The City 'Attorney was asked to be .prepared to present an ordinance which would 'raise the sales tax in tlje City of Carlsbad to 1%, upon receipt of copy of the bill as fin- ally adopted. Letter from the County .of San Diego Public Hea1ht;h Department dated Xay 18th, advising that the gnat control prograin is complet- ed and treatment was 90% effective, and recommending that-for best results, if the same program is desired next year, negotiations -should be commenced earlier. ,. Letter from Dr. H. A. .3aughman dated May 24th, commending' the City Council and City officials, with specia1,praise for A%. An- thony for his >courteous and efficient services during the build. ing of their home. Mr. Anthony was commended by the Council. . Letter from- Brilhart Musical Instrument Corporation withdraw- ing their application for .M-1 zoning of a portion of the Horace Kelly land which they were proposing to purchase for industrial purposes; also pledging t.heir co-operation in the City's efforts to properly zone the unzoned lands. Copy of letter from the County of San Diego Boundary Commis- sion to Glenn R. Feist regarding exclusion of the Keith Tract ' ' from Carlsbad and annexation'of same to the City of Oceanside. The map accompanying the letter was studied and the feeling ex- pressed that .too much area was included in the proposed exclusion; .that it would seem illogical .to relinquish land of assessed valu- ation such as the portiou of the Atchison, Topeka f9 Santa Fe Railway Company right-of-way; but that property which may be .built upon and require utility services should be relinquished. The Clerk was instructed to write a memorandum to the Planning Commis- sion requesting that they and the Public Works Director carefully study the map and make a recommendation at an early date a8 to what property they felt should, be .included in the.relinquishmant. Letter from R, Dt NeIson, 1.55 'Juniper Street, dated' June ,7th, calling.attention to the condition' of' the beach from' Acacia Street south, due to the deposits from the Gas Company's-dredging opera- tions, and suggesting that the Gas Company be contacted and asked to restore the beach to its former condition, Mr. Anthony stated that it would bequire a tremendous operation to-bull-doze out the thousands of yards of adobe muck, but that it might gradually erode. City Clerk Ewald stated that he had talked with Mr. Coor-Bender of the State Parks Commission, who stated they would refuse the San Diego Gas &.Electric .Company the right to deposit anything further on the State Park Beach; that .he had also talked with Mr, Kenyon of the Division of Beaches and Parks and they are aware of the sibuation and are going ahead with their plans to put a life guard and ranger station on the beach..and keep it clean this summer . Cam. McClellan commented that it might be better policy to follow through on the effort to secure right of access over the San.Diego Gas 6 Electric Company property to the State Beach, more or less as a substitute for this stretch of beach. The City Manager wqs asked to-address a letter to both State agencies explaining and stressing the urgency of the situation and the need for life guard service at the State Park beach, Mrs. Christiansen of the Parks, Recreation, Beach and Tree Com- 1 mission stated that Mr. Kenyon had met with them and outlined atheir I , plans to hire two men, one a #2 Ranger who is an experienced man; 1 also that within 24 hours they could transfer accreted lands from I the State Lands to the State Parks Commission. .. Letter from the Parks, Recr,e,ation, Beach and Tree Gommission -.dated June 5th requesting readjustment of budgeeed funds to accumu- late $1240.77 in the Park Development fund. . Cmn. Ede brought up the matter of audi$ing .of .the books,'and Mr. Nelson stated that the auditors will be over Thursday and will get everything posted up to- date; and that he. would recommend that any transfer of funds within Departments be held over-until the beginning of the next fiscal ., year, Mrs. Christiansen stated her Commission feels that now is the most advantageous time -for planking, etc. 9 and if .the work could be commenced now we wilE have a presentable park by the end of the -;- year e .. 07 The proposed joint meeting between the Planning Commission, the Parks, Commission and the Library Commission, to discuss best poss- ible uses of Holiday Park and also explore possibilities of locat- ing the'library on property adjacent to the municipal building site, was discussed. Mrs. Christiansen stated that she did not .believe ' the Parks Commission had been directly approached on this proposal,. Commissioner Swirsky of the Planning Commission stated he believed .the .other Commissions had been invited to meet with the Planning Commission .at their next meeting on .June 13th, ' It was decided that authority for paying the. bill for the work already done should. be granted, and Cmn. McClellan moved the author- ization for transfer of $188.51 within.the Park budget from itens - . in which they have a surplus to items in which they have a deficit; and that the, City Manager be directed to authorize such additional expenditures as he feels are necessany, and for which cash is avail- able within the,Parks budget. Seconded by Cmn. Sutton. All ayes, no nays, motion carried. 