SUBJECT: CUP 16-07 (DEV 2016-0030) – CARLSBAD ELLERY RESERVOIR WCF – Request for approval
of a Conditional Use Permit to allow for the installation, operation and maintenance of a
Wireless Communications Facility (WCF) for the San Diego County Regional
Communications System within a new 60-foot tall faux mono-eucalyptus tree consisting
of three (3) transmitting Omni communication antennas, one (1) receive only Omni
antenna, one (1) City of Carlsbad VHF Omni antenna, one (1) City of Carlsbad receive only
Omni antenna, one (1) 4-foot microwave dish and one (1) City of Carlsbad (1-foot by 1-
foot) SCADA (i.e., monitor and control system); and installation of a 10-foot by 24-foot
prefabricated equipment shelter and a 60 KW enclosed emergency generator with 200
gallon diesel tank fuel supply located at 2237 Janis Way within Local Facilities
Management Zone 1. The City Planner has determined that the project belongs to a class
of projects that the State Secretary of Resources has found not to have a significant
impact on the environment, and is therefore categorically exempt from the requirement
for the preparation of environmental documents pursuant to Section 15303 – New
Construction of Small Structures, of the State CEQA Guidelines.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 7235 APPROVING CUP 16-07
for a period of 10 years, based on the findings and subject to the conditions contained therein.
II. PROJECT DESCRIPTION AND BACKGROUND
Project Description:
The proposed Wireless Communications Facility (WCF) is for the San Diego County Regional
Communications System and will consist of a new 60-foot tall faux mono-eucalyptus tree concealing
behind its branches and leaves three (3) transmitting Omni communication antennas, one (1) receive-only
Omni antenna, one (1) City of Carlsbad VHF Omni antenna, one (1) City of Carlsbad receive-only Omni
antenna, one (1) 4-foot microwave dish and one (1) City of Carlsbad (1-foot by 1-foot) SCADA unit (i.e.,
monitor and control system). Also included is the installation of a new ground mounted 10-foot by 24-
foot prefabricated equipment shelter and a 60 KW enclosed emergency generator with a 200 gallon diesel
tank fuel supply.
The project site is located at 2237 Janis Way on property owned by the City of Carlsbad. The site is
operated by the Carlsbad Municipal Water District (CMWD) and is presently developed with the Ellery
Reservoir water storage tank. Additionally, STC One, LLC and now Crown Castle International have
operated a WCF on the property under a license agreement since 1997. Crown Castle presently operates
the existing 56.5-foot tall faux mono-palm tree WCF located near the proposed WCF. The proposed WCF
and ground mounted equipment will be recessed into an existing 15-foot tall embankment with an
existing 6-foot tall solid wood fence on top separating the water storage tank from the neighboring

adjacent residences to the south and southeast. The existing landscaping between the proposed facility
and the adjacent residential properties to the south is being enhanced to assist in providing additional
vegetative screening and buffering of the facility. The location of the proposed WCF on-site has been
strategically sited to avoid existing utilities and to allow for unimpeded vehicular access and maintenance
operations in and around the water storage tank.
The proposed WCF is an unmanned facility and will operate 24 hours a day, seven days a week. Since the
facility is unmanned, it will not generate any traffic. The facility will be connected to a central network
operations center that monitors the facility’s status. Routine maintenance occurs once a month to ensure
the equipment (including the emergency generator) is operating within normal specifications. If an
emergency arises, it is expected that maintenance crews will be immediately dispatched to correct the
situation.
Background:
The San Diego County Sheriff’s Department operates the Regional Communications System used by law
enforcement, emergency and first responder agencies throughout the County including the City of
Carlsbad’s Police and Fire Departments. One of the elements of this system is currently located on the
400-foot tall Encina Power Plant exhaust stack. The Encina Power Station is tentatively scheduled to be
decommissioned in 2018; as such, NRG Energy, Inc. has elected not to renew the existing lease agreement
with the County.
