Ede. Present besides the Hayor were Councilmen Sutton, Castorena., and Robinson, City Manager Nelson, City Clerk Ewald. Absent Cmn. Helton. *I Can. Castorena moved the adoption of the minutes of the October 4th meeting. Seconded by Cmn. Robinson. All ayes. Motion carried. Correspondence read by the City Clerk as follows: L (1) ' Letter from Better.Business Bureau enclosing an amendment to I the ordinance on '*dutch auctionsfg adopted by the City of San Diego, Or- dinance was refe'rred to the City Attorney for review and recommendation with a report to be made at the next Council meeting, (2 ) btter from Carlsbad Chamber of Commerce, dated October 13, 1955, recommending planting of the planter boxes at either end of the community parking lot, installation of Stop Signs at designated points, and calling atten-tion to the fact that several of the Palm Trees along Elm Avenue, between State and Grand, are a po-tential fire bzard '.3 City Manager Nelson reported that several of the Stop Signs Listed -4 have already been installed and the other locations will be surveyed by 13 the Chief of Police and Director of Public 'dorks and installations made 5 if deemed necessary. The problem of the trimmlng pf the Palm Trees 2 will be referred to the Fire Chief and. the Park and Becreation Commission for action. Cmn. Sutton offered a motion that the Council request the Park and Becreation Commission to investigate likely trees whfch might be planted to try to restore the natural beauty of Eln Avenue. Seconded by Cm. Castorena. A11 ayes. Motion carried. It was pointed out in discussion that the City has no plans for- sidewalks but there is a pos- sibility the ,owners of the area might decide to form an improvement district in the future, and such installations-would have to be con- sidered relative to the planting of trees in the area. I (3) Copy of letter dated October 11th from County Boundary Com- mission, addressed to &nest A. Taylor; approval of description of the boundaries of the proposed Vista May md 101 Interchange Annexation to the City of Oceanside and Withdrawal from the City of Carlsbad. Zity Attorney Smith stated the City can take no action untii the receipt of a request for resolution of exolusion and sucrh request should originate from the City of Oceanside as all negotiations have been in- itiated by that City, (4) Letter from County Assessor's Office, containing notice of San Diego County Assessor's Advisory Committee meeting to be held on Novem- ber 16th. City Clerk Ewald glans to attend and asked that any problems on assessments be brought to his attention befope that date so they may be discussed at the meeting. (5) Financial report for fiscal year, 1954-55, as prepared by the firm of Everts and Esenoff . Report was submitted to members of the Council for study and discussion will be deferred until the next meeting. Mayor Ede expressed the counci1's appreciation to the firm of Everts and Esenoff for their assistance to the City in this capacity. I City Clerk Ewald-announced the League of California Cities will meet in National City on October 14, 1955. City Yanager Nelson, 14ayor Ede and City Attorney Smith plan to attend. It was announced the Soroptimists Club of Oceanside plan to hzve a Ittree plantfng" program on October 24th in honor of Unftea lations Day. The Club has requested that the City designate a plot for the planting of the tree and City Phager Nelson reported the selection Of the Plot has been referred-to the Park and Becreatlon Commission. In order to allow ample -time. for receiving of the monthly bills for payment, by common consent the Council decided-the meeting scheduled for November 1st should be adjourned by the City Clerk to November 8th. The meeting scheduled for November 15th will be adjourned to November 22nd,, at which time the bids for the sewage treatment plant will be opened and processed. City Xanager Iqelson reported that distribution of the sewage treat- ment plant Plans is progressing satisfactorily and Mr. Byrl Phelps has requested a number of additional sets to be dispensed through his office, I-IARBOIi COMIUSSION: City Clerk Ewald reported to the Council on .a meeting of the California Marine Parks and Harbor Association and Rufus Putnam, Executive Officer of the State Lands Commission held on .October 14th which he attended as a Director of the Association. The question of vasious harbor sites, along the coast of California, was discussed under the provisions of Bill NO. 2939 which was passed in the last session of the Legislature. Sec. No. 6476 of that bill provides that master plans shorn be prepared by counties, reviewed by the State Lands Commission and approved by the Legislature before the State could participate in the construction of these small boat harbors. The City Clerk also at- tended a meeting with Mr. Miller, County Planning Director, and members of the San Diego County Harbor