SUBJECT: CUP 16-02-VERIZON CARLSBAD VILLAGE-Request for approval of a Conditional Use
Permit to allow for the installation, operation, and maintenance of a new unmanned
Wireless Communication Facility (WCF) consisting of three sectors of four antennas (12
total), 12 Remote Radio Units (RRU), three surge protection units, two equipment
cabinets, one stand-by generator, and one Global Positioning System (GPS) antenna
mounted behind new radio frequency (RF) transparent screens on the roof of an existing
office building located at 3150 Pio Pico Drive and in Local Facilities Management Zone 1.
The City Planner has determined that the project belongs to a class of projects that the
State Secretary of Resources has found not to have a significant impact on the
environment, and is therefore categorically exempt from the requirement for the
preparation of environmental documents pursuant to Section 15303-New Construction
of Small Structures, of the State CEQA Guidelines.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 7182 APPROVING CUP 16-02
for a period of 10 years, based on the findings and subject to the conditions contained therein.
II. PROJECT DESCRIPTION AND BACKGROUND
The proposed unmanned WCF consists of roof mounted telecommunication equipment cabinets, a roof
mounted standby generator, 12 panel antennas, 12 RRU, three raycap surge protection units, and one
GPS antenna. The panel antennas will be mounted on the roof behind a new RF transparent screen and
will not be visible from the street or the surrounding properties. There is an existing roof screen on the
roof to screen existing mechanical equipment that will be raised three feet and ten inches in order to
screen the antennas and related equipment. The existing roof screen is constructed of wood and will be
replaced with a new RF transparent material and textured with stucco and a cornice will be added to the
top of the screen to integrate better with the architecture of the building. Other associated equipment
will not be visible as the four RRU units will be mounted behind the antennas and the GPS antennas will
be mounted to the equipment cabinet. There are no proposed ch<mges to the landscaping and no parking
spaces will be removed to accommodate the new WCF.
The facility is unmanned and operates 24 hours a day, seven days a week. Since the facility is unmanned,
it will not generate any traffic. The facility will be connected to a central network operations center that
monitors the facility's status. Routine maintenance occurs once every four to six weeks to ensure the
equipment is operating within normal specifications. If an emergency arises, maintenance crews are
dispatched to correct the situation.

Wireless carriers construct new WCF's in a specific area to achieve one ofthe following:
• Provide signal coverage of sufficient strength to achieve consistent, sustainable, and reliable
service to customers at a level sufficient for outdoor, in-vehicle, and in-building penetration with
good voice and data quality during high demand periods.
• Provide additional system capacity to ensure there is sufficient signal capacity to offset the
contraction of signal experienced when nearby sites become overloaded and more enhanced
voice and data serviCI~s are uses, thereby creating periodic gaps. With heavy use, this contraction
of signal is intensified due to the unique properties of digital radio transmissions.
In this case, the proposed site is a capacity site. Verizon's radio frequency (RF) engineers also observed
that the existing/surrounding Verizon sites are becoming overloaded, and determined that an additional
facility is needed in order to relieve network traffic congestion and ensure reliable levels of service.
Table A below includes the General Plan designations, zoning and current land uses ofthe project site and
surrounding properties.

Ill. ANALYSIS
The proposed project is subject to the following ordinances, standards, and policies:
A. Office (O) General Plan Land Use designation;
B. Office (0) Zone (Chapter 21.27 of the Carlsbad Municipal Code);
C. Conditional Use Permit regulations (Chapter 21.42 of the Carlsbad Municipal Code);
D. Wireless Communication Facilities Policy (City Council Policy Statement No. 64); and
E. Growth Management
The recommendation for approval of this project was developed by analyzing the project's consistency
with the applicable regulations and policies. The project's compliance with each of the above regulations
is discussed in the sections below.
A, Office (O) General Pllan land Use Designation
The project site is designated Office (O) on the city's General Plan land Use Map. The proposed WCF is
consistent with the 0 General Plan Land Use designation in that the 0 Land Use designation does not
preclude the use of wireless communication facilities. The proposed use will serve the residential and
business community and region as a whole, including emergency services. Therefore, the proposed WCF
use is consistent with the 0 General Plan Land Use designation.