The County has studied the radio coverage of the coastal north-county area for the purpose of finding
alternative radio sites that would provide the required radio coverage. Based on technical constraints
including line of sight location requirements between elements of the system and transmission capability
to fixed and mobile receivers, the preferred site for the replacement is the high point adjacent to the
Ellery Reservoir water storage tank. The subject property provides an alternate radio site that would allow
the County to continue to provide public safety radio coverage within the city after the Encina Power
Station is decommissioned. The specific location onsite is on the south side of the water tank in the vicinity
of the other existing WCF and related ground mounted equipment. A detailed Site Alternatives and
Selection analysis was prepared by the County and is included as Attachment No. 4 to the Staff Report.
County staff held a neighborhood meeting on October 19, 2017 from 7:00 to 9:00 pm at the City of
Carlsbad’s Faraday Building to present and discuss the project. All property owners within a 600-foot
radius of the project site were notified and invited to hear a presentation regarding the project and given
the opportunity to ask questions of the project team. The project team consisted of County of San Diego
staff from both the Wireless Services Division and Department of General Services, project architect, land
use consultant, noise consultant and radio frequency consultant. Also in attendance were City of Carlsbad
Planning Division staff, Fire Chief and Police Chief. Four members of the public attended who reside in
the neighborhood on Janis Way and Sara Way adjacent to the site. Issues raised by those in attendance
primarily pertained to traffic and noise associated with past construction activities at the site regarding
the existing water storage tank and a recent retrofit to that facility.

III. ANALYSIS
The proposed project is subject to the following ordinances, standards and policies:
A. Residential R-4 General Plan Land Use designation;
B. Residential Agricultural (R-A-10,000) Zone (Chapter 21.08 of the Carlsbad Municipal Code);
C. Conditional Use Permit regulations (Chapter 21.42 of the Carlsbad Municipal Code);
D. Wireless Communication Facilities Policy (City Council Policy Statement No. 64); and
E. Growth Management
The recommendation for approval of this project was developed by analyzing the project’s consistency
with the applicable regulations and policies. The project’s compliance with each of the above regulations
is discussed in the sections below.
A. Residential (R-4) General Plan Land Use Designation
The project site is designated Residential (R-4) on the city’s General Plan Land Use Map. The proposed
WCF is consistent with the R-4 General Plan Land Use designation in that the R-4 Land Use designation
does not preclude the use of Wireless Communication Facilities (WCF). The proposed use will serve the
emergency service providers both locally and regionally; and through those operations, the local
community and region as a whole will benefit. Therefore, the proposed WCF use is consistent with the R-
4 General Plan Land Use designation.
B. Residential Agricultural (R-A-10,000) Zone, Chapter 21.08 of the Carlsbad Municipal Code
The proposed WCF is located on a new 60-foot tall faux mono-eucalyptus tree within the Residential
Agricultural (R-A-10,000) Zone. A WCF, such as the proposed project, are allowed in all zones including
the R-A-10,000 Zone with approval of a CUP. The required CUP findings (discussed in Section C below)
can be made for the proposed WCF as it is a critical component of the regional communications system
for emergency services, and thus a necessary public convenience; and with its stealth design as a faux
tree, sufficiently screened by the water tank, mature landscape around the property’s perimeter, and the
surrounding topography, is not visually intrusive or incompatible with adjacent residential land uses.

C. Conditional Use Permit Regulations, Chapter 21.42 of the Carlsbad Municipal Code
The proposed project is a use which is allowed in the Residential Agricultural (R-A-10,000) Zone subject to
the approval of a Conditional Use Permit (CUP). Chapter 21.42 of the Carlsbad Municipal Code requires
that four findings be made in order to approve a CUP. All of these findings can be made for this project
as discussed below.
