The following Committee Members were present:
Mary Casler, Chairman

Absent: Patrick O'Day
For informational purposes, Mayor CasLer informed the Committee that the deadline
for calling an election for June is March 11, 1983; and the deadline for calling
an election for November is August 12, 1983.
APPROVAL OF MINUTES: The February 3, 1983, minutes were approved as submitted.
AYES : Casler, Kulchin, Straub, Skotnicki, Cool and Feld

Mayor Casler stated that the ordinance is now law in Carlsbad, and the charge of
this committee is to make guidelines for interpreting that law and not to try to
interpret the thoughts in people's minds when they voted on the matter.
A. SEPARATE ENTITIES OUTSIDE THE CITY OF CARLSBAD.
Mayor Casler referenced pages 1 and 2 of the material distributed with the agenda
regarding definitions and then referenced pages 8 and 9 of the discussion paper
pertaining to separate entities.
The City Attorney referenced the definition section of the ordinance, and expressed
the opinion that the other agencies, such as Parking Authority, Building Authority,
and Housing and Redevelopment Commission, are separate legal entities, and not
subject to the restrictions of the ordinance.
Mr. Skotnicki expressed the opinion that such an interpretation would allow the
City to create numerous separate legal entities in the future to subvent the
ordinance. He stated that the Parking Authority is an example of direct subversion
of the people's authority over spending public funds. He stated that as far as
the people are concerned, the different agencies are part of the City and should
fall within the purview of this ordinance.
The City Attorney explained that the Housing and Redevelopment Commission had
processed their Plan in accordance with the law, and the referendum time period
had lapsed. Therefore this ordinance could not apply to those projects and the
method for dealing with those would have been through referendum.

The Committee determined to continue with the remainder of the agenda at their
next meeting, and they adjourned to Thursday, February 24, 1983, at 8:30 A.M.
in the Council Chambers.
