SUBJECT: COP 16-07-OTA RESIDENCE-Request for approval of a Coastal Development Permit to
allow for the demolition of an existing single-family residence and detached garage and
the construction of a 4,250 square foot single-family residence within the Mello II
Segment of the City's Coastal Zone located at 4090 Garfield Street within Local Facilities
Management Zone 1. The project site is within the appealable area olf the California
Coastal Commission. The City Planner has determined that the project belongs to a class
of projects that the State Secretary for Resources has found do not have a significant
impact on the environment, and it is therefore categorically exempt from the
requirement for the preparation of environmental documents pursuant to Section
15303(a), construction of a single-family residence, of the state CEQA Guidelines.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 7191 APPR:OVING Coastal
Development Permit CDP 16-07 based upon the findings and subject to the conditions contained therein.
II. PROJECT DESCRIPTION AND BACKGROUND
Project Site/Setting: The .12 acre (5,014 square feet), project site is located at 4090 Garfield Street as
shown on the attached location map. The site is currently developed with one single-family residence and
a detached garage. The topography of the site is generally flat and includes ornamental landscaping
around the existing residence. Table "A" below includes the General Plan Land Use designations, zoning
and current land uses ofthe project site and surrounding properties.

Proposed Residential Construction: The project consists of the demolition of an existing single-family
residence and detached garage and the construction of a new 4,250 square foot single-family residence.
The two-story residence sits above a basement and two-car garage. The modern style home includes
curved "barrel" roof features and metal railings along the balconies and roof deck. The exterior consists
mainly of a smooth stucco finish. Metal clad wood windows are located on all elevations and vary in
shape and size. Two wood trellis features are located on the front/west elevation.
Proposed Grading: Estimated grading quantities include 660 cubic yards (cy) of cut, 30 c:y of fill with 630
cy of export. A grading permit will be required for this project.
Ill. ANALYSIS
The project is subject to the following regulations and requirements:
A. R-8 Residential General Plan Land Use Designation;
B. Two-Family Residential (R-2) Zone (CMC Chapter 21.12);
C. Coastal Development Regulations for the Mello II Segment of the Local Coastal Program
(CMC 21.201) and the Coastal Resource Protection Overlay Zone (CMC 2.1.203);
D. lnclusionary Housing Ordinance (CMC Chapter 21.85); and
E. Growth Management (CMC Chapter 21.90).
The recommendation for approval of this project was developed by analyzing the project's consistency
with the applicable city regulations and policies. The project's compliance with each of the above
regulations is discussed in detail in the sections below.
A. General Plan Land Use Designation
The project site has a General Plan Land Use designation of R-8 Residential which allows for the
development of single-family and two-family residences at a density of 4-8 dwelling units per acre with a
Growth Management Control Point (GMCP) of 6 dwelling units per acre. The project's density (8.3
du/ac) exceeds the R-8 Residential density range of 4-8 du/ac. However, one single-family dwelling is
permitted to be constructed on a legal lot that existed as of October 28, 2004 pursuant to General Plan
Residential Land Use Policy 2-P.7. The subject lot was legally created prior to October 28, 2004;
therefore development of a one-family dwelling is consistent with the R-8 General Plan Land Use
designation.
B. Two-Family Residential Zone (R-2)
The project is required to comply with all applicable regulations and development standards of the
Carlsbad Municipal Code (CMC) including the Two-Family Residential (R-2) zone. The proposed project
meets or exceeds all applicable requirements of the R-2 zone (Shown in Table "B" below).

C. Conformance with the Coastal Development Regulations for the Mello II Segment of the Local
Coastal Program (CMC Chapter 21.201) and the Coastal Resource Protecti<m Overlay Zone
(CMC Chapter 21.203).
The project site is located within the Mello II Segment of the Local Coastal Program and is in the appeal
jurisdiction. The site is also located within and subject to the Coastal Resource Protection Overlay Zone.
The project's compliance with each of these programs and ordinances is discussed below:
1. Mello II Segment of the Certified Local Coastal Program and all applicable policies.
The project is located in the Mello II Segment of the Local Coastal Program.
The subject site has an LCP Land Use Plan designation of R-8 Residential, which allows for a density of 4-
8 du/acre and 6 du/acre at the Growth Management Control Point (GMCP). The project density of 8.3
du/ac is consistent with the R-8 Residential General Plan Land Use designation as discussed in Section
uA" above. Therefore the project is consistent with the Mello II Segment of the LCP.
The project consists of the demolition of an existing single-family residence and the construction of a
new 4,250 square foot single-family residence with an attached two-car garage in an an~a designated for
residential development. The proposed two-story, single-family residence is comiPatible with the
surrounding development of one and two-story single-family and multi-family structures. The two-story
residence will not obstruct views of the coastline as seen from public lands or the public right-of-way,
nor otherwise damage the visual beauty of the coastal zone. Furthermore, no agricultural uses exist on
the developed site, nor are there any sensitive resources located on the site. The proposed single-family
residence is not located in an area of known geologic instability or flood hazard; and giiven that the site
is located on the opposite side of the street from Agua Hedionda Lagoon, no public opportunities for
coastal shoreline access or water-oriented recreation activities are available.
2. Coastal Resource Protection Overlay Zone
The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (CMC
Chapter 21.203 of the Zoning Ordinance) in that the project will adhere to the city's Master Drainage
Plan, Grading Ordinance, Storm Water Ordinance, Standard Urban Storm Water Mitigation Plan
(SUSMP) and Jurisdictional Urban Runoff Management Program (JURMP) to avoid increased urban run-
off, pollutants and soil erosion. The subject property is a previously developed lot that does not include

(equal to or greater than 25% gradient) nor native vegetation. In addition, the site is not located in an
area prone to landslides, or susceptible to accelerated erosion, floods or liquefaction.
D. lnclusionary Housing Ordinance (CMC Chapter 21.85)
For any residential development of less than seven (7) units, the inclusionary housing requirements may
be satisfied through the payment of an inclusionary housing in-lieu fee. However, pursuant to Carlsbad
Municipal Code Section 21.85.030D.3., the construction of a new residential structure which replaces a
residential structure that was destroyed or demolished within two years prior to the application for a
building permit for the new residential structure is exempt from affordable housing requirements,
provided that the number of residential units is not increased from the number of residential units ofthe
previously destroyed or demolished residential structure. The proposal to demolish one existing single-
family residence and construct one single-family residence has been conditioned to pay the applicable
housing in-lieu fee on a per unit basis for one unit if building permits for the project have not been applied
for within two years of demolishing the existing single-family residence on-site.
E. Growth Management
The proposed project is located within Local Facilities Management Zone 1 in the northwest quadrant of
the city. No impacts are associated with the project as the project consists of repllacing an existing
dwelling unit and no new impacts will be generated.
IV. ENVIRONMENTAL REVIEW
This project is exempt from CEQA per the exemptions listed below:
(1) Section 15303(a) of CEQA exemptions (Class 3) exempts the construction of single-family
residences in urbanized areas from environmental review.
A Notice of Exemption will be filed by the City Planner upon project approval.
