CALL TO ORDER:
Chairman Louis called the meeting to order at 2:OO p.m.
ROLL CALL:
Present: Commissioners Louis, Henley, Kubota, Maerkle and Melideo.
Absent: None.
PLEDGE OF ALLEGIANCE was led by Commissioner Henley.
COMMENTS FROM THE PUBLIC:
Margaret Bonas questioned why the contractor for the Hubbs-Sea World construction
project was not required to use reclaimed water for earthwork and compaction activities.
It was explained by staff that reclaimed water was not in close proximity to the project
and it would be prohibitive to require the contractor to truck all reclaimed water needed
for construction across town. It was also pointed out that reclaimed water is being used
for projects where available such as present construction in the Aviara development area.
OLD BUSINESS:
0928-01 - Synopsis of AB 3030
The District Engineer, Bill Plummer gave a synopsis of AB 3030. This 1992 ACWA
legislation regarding ground water was sponsored by Ken Crawford of Fresno. AB 3030
would provide a valuable tool for protecting and enhancing water resources. It would
authorize any water agency that provide water services to adopt and implement a ground
water management program in a ground water basin underling jurisdiction that is
presently not managed by any other agency. Fees and assessments would carry out
and pay for the ground water program and development.
The plan would allow the agency control to develop a plan variation and determine
where wells would be drilled within jurisdictions and how much water may be pumped out of wells. There is a minimum requirement of 100 gallons per minute. Having water
agencies in control of the ground water they could maximize their water supply and keep

the wells from being over extracted. The plan would allow the water agency a chance
to review land use planning to prohibit development which may cause contamination
around the areas protected.
NEW BUSINESS:
0928-02 AWCA Fall Conference
Commissioner Melideo wanted clarification regarding gifts and/or prizes that may be
acquired by a Commissioner if they were acting as a District representative at the time
of winning said gift/prize.
At a previous meeting Mary Melideo was designated to be the District’s representative
at the ACWA fall conference. Since that time, the budget has been substantially cut back
and no further travel or expenditures will be paid by the District for the Commissioners.
At the spring ACWA conference Commissioner Maerkle won free lodging and registration
to the ACWA fall conference. Commissioner Melideo questioned if that should not be
property of the District to be used for any one of the Commissioners.
Mr. Maerkle said he only won this prize because it was a contest and the prize was non-
transferrable.
Bob Greaney said that he spoke with the City Attorney regarding gifts and they have no
policy concerning this matter.
Commissioner Louis said that there is a Resolution that states all travel by the
Commissioners will be reimbursed. Bob Greaney explained that was true, but at that
time the City could not have envisioned the present economic condition. The District has
been requested every year by the City Manager‘s office to reduce the budget.
P & M MEETING:
Commission Maerkle reported that Dave Kelly was the guest speaker and talked about
water issues.
GENERAL MANAGER’S REPORT:
Bob Greaney, the General Manager presented a copy of the Request for Proposal of the
rate study to the commissioners. The commissioners requested that they be invited to
the interviews, staff said they would be notified.

APPROVAL OF MINUTES:
On motion by Commissioner Maerkle, the Minutes of the Regular Meeting held on August
24, 1994, were approved as presented.

NEXT MEETING DATE:
The next regular meeting of the Water Commission will be October 12, 1994.
