Subject: Amend the Carlsbad Municipal Code to rename and expand the scope of
the Traffic Safety Commission relating to multimodal transportation
systems.

Background
At the annual goal setting workshop held on March 20, 2018 City Council directed staff to
change the name and amend the duties of the Traffic Safety Commission to align with the
implementation of the General Plan Mobility Element. The proposed amendments adjust all
references to the traffic safety commission, update the duties of the Traffic Safety Commission
relating to multimodal transportation systems, and remove sections from Chapter 2.28 to
eliminate redundancy with Chapter 2.15 that relates to all boards and commissions.
The proposed name change is intended to do two things:
1. Expand the duties of the commission to be involved in all mobility issues, and not just
automobile and pedestrian traffic
2. Emphasize that safety is a priority in all decisions going forward; the Mobility Safety
Commission will not be limited to issues related only to safety.
Discussion
A goal setting workshop was hosted by the City Council on March 20, 2018. City Council
approved Resolution No. 2018-052 on April 17, 2018 establishing the City Council goals that
included the following:
By April 2019, amend the duties of the Traffic Safety Commission to include
advising the City Council on matters related to implementation of the General Plan
Mobility Element.
Staff is scheduled to submit an ordinance for City Council approval on April 23, 2019 proposing
specific changes to the CMC directly tied to this City Council goal. Staff is in the process of
preparing a work plan for the Mobility Safety Commission that will guide work over the next
year as it relates to matters related to the implementation of the General Plan Mobility
Element. Staff took this opportunity to review all CMC sections that related to, or referenced,
the Traffic Safety Commission with the resulting recommendations:

• revise CMC Section 2.28.010 to rename the traffic safety commission the Mobility Safety
Commission;
• revise CMC Section 2.28.050 to change the duties of the renamed Mobility Safety
Commission relating to multimodal transportation systems;
• revise CMC sections 2.15.050, and 2.12.125 to reference the Mobility Safety
Commission instead of the Traffic Safety Commission;
• eliminate CMC sections 2.28.020 and 2.28.040 because sections found within Chapter
2.15 have been added or revised to address the same subject matter.
Necessary Council Action
An ordinance will be required to be adopted by the City Council to make changes to the CMC.
Next Steps
Staff will prepare a staff report to City Council to introduce the ordinance for the recommended
changes to the CMC.
Staff will prepare a draft work plan for the renamed Mobility Safety Commission. The work plan
is expected to emphasize the commission’s new duties and City Council directive to have the
Mobility Safety Commission advise City Council on matters related to implementation of the
General Plan Mobility Element.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, AMENDING CHAPTER 2.28, SECTION 2.15.050 and SECTION
2.12.125 OF THE CARLSBAD MUNICIPAL CODE
WHEREAS, on July 2, 1968, the City Council of the City of Carlsbad established a Traffic Safety
Commission to study and make recommendations regarding traffic safety; and
WHEREAS, the City Council has established a goal to have the City of Carlsbad become a leader
in multimodal transportation systems and creative approaches to moving people and goods through
and within the City of Carlsbad; and
WHEREAS, the City Council wishes to expand the scope of the Traffic Safety Commission so that
the commission can advise the City Council on matters related to implementation of the General Plan
Mobility Element; and
NOW, THEREFORE, the City Council of the City of Carlsbad, California, does ordain as follows:
SECTION I: The above recitations are true and correct.
SECTION II: That Carlsbad Municipal Code Chapter 2.28 is amended to read as follows:
Chapter 2.28
MOBILITY SAFETY COMMISSION
Sections:
2.28.010 Created.
2.28.050 Duties.
2.28.010 Created.
A Mobility Safety Commission for the city is created.
2.28.050 Duties.
It shall be the duty of the Mobility Safety Commission to study all matters referred to it
concerning mobility and traffic safety, including implementation of the General Plan Mobility
Element, and to make written recommendations to the City Council regarding measures that
should be taken to promote mobility and traffic safety within the city as follows:
A. Review staff studies and reports, and make recommendations to the City Council on
mobility and traffic safety matters, including those related to pedestrian, bicycle, and
vehicular modes of travel;
B. Provide a public forum to review community input regarding mobility issues, including
those related to pedestrian, bicycle, vehicular and other modes of travel;

