SUBJECT: COP 16-06-I~APTIE RESIDENCE-Request for approval of a Coastal Development Permit
to allow for the construction of a 3,668 square foot, two-story single family residence with
an attached two-car garage within the Mello II Segment of the Local Coastal Program
located at 5070 Carlsbad Boulevard within Local Facilities Management Zone 3. The
project site is not located within the appealable area of the California Coastal
Commission. The City Planner has determined that the project belongs to a class of
projects that the State Secretary for Resources has found do not have a significant impact
on the environment, and it is therefore categorically exempt from the requirement for
the preparation of environmental documents pursuant to Section 15303(a}, construction
of a single family residence of the state CEQA Guidelines.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 7185 APPROVING Coastal
Development Permit CDP 16-06, based upon the findings and subject to the conditions contained therein.
II. PROJECT DESCRIPTION AND BACKGROUND
Project Site/Setting: The 0.15-acre (6,600 square feet, gross; 6,180 square feet net) project site is a vacant
infill parcel located along the east side of Carlsbad Boulevard, one lot south of the intersection with
Cannon Road, as shown on the attached location map. The parcel sits at an elevation approximately 10
feet above the elevation of Carlsbad Boulevard and no frontage improvements exist. Existing fencing and
walls which are located on shared property lines with properties to the north, east and south are proposed
to remain. No agricultural acti1vities, sensitive resources, geological instability, flood hazards or coastal
access opportunities exist on site. Table "A" below includes the General Plan Land Use designations,
zoning and current land uses of the project site and surrounding properties.

Proposed Residential Construction: The project involves the construction of a new 3,668 square foot,
two-story single-family residence with an attached two-car garage on a vacant lot. Due to the change in
grade between the building pacl and Carlsbad Boulevard (i.e., 10 feet), the two-car garage is proposed to
be constructed below grade and designed as a basement. Also included in the basement is an elevator

and storage room. The two--story single-family residence has a proposed height of 24 feet; this height
measurement excludes the garage elevation as it is defined as a basement. The proposed contemporary
style includes a flat roof and clean rectilinear architectural lines. Exterior building materials consist
primarily of stucco with a smooth finish and horizontal metal panels. The proposed elevator has a
maximum height of 29'-6" and is an allowable architectural projection. The three bedroom, three bath
single:family home also includes a 288 square foot deck on the second floor and a 497 square foot rooftop
deck. To allow for future improvements to Carlsbad Boulevard, the proposed project includes a seven-
foot dedication along the western/front property line. The project has been designed to meet the
setbacks from the future right-of-way/property line.
Proposed Grading: Estimated grading quantities include 1,057 cubic yards (CY) of cut with 120 CY of
remedial grading. Overall, a total of 1,057 CY will be exported from the site. As a result of the 10-foot
change in grade between Carlsbad Boulevard and the building pad, a series of stepped retaining walls are
proposed in between the garage and Carlsbad Boulevard. Eacti step of the retaining wall has a maximum
height of 42 inches; the stepped design will allow for landscaping in between the walls to soften the
appearance as viewed from Carlsbad Boulevard. A grading permit will be required for this project.
Ill. ANALYSIS
The project is subject to the following regulations and requirements:
A. R-4 Residential General Plan Land Use Designation;
B. One-Family Residential (R-1) Zone (CMC Chapter 21.10);
C. Coastal Development Hegulations for the Mello II Segment of the Local Coastal Program (CMC
21.201) and the Coastal Resource Protection Overlay Zone (CMC 21.203);
D. lnclusionary Housing 01rdinance (CMC Chapter 21.85); and
E. Growth Management (CMC Chapter 21.90).
The recommendation for approval of this project was developed by analyzing the project's consistency
with the applicable city regullations and policies. The project's compliance with each of the above
regulations is discussed in detail. in the sections below.
A. General Plan Land Use! Designation
Table "B" below includes both the gross and net developable acreage of the project site, the number of
dwelling units allowed by the General Plan's Growth Management Control Point (GMCP) density; and the
proposed number of dwelling units and the density of the project.