1. Civil Defense Director Whipple reported that 511 children had re- ceived the "dog tags"; that he is negotiating with the Advent Chris= Academy as a storage depot for hospital supplies and facilities for a 200-bdg hospital${ that Carlsbad has.been selected for a 200-bed hospital; 'and that there are approximately 300 volunteers signed up in the local Civil Defense. program, Mr. Whipple was congratulated by the Council for the excellent organizational job he has done on Civil Defense. I ' tian ,Conference for the build,ing' just north. of the Army. & Navy 3b.. Paul Swirbky stated that the next conference with Mr. Kalicka of Gor'don !thitnall @ Associates will: be at the' Planning Commission , meeting on June 27th, at which there will be further discussion on the proposed new zoning ordinance; and he invited all Council members to attend. . . .. 1,. $2' .. .. Mr. Anthony reported that sewer constructioo in the Carlsbad Estates will be completed by Wednesday evening; and that somirof the property owners-on Alder Avenue had raised $1500.00 toward extension of the line LOO0 feet further, to serve'their proper- ties, asxi that be feat it could be done at this time more econom- ically than later, He stated the contractoas,. ..-Schafer e Stowers, balance of,$25Q0.00 as collections'come in ffom connections, with the stipulation that' they are to be paid out of the first collec- tions. He recommended stroirgly that the City accept this proposi- tion and-put up the necessary $1110,60 to,make up the difference, due to the very bad conditions in. the area at this time (effluent standing on lawns in. some instances) and the decision of the- De- partment of Public Health that'no additional building will be per- mitted in the area except' where public sewer connection can be made, The City Attorney explained the contractor's proposition to await payment of the'last half of their money, subject to a refunding contract whereby-they would be paid out of first IAne cost payments. Can. McClellan pointed out that the cost of $2.50 per front foot as compared with approximately $5.70 for 1911 Act construction would indicate an advantageous deal, and suggested that the City make an offer of a lower contribution with the pro- posal that property-owners benefitting raise an additional amourit. Cmn, Sutton expressed opposition to the City advancing money to benefit two or three omers and named other critical cases which should be relieved by sewer connection if at all possible; and there was considerable discussion as to the most practical plan to be followed in order to clear up as many serious cases as poss- ible. Cmn, McClellan moved that the Council authorize the ex- penditure up to $800.00 of City funds, on an advance or reimburse- ment basis, towards the construction of a sewer line from Park Drive and Monroe, along Monroe to Alder, and along Alder to a point 414 feet to a manhole; provided the remainder of the cost can be met by voluntary individual dash payments and an agreement on the part of the contractor to accept payment of the remainder of.the necessary cost on a reimbursement contract. Cmn. Sutton asked whether the Freeway .could be posted with "No Parking'' signs to discourage motorists from creating a traffic . hazard by parking on the Freeway to watch water activities on the lagoon. The City Attorney stated that the law does not permit parking of any vehicle on the Freeway, except it be disabled, and the City Police Department can enforce this law, but no posting I can be done except by the Division of Highways.. The City Manager and Chief of Police were asked to confer and frante a letter to the Highway Commission requesting that the area be posted, The City Attorney reported that he was optimistic that the condemnation proceeding8 on the site for the disposal plant will not qome to trial; that it appears an agreement will be reached .out of Court. He reported that the exchane of property with the N~yn~s Club is not dompleted, as the description of the property ..tp be transferred by the City is very caraplicated and is not yet ready. He reported that on the sale of the sewer bonds,, he had taken the matter up with Warren Beebe of Los Angeles and expects..: vv ..... .. .. to' see him this week and get the entire proceedings' for sale' of .the bonds lined Up. Seconded by Cmn, Sutton. . All ayes, Ordifiance adopted. Proposed Ordinance #9042, establishing zoning of unzoned areas in the City of Carlsbad, was read. It was decided that a more definite boundary should be fixed on the north, rather than desig- nating the north shore of the Agua Hedionda lagoon as the northern boundary of the new zoning. After some discussion, Cmn. McClellan