, except in areas that will be affected by the
new construction. Therefore, a small area of landscape will be added around the service entry off
of Paseo del Norte and that will include a tree and grass area.
The proposed project is subject to the following land use plans, policies, programs and zoning
regulations:

E. Growth Management (Local Facilities Management Zone 3).
IV. ANALYSIS
The recommendation of approval for this project was developed by analyzing the project's
consistency with the applicable policies and regulations listed above. The following analysis
section discusses compliance with each of the regulations/policies utilizing both text and tables.
A. General Plan
The following Table (Table 1) identifies General Plan goals and objectives relevant to the
proposed project and indicates the compliance of the proposal.

B. General Commercial Zone (C-2)

The General Commercial (C-2) zoning designation for the site is implemented via the Car
Country Specific Plan, which allows new and used auto sales and service uses. The proposed
remodel will reconfigure the existing Volkswagen showroom and will add a second showroom
and service write-up area for Subaru. The requested use is properly related to the site,
surroundings and environmental setting as the project design complies with the requirements and
development standards of the Car Country Specific Plan. The location of the building and
proposed circulation plan accommodates the planned uses and operations which take place on
site and the project provides adequate parking for customers and employees, and for
storage/display of vehicles, as shown in Table 2 below.
The proposed use is consistent with the existing and planned development in the area; therefore,
adjacent properties will not be adversely impacted. The various goals and objectives of the
General Plan will be implemented since this project represents part of the build-out and
implementation of an approved Specific Plan (Car Country) within the City of Carlsbad.
The site is adequate in size and shape to accommodate the proposed building and the proposed
use complies with all required development and design standards. The demolition, remodel and
addition results in a lot coverage of 19% which is below the allowable lot coverage of 25%. The
new portions of the building will be set back 45 feet or greater from Paseo del Norte and
adequate circulation, access aisles and parking spaces will be provided for all of the existing and
proposed uses on the site. The land use and circulation requirements for the site and surrounding
dealerships and related automotive uses were developed at a Specific Plan level and the street
system serving the proposed use will be adequate to handle all traffic generated by the project.
C. Specific Plan 19(G) -Car Country
The site is located within the original boundaries of the Car Country Specific Plan (SP 19),
which was approved in 1972. Subsequent to the original approval, a number of amendments
have been approved including an expansion of Car Country to include the sites located west of
Car Country Drive, and other minor amendments related to signage and development standards.
The proposed project is consistent with the design guidelines and development standards
contained in the Specific Plan. The following table is provided as a brief overview of
development standard compliance.

D. Mello II Segment of the Local Coastal Program/Coastal Resource Protection
Overlay Zone/Coastal Development Procedures
The proposed addition and remodel of the Volkswagen/Subaru auto dealership is consistent with
the relevant policies of the Mello II Segment of the Local Coastal Program and the Coastal
Resources Protection Overlay Zone. The project site has been previously disturbed and is
developed with an existing auto dealership, service buildings and associated parking. The
proposed project will not obstruct views of the coastline as seen from public lands or the public
right-of-way or otherwise damage the visual beauty of the coastal zone. No agricultural uses
currently exist on the site, nor are there any sensitive resources located on the property. The
proposed project is not located in an area of known geologic instability or flood hazard. No
public opportunities for coastal shoreline access are available from the subject site since it is not
located between the first public road and the ocean and no public access requirements are
conditioned for the project. There are no steep slopes or natural vegetation on the subject site.
The Developer is required to comply with the City's requirements of the National Pollutant
Discharge Elimination System (NPDES) permit and the Developer is required to provide

Storm Water Best Management Practices Handbook" to reduce surface pollutants to an
acceptable level prior to discharge to sensitive areas. These measures will ensure, to the
maximum extent practicable, that no additional pollutants of concern are contributed to the
watershed. The project includes a condition for the applicant to complete a detailed storm water
management plan and implement the measures required to ensure storm water quality is not
impacted as a result of the project, including incorporation of a biofilter BMP in the landscape
area along Paseo del Norte for the New Car Display area. Therefore, the project will not have
drainage impacts on coastal resources.
E. Growth Management
The proposed project is located within Local Facilities Management Zone 3 in the northwest
quadrant of the City. The impacts on public facilities created by the project, and its compliance
with the adopted performance standards, are summarized in the table below:

V. ENVIRONMENTAL REVIEW
The Planning Director has determined that the project belongs to a class of projects that the State
Secretary for Resources has found do not have a significant impact on the environment and it is
therefore categorically exempt from the requirement for the preparation of environmental
documents pursuant to Section 15332 -In-Fill Development Projects of the state CEQA
Guidelines. In making this determination, the Planning Director has found that the exceptions
listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project.
In light of the above, a Notice of Exemption will be filed by the Planning Director upon project
approval.
