DATE OF MEETING: September 15, 1970 - 4:00 P.M.

Present: Bob Watson, Thelma Sowell, Win Friday, Glenn McComas,
Jack Arnold, Bill Esterline, Bob Neely, Alex Wolenchuk,
Chief Anear, Hunter Cook, Stuart Wilson
Absent: Bill Cannon, Knox Williams, Don Hickethier
1. Status of water systems improvement project - The City Engineer
reported on the status of the water system improvement project:
A. Plans and specifications are progressing and should be
complete by Engineering Science approximately November 1.
B. Some modifications have been made in the size of the parcels
to be acquired for Elm Avenue and Skyline reservoirs in order
to reduce land acquisition costs. Consideration is being
given to filing condemnation procedures on all parcels as a
formality, in order to avoid delay in obtaining possession
of the properties in case negotiated purchase is impossible.
2. Water bonds - Mrs. Sowell advised the Committee that charges
of approximately $1,200 to $1,500 will be incurred to obtain
Moody"s and Standard and Poor bond ratings.
3. Water Department audit - The audit has been completed and verifies
the preliminary predictions submitted previously by Mr. Carroll.
The Water rates will be reviewed at the first of the year.
4. Carlsbad Municipal Water District - A general discussion of
the CMWD/City Water Department inter'-relationship was held.
The question of the affect of John Stull's "Special District"
Bill was discussed. The City Attorney indicated he did not
believe it would have a significant affect on us.
The City Attorney will prepare a letter to our special legal
counsel in this matter, Leroy Wright, addressing specific
questions regarding various possibilities for solving the
matter. The Attorney will send a draft of the letter to all
members of the Committee for comment prior to sending it to
Mr. Wright. Mr. Wright will be asked to comment on the
advisability of an immediate court case to determine our right
to wholesale connections both within the existing City limits
and within areas to be acquired in the future. He will also
be asked to comment on the matter of de-annexing land for an
improvement district and paying off existing obligations.
The basic item will be to determine what is possible legally
before determining what is practical politically.
