City Cl-erk stated he would call Mr. kdgerwood about the invitation, as sone mem- ber of the Sanitary Board might be interested..in attending,
Letter from the Automobile Club of So'uthern Calif.ornla. quoting in- stalled price on signs and hardware to be installed on U, s, 101, de- signating it as "Business Route", of $59.19, 2nd stating that it will be necessary to secure 6 giderlte posts from the Highway Department, C-an, Ede moved that the Council authorize the expenditure for signs at the prices indicated, and for the six giderite posts to be obtai-ned from the Highway Department, Seconded by Cmn, Castorena, All ayes, motion carried.

Letter frorii County of Sayl Diego, office of the Grand Jury, signed
by C, L. Christie, foreman, pointing out certain unsafe and unsanitary conditions on the Carlsbad beach and asking that remedial measures be taken in the interests of public health and safety. The .City Attorney reminded the Council that an ordinance prohibiting dumping of trash on either public or vacant private property would be prepared from a study being made by the Recreation Cornmission, Meantime, IVlayor Wc- Clellan suggested that Mr. 0. €4, Morris, owner of the property at the foot of Cedar Street where the d-umping has occurred., be contacted and asked whether he would post the area. or give the City authority eo do
SO. On the matter of the safety guard art the foot of Cedar, it was agreed that posts with reflector signs be used instead of barriers, Cm. Ede moved that the matter be left to the discretion of the Dire& or of Public Works, and that the City Clerk be authorized to follow ou his suggestions'as to purchasing any items necessary, Seconded by Cmn Sutton, The City Clerk stated that the letter had been acknowledged and Mr. Christie informed of the "Cleqn-Up" campaign conducted on August 29th on the beach. It was also suggested that the Public Works Director investigate the problem of drainage in the area of the Cedar Street arroyo as there is considerable erosion, Vote: all ayes, motion carried ,
.Letter from H, PI, Walker asking.the Council to consider a proposal made to the Oceanside-Carlsbad -Transportation Company to re-route their buses to include a section of Garfield Street between Tamarack a: Grand Avenue. City Clerk Hagen stated that 26 letters had been re- ceived m the saole subject. He was asked to discuss the matter with

Nr. Friend, superintendent of transportation of the 0-C Transportation Company, and ascertain whether he will entertain a re-study of the matter, advising him of the number of requests received.
City Clerk Hagen reminded the Council of the League of Cities' meeting at EL Ca-jon Elks Club, reservations to be made with the City Clerk by Wednesday noon.
Mayor IVIcClellan reported that the Sanitary. District Board of Di- rectors requested a joint meeting with the City Council on Iqonday, Septem- ber Zlst, at 7::30 P. Pi,, probably on the subject of the sewage plant,
City Clerk Hagen read the following memoranda from the. Planning Commission:
(1) Recommending approval of the request for reclassification from R-1 to R-2 of Parcel 5 of Tract 117, and Parcels 1, 2, 3, and 4 of Tract 115, Carlsbad Lands, requested by George and Adaline Prudhomme, et al. The property was located on the map as lying between the freeway and Elmwood, on both sides of Elm Avenue. Cmn. Ede moved that the Corn- cil accept the recommendation of the Ilanning Commission, and that a hearing be set at 8:OO P. H, on Taesday, October 6th, on said application, Seconded by Cmn, Castorena, All ayes, motion carried.

(2) Recommending -approval of application for special use permit to.al1ow expansion of commercial laundry operations to include diaper service at 534 Elm Avenue, in a C-1 zone, as requested by Alonzo .V. Ro- mero. Cmn, Ede moved that a special use permit be granted Alonzo V, Romero for the purpose .requested. Seconded by Cmn. Chase, All ayes, mot ion carried.
(3) Recommending that no fees for either variance or rezoning re- quests be refunded if the request is denied. After discussion, ,the mat- ter was referred to the City Attorney to interpret the ordinance and to recommend revision, if necessary, It was brought out that the entire zonSng ordinance is in need of .n?evision, and Mr. Bond, Chairmn ,of the Planning Commission, was asked whether any work has been done by the
. Planning Cornmission toward revision. He stated no .recommendations were
ready at this time. It was noted that considerable interest is being shown by individuals as to location of future streets.
Bernie Robinson was present and stated he would like to know what restrictions governed posting of an advertising sign on Highway 101, City Attorney Smith stated that a sign ordinance had been framed but had met with some objections and has not been presented to the Council; that so far as the City is concerned there is no prohibiting ordinance, and ' advertising signs are a permitted use in a C-1 zone, He was advised to talk over the situation with Col. Hagen, He also made the suggestion that there should be signs or mrkers clearly indicating to highway motor- ists that there is a business section to the east,
City Clerk submitted a bill for installing of two spot lights on the Chief of Police 1 s car , of .$43.6j, which had been paid by the Chief , Cmn. Castorena moved that the Council authorize the payment of $163.65 as reimbursement for installation of two spot lights on his car, for use in police work. Seconded by Can. Chase. All ayes, motion carried,
The matter of creating a lighting district on Roosevelt Street, discussed in the Council several months ago, was reviewed, In discussing the limits of the district, Crm. Castorena .stated he believed it should extend from Elm Avenue to beyond Walnut, possibly to 1"ignolia. City At- torney Smith outlbed the legal procedure, which would be initiated by the Council ordering the Public Works Director to define the area and diagram it and prepare a cost estimate (which the San Diego Gas C% Elec- tric Company will do upon request) and upon the filing of the diagram and cost estimate a Notice of Intention to form a lighting district is posted
and a hearing held. Can. Castorena, stated he was convimed the people of that area desire the lighting district and that he believed it would be a great help to the Police Department. Mr. Ewald asked about the possibility of creating a lighting district -east of the freeway, City Attorney Smith stated that creating a larger district would probably re- sult in considerable economy over the creating of several smaller ones. Mzyor WcClellam proposed that the entire matter be put into the hands of a Council committee for study and recommendations, and, upon agreement of the other members, appointed Cmn. Chase to head -such a co-mmittee, other members being City Clerk Hagen and Nr. Barter, Cmn. Castorena volunteered