The General Plan Land Use designation for the property is R-4, Residential 0-4 dwelling units per acre. The
R-4 designation allows for residential development at a density range of 0 to 4 dwelling units per acre
(du/ac) with a Growth Management Control Point (GMCP) of 3 .. 2 du/ac. The project site has a net
developable acreage of0.14 acres; at the 3.2 GMCP, 0.4 dwelling units are allowed. Although the project's
proposed density of 7.1 du/ac exceeds the R-4 density range of 0 to 4 du/ac, one single-family dwelling
unit is guaranteed pursuant to the following General Plan land Use provision: "Notwithstanding the

density provisions and intent of each residential land use designation, a one-family dwelling shall be
permitted on any legal lot that existed as of October 28, 2004." The subject lot was legally created prior
to October 28, 2004; therefore, the development of the subject lot with one single-family home is
consistent with the R-4 General Plan Land Use designation.
B. One-Family Residential Zone (R-1)
The project is required to comply with all applicable regulations and development standards of the
Carlsbad Municipal Code (CMC) including the One-Family Residential (R-1) zone. The proposed project
meets or exceeds all applicable requirements of the R-1 zone as shown in Table "C" below.

C. Conformance with th4~ Coastal Development Regulations for the Mello II Segment of the Local
Coastal Program (CMC: Chapter 21.201) and the Coastal Resource Protection Overlay Zone (CMC
Chapter 21.203).
The project site is located within the Mello II Segment of the Local Coastal Program (LCP) and is not located
within the appeals jurisdiction of the California Coastal Commission. In addition, the site is located within
and subject to the Coastal Resource Protection Overlay Zone. The project's compliance with each of these
programs and ordinances is discussed below:
1. Mello II Segment of the Certified Local Coastal Program and ail applicable policies.
The General Plan land Use designation for the property is R-4, Residential 0-4 dwelling units per acre. The
R-4 designation allows for residential development at a density range of 0 to 4 dwelling units per acre
(du/ac) with a Growth Management Control Point (GMCP) of 3.2 du/ac. As discussed in Section "A" above,
the proposal to build one single-family home is consistent with the General Plan. Therefore, the project
is consistent with the Mello II Segment of the LCP.
The project consists of a new 3,668 square foot, two-story single-family residence with an attached two-
car garage which is designed as a basement on a vacant lot. The new home is proposed in an area
designated for single-family residential development. The proposed two-story residence is compatible
with the surrounding development of one-and two-story single-family residential structures.
Additionally, the two-story residence will not obstruct views of the coastline as seen from public lands or
public right-of-way nor otherwise damage the visual beauty of the coastal zone. Furthermore, no
agricultural uses exist on the site, nor are there any known sensitive resources located on the site. The
proposed single-family residence is not located in an area of known geologic instability or flood hazard.

Given that the site does not have any frontage along the coastline, no public opportunities for coastal
shoreline access or water-oriented recreational activities are available.
2. Coastal Resource Protection Overlay Zone
The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (CMC
Chapter 21.203 of the Zoning Ordinance) in that the project will adhere to the city's Master Drainage Plan,
Grading Ordinance, Storm Water Ordinance, Carlsbad BMP Design Manual and Jurisdictional Urban Runoff
Management Program (JURMP) to avoid increased urban run-off, pollutants and soil erosion. No
undevelopable steep slopes or native vegetation is located on the subject property and the site is not
located in an area prone to landslides, or susceptible to accelerated erosion, floods, or liquefaction.
D. lnclusionary Housing Ordinance (CMC Chapter 21.85)
For any residential development of less than seven (7} units, the inclusionary housing requirements may
be satisfied through the payment of an inclusionary housing impact fee. The proposal to construct one
(1} single-family residential dwelling unit has been conditioned to pay the applicable housing impact fee
prior to the issuance of a building permit.
E. Growth Management
The proposed project is located within Local Facilities Management Zone 3 in the northwest quadrant of
the city. The impacts on publlic facilities created by the project, and its compliance with the adopted
performance standards, are summarized inTable "D" below.

IV. ENVIRONMENTAL REVIEW
This project is exempt from CEQA per the exemptions listed below:
Section 15303(a) of CEQA exemptions (Class 3) exempts the construction of single family
residences in urbanized areas from environmental review.
A Notice of Exemption will be fiiE~d by the City Planner upon project approval.