Conditional uses such as Wireless Communications Facilities (WCF) possess unique and special
characteristics that make it impractical to include them as permitted uses “by right” in any of the various
zoning classifications (i.e. residential, commercial, office, industrial, and open space). The authority for
the location and operation of these uses is subject to City Council Policy Statement No. 64 – Wireless
Communication Facilities Policy (see discussion D below), Planning Commission review and the issuance
of a CUP. Staff has reviewed the proposed project and found that all of the necessary findings can be
made to approve the CUP. The required findings and satisfaction of these findings are provided below.
1. That the requested use is necessary or desirable for the development of the community, and is in
harmony with the various elements and objectives of the general plan, in that the use is consistent
with the General Plan in that the Residential R-4 Land Use designation does not preclude the
provision of Wireless Communication Facility (WCF) uses. The WCF is located on a public utility
installation in a residential zone (Ellery Reservoir), which is not publicly accessible and therefore is
a preferred location pursuant to City Council Policy No. 64, Wireless Communication Facilities. The
project’s location and stealth faux tree design also enables the project to comply with the General
Plan objectives that seek to maintain and enhance Carlsbad’s appearance.
2. That the requested use is not detrimental to existing uses or to uses specifically permitted in the zone
in which the proposed use is to be located in that the proposed Wireless Communication Facility
(WCF), which is stealthily disguised as a faux eucalyptus tree, will be sufficiently screened by the
existing water storage tank, mature landscaping around the property’s perimeter, and the
surrounding topography so as not to be visually intrusive or incompatible with adjacent residential
land uses. Additionally, a Radio Frequency (RF) Electromagnetic Fields Exposure Study was
prepared by Dtech Communications (February 8, 2017) demonstrating that the cumulative
exposure levels from this facility, combined with other existing facilities onsite, will be well below
the Federal Communication Commission’s (FCC) Maximum Permissible Exposure (MPE) limits for
the public. Furthermore, in accordance with Performance Guideline C.5 of City Council Policy
Statement No. 64, the project has also been conditioned to comply with FCC RF Exposure
Guidelines. Lastly, a Noise Impact Assessment was prepared by ABC Acoustics, Inc. (January 25,
2017) in accordance with the City of Carlsbad’s Noise Guidelines. Calculations confirm that, as
designed and conditioned, with the exception of the emergency generator, exterior noise levels
from the equipment inside meet the applicable noise limits defined by the City’s noise guidelines at
all sensitive receptors.
3. That the site for the proposed conditional use is adequate in size and shape to accommodate the
yards, setbacks, walls, fences, parking, loading facilities, buffer areas, landscaping and other
development features prescribed in this code and required by the city planner, planning commission
or city council, in order to integrate the use with other uses in the neighborhood in that with
exception to a setback exemption for the 60-foot tall Wireless Communication Facility (WCF) (7.5
feet proposed where 60 feet is recommended), which is allowed pursuant to Section 21.42.140 of
the Carlsbad Municipal Code; and provisions to decrease setbacks pursuant to Design Guideline
B.5.c. of City Council Policy Statement No. 64, the proposed WCF complies with all requirements of

the code and City Council Policy Statement No. 64. Additionally, the ground mounted equipment
will be sufficiently screened by a retaining wall, the water storage tank, and the surrounding
topography, and will not obstruct driveway access around the water storage tank. Lastly, the WCF,
which is stealthily disguised as a faux eucalyptus tree, will be sufficiently screened by the existing
water storage tank, mature landscaping around the property’s perimeter, and the surrounding
topography so as not to be visually intrusive or incompatible with adjacent residential land uses.
4. That the street system serving the proposed use is adequate to properly handle all traffic generated
by the proposed use in that the use generates very little traffic, requiring only one routine monthly
maintenance visit and the occasional emergency visit in response to operational problems. The
existing street system is adequate to property handle any traffic generated by the use.