hanging baskets of flowers on the arm-bracket of the light pole, asking that it be given consideration in the Committee's deliberations.
The matter of signs and posters posted on trees and poles in Carlsbad by the Del Nar Hotel and the Oceanside Athletic Club was discussed, and the City Clerk was requested to write both firm, asking them to dis- continue this practice.
The Playor reported a telephone call from Mr. Beuthel of the Division of Highways regarding a water service they were installing to flush out the Chestnut Street underpass, asking that they be advised immediately whether the City wished to have a meter installed or sinply direct con- nections, The matter was referred .to Col, Hagen to take up witQ the Water Company and ascertain whether they would make a flat rate, or what could be worked out.
Cmn. Chase stnted that he had been approached by several individuals requesting tb-t the Council mke some arrangement for sp9ayIng for flies: as was done seveml years ago by the County Health Departraent. City Clerk Hagen was asked to consult the County Health .Department for inform- ation as to cost, etc.
Second reading was made of proposed Ordiyance 7018, changing name of U, S, Highway XI-SD-2-Cbd to CARLSBAD BOULEVARD, upon relinquishment to the City of Carlsbad, Cmn. Castorena moved the adoption of Ordinance 7.018 as read. Seconded by Cmn, Ede. Five ayes, no nays, non absent, Ordinance adopted.
The Mayor suggested that for the information of the utilities compan- ies, and also the Division of Highways as they may want to post -it, they should be notified of the cbnge of name.
Proposed Ordinance &029 was summarized, chkging zone of a, portion of Tract 256, Thum Lmds, and a portion of Lot J, Rgncho Agua Hedionda. Cmn. Ede moved that first reading of proposed Ordinance #YO29 be waived, Seconded by Cmn. Chase, A11 ayes, motion carried-.
City Clerk Hagen read Resolution #74 authorizing County of Sah Diego' to enforce County Ordinmce within the City of Carlsbad. Cm. Ede moved the adoption of Resolution $74. Seconded by Cmn. Castorena. Five ayes, no nays, none absent, Resolutfon adopted,

on the fire truck, was read. Cmn. Castorena explained that the specifi- cations called for a 200-HP GIqC tmck, 500-gallon capacity, punp'Lag ;lo00 gallons per mimte, and described other details. Cmn. Fire Chief Hardin and Fire Captain Jerry Standish displayed the new Fire Department dress unfforms of charcoal orlon material, and. were complimented by the IJIayor and Council on the 'appearance and fit of the . uniform and the fact that they were purchased from funds raisea by the Department
After a 15-minute recess, Mayor McClellan reconvened the Council at 9:25 P, PI.
The City Clerk reported that Joe I'lcCarthy of Everts & Esenoff had stated that the audit reports were not yet ready but would be in a day or two and he would send over a d-ozen copie s.

The City Clerk reported that Niss Ruby Sawyer from the State Con- - troller's office in Sacrarnento would arrive in San Diego Thursday morn- ing by plane, to assist with making out the State reports; and that he would meet her iy1 San Diego,
In discussion on the tax rate, it was brought out that the mayors of other cities in the county feel that Carlsbad is very conservative in setting such a low rate, and it is a matter of some anazement to them,
v Cmn. Chase reported that he had spoken to City Attorney Smith about framing a contract between the City and Joe Apodaca covering constructior: a.nd repair work on the streets on a rate basis, and hoped to have it ready for the next Council meeting. He stated that work is p-regressing satisfactorily on street patching and gutter cleaning, and he had spoken to Mr. Apodaca to see what could be done about renting some of the larg- er equipment, Cmn. Chase also stated that he would like to propose a conference between the Gallinger Corporation, Briggs, a Council member and one of the affected property owners to see what could be worked out on the d-rainage problem on Park Drive resulting from development of the subdivisions above, and felt that such a conference should be held be- fore the rainy season begins, commenting that he unde-rstood considerable feeling was developing among the property owners against anything that will be an expense to them, It was suggested that a plan of resurfacing or original surfacing be worked out so that when a group of owners wish to get together and put up the cash, we wil-l have something definite to offer them.
Crnn, Chase also reported attending the Planning Commission meeting and suggesting that the possibility be checked of having the State Col- lege class making a planning study of the City include a master drainage plan. The old drainage probzems at Lincoln and Oak, and Hadison and
Grand, were brought up, Cmn, Chase reported that both Leo Williams and. Dofl Hubbard had been asked for another bid on the sump, which, though':
I not a permanent solution, would take care of the problem for sometime to