B. Office (O) Zone, Chapter 21.27 of the Carlsbad Municipal Code
The proposed WCF is located on the rooftop of an existing office building within the Office Zone. Wireless
communication facilities, such as the proposed project, are allowed in all zones including the Office Zone
with approval of a CUP. The required CUP findings (discussed in Section C below) can be made for the
proposed WCF as it is a desirable public convenience and is compatible with its surroundings.
The 12 panel antennas will be mounted on the roof behind an RF transparent screen wall that integrates
with the architecture of the office building. The maximum above ground height of the screen walls is 35
feet, which is the maximum height permitted in the Office zone. The WCF does not impact the setback
requirements of the Office zone because the antennas and all associated equipment will be located on
the roof of the existing building and no modifications to the building envelope are proposed.
C. Conditional Use Permit Regulations, Chapter 21.42 of the Carlsbad Municipal Code
The proposed project is a use which is allowed in the Office Zone (O) subject to the approval of a CUP.
Chapter 21.42 of the Carlsbad Municipal Code requires that four findings be made in order to approve a
CUP. All of these findings can be made for this project as discussed below.
Conditional uses such as WCF possess unique and special characteristics that make it impractical to include
them as permitted uses "by right" in any of the various zoning classifications (i.e. residential, commercial,
office, industrial, and open space). The authority for the location and operation of these uses is subject
to City Council Policy Statement No. 64 -Wireless Communication Facilities Policy (see discussion D
below), Planning Commission review, and the issuance of a CUP. Staff has reviewed the proposed project
and found that all of the necessary findings can be made to approve the CUP. The required findings and
satisfaction of these findings are provided below.
1. That the requested use is necessary or desirable for the development of the community, and is in
harmony with the various elements and objectives ofthe general plan, including, if applicable, the
certified local coastal program, specific plan or master plan, in that the proposed WCF use is
necessary and desirable for the development of the community because of the benefit and
demand for digital communications and data transmiss:ions for businesses, individuals, public
agencies and emergency service systems. The proposed use is consistent with the General Plan
in that the Office Land Use designation does not preclude the provision of WCF uses, nor is it
detrimental to existing permitted uses in the vicinity in that the WCF exhibits stealth design and
only minor alterations to the existing site are proposed.
2. That the requested use is not detrimental to existing uses or to uses specifically permitted in the
zone in which the proposed use is to be located in that the proposed WCF visual impacts will be
minimized as the 12 panel antennas and all other associated equipment will be roof mounted
on an existing office~ building and will be screened behind an RF transparent screen wall that
will be finished with stucco and will have cornice at the top, which will integrate with the
architecture of the building. There are no other changes proposed to the exterior of the building
or to the landscapinig on-site.
3. That the site for the proposed conditional use is adequate in size and shape to accommodate the
yards, setbacks, walls, fences, parking, loading facilities, buffer areas, landscaping and other
development features prescribed in this code and required by the city planner, planning
commission or city council, in order to integrate the use 'with other uses in the neighborhood in
that the 12 panel antennas and all other associated equipment will be roof mounted on an

existing office building behind RF transparent screen walls that will be finished with stucco with
a cornice at the top, which will integrate with the architecture of the building. Installing the
Wireless Communication Facility on the roof does not require any modifications to the building
envelope that would alter the setbacks for the existing office building nor does it require the
removal of any parking spaces or changes to the site's landscaping. The RF transparent screen
wall will have a ma>timum height of 35 feet, which complies with the allowed height of the
Office (0) Zone.
4. That the street system serving the proposed use is adequate to properly handle all traffic
generated by the proposed use in that the use generates very little traffic, requiring only routine
monthly maintenance visits and occasional visits in response to operational problems. Pio Pico
Drive and Pine Avenue will be used to access the site. The existing street system is adequate to
property handle any traffic generated by the use.
D. City Council Policy Statement No. 64-Wireless Communication Facilities
Pursuant to Carlsbad Municipal Code Section 21.42.140(165)b, a WCF Conditional Use Permit application
that does not comply with the preferred location and the stealth design review and approval guidelines
of City Council Policy Statement No. 64 shall be conditionally approved or denied by the Planning
Commission.
The WCF project does not comply with the setback requirement as listed in Design Guideline B.2.a. of City
Council Policy Statement No. 64. Specifically, a WCF should, be set back from the residential zone
boundary a minimum distance equal to the above-ground height ofthe antenna. The top of the 6'9" tall
antennas measure 35 feet from grade, which would require a 35 foot setback from the residentially zoned
properties from the east and south. The antennas located closest to the east property line are setback 16
feet, and the antennas located closest to the south property line are setback 32 feet. However, there is
no visual impact by locating the antennas closer to the property line than the required distance of 35 feet
as the 12 panel antennas will be roof mounted on an existing office building and will be screened behind
an RF transparent screen wall that will be finished with stucco and will have cornice at the top, which will
integrate with the architecture of the building. Additionally, the proposed WCF facility meets the Federal
Communications Commission standards for radio frequency (RF) compliance and will not expose people
to harmful levels of RF. Verizon Wireless analyzed 11 other potential sites within the vicinity of the
proposed location and determined they were not feasible for reasons such as zoning, structural integrity
of rooftops, no interest from owners and antenna heights not being high enough to gain maximum
coverage. The WCF has been designed using "stealth" design techniques to the extent feasible and is
consistent with the Design Guidelines listed in City Council Policy Statement No. 64. Furthermore, the
Office Zone is considered a preferred location for a wireless communication facility.
E. Growth Management
The proposed WCF is located in Local Facilities Management Plan Zone 1. Installation of the facility on
the existing site and monthly facility maintenance visits will not result in increased public facilities
demands; therefore, the proiPosal will not exceed performance standards for public facilities.

IV. ENVIRONMENTAL REVIEW
The City Planner has determined that the project belongs to a class of projects that the State Secretary
for Resources has found do not have a significant impact on the environment, and it is therefore
categorically exempt from the requirement for the preparation of environmental documents pursuant
to Section 15303 (New Construction of Small Structures) of the state CEQA Guidelines. Additionally, as
Verizon Wireless must comply with FCC regulations, radio frequency emissions from the proposed
facility are below levels established as acceptable by the FCC, and are therefore not considered a health
hazard. In making this determination, the City Planner has found that the exceptions listed in Section
15300.2 of the state CEQA Guidelines do not apply to this project.