D. City Council Policy Statement No. 64 – Wireless Communication Facilities
Pursuant to Carlsbad Municipal Code Section 21.42.140.B.165.b, a Wireless Communication Facility (WCF)
Conditional Use Permit application that does not comply with the preferred location and the stealth
design review and approval guidelines of City Council Policy Statement No. 64 shall be conditionally
approved or denied by the Planning Commission.
It should be noted that the WCF is within a preferred location and exhibits a “stealth” design consistent
with the guidelines; however, it does not comply with the setback recommendation as listed in Design
Guideline B.5.b. of City Council Policy Statement No. 64. Specifically, a WCF located in a residential zone
and public utility installation, should be set back from the property boundaries of the utility installation a
minimum distance equal to the above-ground height of the antenna. In this case, the top of the antennas
and faux eucalyptus tree foliage measure 60 feet high from grade, which should require a 60-foot setback
from the property boundary. Pursuant to Design Guideline B.5.c. of City Council Policy Statement No. 64
and Section 21.42.140 of the Carlsbad Municipal Code, the Planning Commission may decrease setbacks.
Given the water storage tanks existing location in the center of the site and the other onsite utilities
surrounding it, there are no other locations onsite to accommodate the proposed WCF or provide for the
recommended 60-foot setback. The 4-foot microwave dish would be the closest portion of the WCF to
the property line, which is setback approximately 7.5 feet. The center point of the monopole (i.e. faux
tree trunk) is setback approximately 16.5 feet. However, there are no visual impacts in locating the
antennas closer to the property line than the required distance of 60 feet, in that the WCF antennas,
microwave dish and SCADA unit will all be screened within the branches and dense foliage of the faux
mono-eucalyptus tree which is also being set amongst other mature trees of similar height along with
additional screening type landscaping proposed to provide additional buffering and softening of the use.
A detailed Photo-Simulation was prepared and is included as Attachment No. 5 to the Staff Report.

E. Growth Management
The proposed Wireless Communications Facility (WCF) is located in Local Facilities Management Plan Zone
1. Installation of the WCF on the existing site and monthly facility maintenance visits will not result in
increased public facilities demands; therefore, the proposal will not exceed performance standards for
public facilities.
IV. ENVIRONMENTAL REVIEW
The City Planner has determined that the project belongs to a class of projects that the State Secretary
for Resources has found do not have a significant impact on the environment, and it is therefore
categorically exempt from the requirement for the preparation of environmental documents pursuant to
Section 15303 (New Construction of Small Structures) of the state CEQA Guidelines. Additionally, as the
County of San Diego must comply with FCC regulations, it has been determined that the cumulative radio
frequency emissions from the proposed WCF combined with the other existing facilities are below levels
established as acceptable by the FCC and are therefore not considered a health hazard. In making this
determination, the City Planner has found that the exceptions listed in Section 15300.2 of the state CEQA
Guidelines do not apply to this project.

Carlsbad Radio Site Alternatives and Selection
[See map for corresponding sites locations (#)]
Emergency radio coverage for fire, police and medical services for the City of Carlsbad is
currently provided by two distinct locations. The Lake San Marcos radio site (located about
seven miles southeast of downtown Carlsbad) covers the majority of City's inland areas east of
the Interstate 5, and the Encina Power Plant radio site (antennas located on the existing 400’
stack) provides most of its radio coverage along the City's shoreline, downtown area and
Interstate 5.
The Encina Power plant radio site is located less than two miles from downtown Carlsbad with a
clear ‘line of sight’ to downtown Carlsbad, thus providing excellent indoor coverage to the
majority of the densely populated region. The anticipated loss of Encina Power plant radio site
will result in unacceptable loss of radio coverage in the downtown area. Therefore, it is vital
that the new radio site be located at the optimal location to safeguard this essential emergency
radio coverage.
All radio sites provided by the City including private property, City parks and water tank
facilities were evaluated equally. The County and the City formed a working group to evaluate
alternatives and coverage provided by each potential radio site. Representatives from the City
Fire and Police Departments worked together with County engineers and reached a consensus
on the site that provided the best coverage for their service area. After a thorough review and
consideration of each potential site, the Ellery Reservoir site (#1), located on Janis Road
(currently housing Crown Castle commercial cellular tower), was selected as the preferred site.