C. Review and provide recommendations for revision to the city codes and plans on
mobility and traffic safety matters, including those related to pedestrian, bicycle and
vehicular modes of travel, and parking and school traffic safety.
SECTION III: That Carlsbad Municipal Code Chapter 2.15, section 2.15.050 is amended to read
as follows:
2.15.050 Appointments.
A. Appointments to the Planning Commission, Parks and Recreation Commission, and
Mobility Safety Commission, shall be made by the following process:
1. The mayor and each council member shall nominate one individual to serve on each of
the commissions for a term coinciding with the term of the council member making the
appointment. The mayor shall nominate two additional individuals to serve on each of the
commissions. All nominations shall be subject to ratification by a majority vote of the City
Council. If a nominee is not approved by a majority vote of the City Council, the council
member making the nomination may nominate another individual at the same or a
subsequent meeting. In the event that a member of the City Council does not make any
nomination within 45 days of the date the council member is sworn into office or within
60 days of the occurrence of a vacancy, the appointment will be made by the mayor with
the approval of the City Council.
2. Although each member of the City Council elected by a district shall use his or her best
efforts to appoint individuals residing in that district to these commissions, members of
the City Council may appoint individuals not residing in their districts in their discretion in
order to assure that the most interested and qualified individuals serve on the
commissions.
B. Appointments to all other city boards and commissions shall be made by the mayor with
the approval of the City Council.
SECTION IV: That Carlsbad Municipal Code Chapter 2.12, section 2.12.125 is amended to read
as follows:
2.12.125 Attendance at commission meetings.
The city manager may attend any and all meetings of the Planning Commission, Parks and
Recreation Commission, Harbor Commission, Library Commission, Mobility Safety Commission
and any other commissions, boards or committees created by the City Council, upon the city
manager’s own volition or upon direction of the City Council. At such meetings which the city
manager attends, he or she shall be heard by such commissions, boards or committees as to all
matters upon which the city manager wishes to address the members thereof, and he or she
shall inform the members as to the status of any matter being considered by the City Council,
and the city manager shall cooperate to the fullest extent with the members of all commissions,
boards or committees appointed by the City Council.

EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption; and the City
Clerk shall certify the adoption of this ordinance and cause the full text of the ordinance or a
summary of the ordinance prepared by the City Attorney to be published at least once in a

A traffic mMobility Ssafety cCommission for the city is created.
2.28.020 Membership—Appointment—Terms.
The traffic safety commission shall consist of five seven members appointed by the mayor and confirmed
by the city council. Each member shall serve until their successor is duly appointed. The members shall
serve staggered terms at least two years apart. In order to stagger the terms, upon the next appointment
of commission members after the effective date of the ordinance from which this section derives, two
members will be appointed for terms expiring two years thereafter and three members will be appointed for
terms expiring four years thereafter. All subsequent appointments will be for four-year terms. Members of
the commission may be removed by the mayor with the consent of the city council at any time. The
transportation director shall be an ex officio member and serve as secretary to the commission. The ex
officio member shall not be entitled to vote.
2.28.040 Officers—Meetings—Reports—Conduct of meetings.
The commission shall elect a chair, a vice chair, and such other officers as it deems desirable. The officers
shall serve for a term of one year and until the election of successors. The commission shall hold meetings
no less than once during each calendar month (provided agenda items exist), and shall send a report of
each month’s meeting to the city council. The commission may adopt its own rules and regulations.
2.28.050 Duties.
It shall be the duty of the traffic safety mMobility Safety cCommission to study all matters referred to it
concerning mobility and traffic safety and pedestrian safety, including implementation of the General
Plan Mobility Element, and to make written recommendations to the cCity cCouncil regarding
measures that should be taken to promote mobility and traffic and pedestrian safety within the city as
follows:
A. Review staff studies and reports, and make recommendations to the cCity cCouncil on mobility and
traffic safety matters involving, including those related to traffic and pedestrian, bicycle, and vehicular
modes of travel safety;
B. Provide a public forum to review citizen complaints and requestscommunity input regarding traffic and