moved the adoption of Ordinance #9042 aa an urgency ordinance, with the change in description from Agua Hedionda lagoon to the soutberly boundary of the land classified as R-A in Ordinance #90O&, and with the addition of the ,description .of the land lying easterly of the Atchieon, Topeka & Santa Fe Railway5 and that the condition- al uIse permit mentioned in Section #1 extend to the southern boun- dary of Palisades kr2, westerly of- the-Santa Fe right-of-way; and the exclusion in Section #2 of the area described in Section #4. Seconded by Cmn. Helton. All ayea, Ordinance adopted. -. City Clerk Ewald presented the bill from Schafer c1 Stowers for $17,279.60 as partial payment on the sewer contract, and stated that arrangements had been made to pick up the check for $11,500.00 fraa the Carlsbad Union School District, to apply on the contract. Can. Sutton moved the approval for payment of the bill presented by Schafer & Stouers, to May 31st, of $17,279.60, subject to funds be- ing available, indicated to be on hand asr of tomorrow. Seconded by Cmn, Helton, All ayes, motion carried. Cmn. McClellan reminded the Council of the application to be made by Byrl Phelpe for Chap- ~ ter #47 funds for engineering, stating he felt a copy of the appli- cation should be in the City files. City Manager Nelson stated that he had checked with Mr. Phelps' office regarding other .appli- . cations but was not aware of this; and atated he would check with Mr* Phelpe immediately on the application in question. I Mayor Ede commented that at the last League of Cities! meeting - it was announced that Mr. Beuthel, Assistant Engineer for District XI of the Division of Highways, is retiring, and that Ernie Taylor presented a motion c-ormnending Mr. Beuthel for his excellent work; and that Mrr Beuthal had told Mayor Ede that even though retiring, sonally very much interested in, it. . he will come up and work on the Elm Avenue pro Sect as he is per- Cm. McClellan stated that one time he was talking to.Mr. Webb, 'chief of the Right-of-way Department of the Division of Highway8 in this District, and he. had indicated that the State would be interested in a proposal. from .the -City to acquire all those parcels of surpfus properties.on which they have been un- able to negotiate individual sales. He stated .the City might be able to negotiate-their purchase at 8 substantially lower price than to individual buyers, and might be able to uea them as road- I sick $arRs, etcrf .emno .PIcClellan was asked to call at .the Division i of Highways' office and see what could be accomplished. City Manager Nelson asked that the Council set the amount of bond for which he is to apply, as required by the ordinance. 'He sug- gested that a $5000.00 would be sufficient, at a premium of $5.00 per thousand, to be ..paid by -the .City. 3 Gmn. Castorena moved that the City Manager be instructed to .apply for a surety bond of $5000.00 for one year. Seconded .by Cmn. Sutton. All ayes, motion carried. -. City Manager Nelson stated that he and Mr. Anthony had been studying the possibility of taking over the Public Works maintenance during the.next fiscal year as a regular function of the .City, rather than on a contract basis as at present. He stated he had talked to the present contractor, who seems to -be agreeabse to the thought that he and his men become City eaployecs. The City Manager also stated he felt the City should not open up the. City ,insurance business on a competitive basis, ,but should wiJ1 bet ,proposals 'out to various companies of established respon- sibility .on the policies expiring on June' 30th, stating specifically' what is desired, and see what type of program they can offer. .He recommended an increase in liability insurance from $lOO,OOO.OO/ $300,000.00 to $150,000.00/$400,000.00, and increasing the'autoiao- bile insurance substantially. .The Council agreed that. his sugges- tions are along sound lines and authorized .him to proceed as out- lined. , deal with only responsible firms; that if the Council agrees, he Yi. Nelson suggested that the Council- give some thought to the preservation of items of memorabilia from the early days of the City's operation, for their eventual historical value. The. sugges- tion was received enthusiastically by the Council. Mayor Ede reported that Mr. Fennel had represented the City of Carlsbad at the hearing on Air Pollution Control, and at that time the Board of Supervisors voted 3-2 to activate the County-wide dis- trict (Supervisors Howell and Bird voting against it). He stated that the City Council of the City of San Diegs had gone on record as fayoring the proposal. City At.torney Smith reported that'the hearing on the electric rate increase was again.postponed to June 14th. Police Chief Palkowski: announced the bicycle rodeo to be held at the Fine Avenue School on Saturday, the Ilth, from 9:OO A* M* to noon8 as a joint effort -between the Police, Department and the school, children from 5 to 15 being iligibbe.