The subject site provides the best overall coverage to the coastal area, downtown Carlsbad,
Interstate 5 and will increase coverage along State Highway 78.
Site Selection Process
Given the topographical character of the City of Carlsbad, the selected radio site must meet
three unique conditions. First, the new placement must be located at least 300' above sea level
to cover the entire length of Interstate 5 within the City limits and to provide sufficient radio
signal along the City's shoreline. Second, the placement must be located within a two to three
mile radius from downtown Carlsbad to ensure public safety quality building signal penetration.
Third, the placement must not be obstructed by any fabricated or natural obstacles that may
attenuate the radio signal.
County engineers evaluated all of the City’s recommendations including Calavera Hills (#2),
Maerkle Reservoir (#3), Carlsbad Safety Training Center (#4) and La Costa Hi Reservoir (#5), all
which proved to be too distant from downtown Carlsbad and Interstate 5.

The remaining eligible radio sites were the Twin "D" Tanks (#6), the SDG&E property (#7) on
Cannon Road, the Carlsbad Water Recycling Facility (#8) and the water tank location at Carlsbad
Village (#9). The SDG&E property on Cannon Road and the Carlsbad Water Recycling Facility
were too low in elevation to provide good indoor coverage in downtown Carlsbad. The Twin
"D" Tanks are located on a higher site and provide good radio coverage along Interstate 5;
however, it is too far from the target area to provide good indoor coverage in downtown
Carlsbad. The water tank at Carlsbad Village provides good indoor coverage for downtown
Carlsbad, good coverage along Interstate 5 and excellent coverage along the State 78 Highway
zone. However, this site is too small to house the necessary tower, equipment shelter, and
emergency generator.
None of the radio sites mentioned above supplied by the City covered the downtown area with
enough signal to ensure good indoor coverage. Alternative solutions were considered, including
a theoretical 60’ to 100' tower in the existing Encina Power Plant site but the site elevation
would be too low to provide good indoor coverage in downtown Carlsbad.
Conclusion:
Because wireless coverage works on a line‐of sight basis, the higher and closer a site location is
to the service area, typically the better job it will do with coverage. The Ellery Water tank site
on Janis Road has been determined to provide the greatest coverage to downtown Carlsbad,
along Interstate 5, and along State Highway 78. The site is large enough to house the necessary
infrastructure. The proposed tower will not block or reduce views of the ocean. The existing
trees and water tank will obscure the view of the proposed faux eucalyptus tree, resulting in
insignificant aesthetic impacts. Currently, the Ellery water tank site houses a 45' tall cellular
carrier faux mono-palm tower. The County considered collocating on this structure but this
tower is not tall enough to accommodate the five, 14' long omnidirectional public safety
antennas and one microwave dish.
The proposed 60' faux eucalyptus tree tower will visually blend with the nearby existing trees
and along with the equipment shelter located behind the water tank will make the structure
indiscernible from nearby residential vantage points. The new faux tower would not degrade
the current visual character or quality of the site and its surroundings. This site has been
selected to maximize radio coverage thus enhance safety and emergency response for the
residents of Carlsbad and the hundreds of thousands of tourists that visit the City's downtown
and beaches. It should be emphasized that public health, safety and welfare are key findings
for a Conditional Use Permit.

Alternative Location Selection within Site
The proposed location within the Ellery Reservoir site resulted in collaboration efforts with the
property owners, in this case the Carlsbad Water District. Richard Williams P.E., a utility
manager for the Water District, suggested that the Water District would prefer the proposed
location for the communications facility, due to infrastructure conflicts at the southeast
segment of the site. Furthermore, the electrical and operations staff also weighed in and all
have agreed that the proposed location is the most desirable from the District’s standpoint.