Mr. Barter stated that it was planned to have the contractor who re- pairs Magnolia Street for the Water Company bid on the portion the City must repair. 3
Cmn, Castorena was asked about the possibilities of formulating a co-operative plan for .installing fire hydrants, whereby the CAty would furnish 50% of the cost if the citizens will pay the rest of the,money, He stated that the Department is work3ng on a. plan to have committees of firemen -appointed to go from house to house, asking questions and making suggestions as -they go along in regard to types of fire extin- guishers, etc., and. then to make follow-up calls to see whether their suggestions have been followed, etc, He stated the -Fire Chief feels that the citizens will be willing to enter -il?to a co-operative agreement .to pay one-fourth or perhaps one-half the cost of fire hydrants, and that this could be determined in their canvass of the City, It,was .suggested that the plan be also extended to the business area if the merchants would co-operate. City Clerk Iiagen stated that $3300.00 is available for this purpose, and that five hydrants on State Street, costing $l5OO,OO, had. already been arranged for, City Attorney Smith suggested that the whole matter be set up on a more detailed plan, as a co-operatLve agreement, with the Fire Chief selecting the areas, and the entire $3300.00 ear-marked for this purpose, .on a 50% matching basis or whatever percentage is d.ecided upon. It was agreed that a report be prepared and- submitted at the next meeting, October 6th.
Mayor IkIcCleLlan commended City Attorney Smith on the successful conclusion of the Williams Vs. McClellan et a1 litigation, pointing out also that the expense to the City was in his opinion nominal, and asked whether the Council wishH, to express its appreciation. Cmn. Sutton moved that the Council go on record as expressing its apprecia- tion to City Attorney Bruce Smith for the able manner in which he has

City Attorney Smith reported that the Patterson suit against the City has again been postponed, to September 30th.
BuildSutg bspector Ewald brought to the attention of the Counoil the matter of the proposed sewer line up Chestnut Avenue, pointbg out that the Gallinger Corporaticm have offered to put up $6000.00 toward its oonstructlorz, and that the sewer ccmtractor would like to ut a bid on it but cannot until the engineering has been done, which wfl1 ooat

It was pouted .out that when the high school Is constructed on Chestnut a few years hence; sewers will be a necessity. .(. Can, Castorena moved that the City Attorney be instructed to join with the Sanitary Board Attorney for the purpose of seouring a Court order on future prooeedings between the 'City Council and the Sanitary Board; and that he also acquaint the associate oounsel in Los hgeles with the urgency of the situation in an effort to expeditL %he Patter- son case. Seconded by Cmn. Sutton. All ayes, motion 08rried.
City Clerk Hagen read proposed Resolution #77 approving Region 10 Operational Plan A, dated .July 28, 1953, Cm, Castorena moved the .adoption of proposed Besolution No. 77 a8 read. Seconded by Cm, Chase. Four ayes, no nays, Cm. Eae absent. Resolution adopted. Hr. Barter submitted a profile of .a proposed drainage line on Bass- wood Avenue, which he explained in detail, stating it would cost ap- proximately $875.00. He stated that the bid was seoured from Leo Wil- liams, and it was suggested that he secure bids from Don Hubbard and Bilioh a~ the job. Cm. Chase commented that it was yery neoessary that this work be done, and moved that the Public Works Director be authorized to go ahead with the drainage line whfoh he recornended be bstalled on Basswood Avenue. Seconded by Cmn. Castorena, All ayes, motion carried.
. Mr. Barter reported that Hrs. Nicholson had called him .about grad- ing and surfacing lCuttle Street , stat- that Mr. Richardson, resident engineer for the Division of Highwa 8, had stated that the State would run gutters -and grade the street (3 5: 0 feet) and that the blacktop con- tractor would give the Cit the same price as the State gets, the ea- tire est,imated oost to be ii 635.00, Ius a $65.00 .contingency, of which Mrs. Nicholson agreed to pay i 200.00, kyor HcClellan commented that if this is done, there will be similar requests elsewhere, whiah would have to be done in equity; that he did not see how this could be done unless some sort of a co-operative plan is established, ,It was suggested that, pending a study, the City match the cost on a 50% basis. Cmn. .Chase moved that we offer to match .SO$ of the cost of the paving on Tuttle Street, and specify that this will apply to only Tuttle Street; the cash to be deposited by the owner with the City Treasurer prior to authorization of the work. Seconded by Cm, Sutton. All ayes, motion carried.