Department, relative to the drafting of such a master plan and it was the decision of the members present that the best way to proceed was to ask the County Board of Supervisors to contact the County Planning Commission to prepare such a master p1.m and have all committees assisting in it as much as possible, After discussion of this report by the City Clerk, members of the Council expressed the opinion that perhaps the recommendation would be more favorably accepted and the City would not be involved in political conflict, if the City Clerk were instructed to contact the Planing Com- mission and Harbor Commission and, upon receipt of their suggestions, he then confer with Pir. Dean Howell of the Board of Supervisors on the matter. City Nanager Kelson reported that a communication has been reoeived from the City of Fontana clarifying the information which the City had received that ItChristmas Tree Fundsft had been alloted to the City of Carlsbad by the City of Fontana; The letter stated that, at one. time, they had split their allotment with the City of Campbell but no funds are available at this time. There has been a report from residents, of the area south of Gar- field Street, that pipe had been left at the lagoon after the completion of dredging, The City Manager had contacted the San Diego Gas and Elec- tric Company Construction Engineer and it will be removed. Can. Robinson offered a suggestion that the Council give considera- tion to the requiring of macadam or asphaltic surfacing In place of the cold road mix which is presently required in the subdivision ordinance. He pointed out that the difference in price is negligible. and the dlf- in the completed paving is tremendous and, in the use of cold road mix,. the City is accepting a constant maintenance program. By common con- sent the Council instructed the City "ianager to refer the matter to the Planning Commission and Department of Public Works. City Planager Nelson reviewed the subject of the Lewis Chase Build- ing permit which had been presented to the Planning Commission, He ex- plained that, after the permit had been issued and complaints were re- ceived, it was ascertained it was not a proper building in a C-1 zone. Mr. Chase was then contacted and gave up the permit readily, realizing he had made a mistake. After conferring with the Attorney, it was our recommendation that the use of the building was not allowed. The owner then asked that-he not be required to abandon the building and requested a perrnit for an office building for a C-l zone, Mr. Itelson explained that, while there was a certain amount of avoidance of the law, the City was not in a position to prejudge the law. Residents of the area were not satisfied with the results-and it had been recommended that they could appear before the City Council. Since that time, City officials have been alerted by residents of the area and a communication has been sent to Nr. Chase informing him of what he can do and what he can't do. venti moved Four Second reading was given Ordinance No. 2020, adopting a Fire be- .on Code of the National Boar& of Fire Underwriters. Cmn. Second reading was given Ordinance No. 1026, amending Ordinbnce No. 1025, changing the title of- the Park, Recreation, Beach and Tree Com- mission to’ park and kecreati-on Commission, Cnn, Castorena moved. the adoption of Ordinance No. 2026, Seconded by Ck. Sutton. Four Ayes: Sutton, Robinson, Ede, Castorena. No. Noes. Absent: Helton. , Ordinance adopted. City Attorney Smith reported he is inthe process of preparing the proposal for purchase of the Mutual Water Company and is attempting to arrive at a solution to guarantee the North Carlsbadmea- a water supply. Mr. Smith advised the Council that b. William Do Cannon has asked him to represent him in the formation of a County Water %strict. He emphasized that, in accepting this assignment, he does not wish to con- tinue if there are any conflicting views of the City Council, He earnestly requested that any objections be voiced as he does not wish to embarrass himself either professionally or personally. Members of the Counoil expressed their confidence in the City Attorney and it was their general feeling that he would take no course of action which would place hfm in a position in which he would have to be compromised. If any con- flicts should develop, during the negotiations for such a district,-they will be brought out publicly to the attention of the Council and a de- cision will be- made at that time. Discussion was held on the formation of a County Water Distriot and members of the Council expressed the opinion that the MunicLpaX Water District should proceed with caution and the matter should be given careful study. Cmn. Robinson offered the suggestion that the members of the Council avail themselves of the trips to study the proposed pipe-line routes. City Manager Nelson reported on the State Enployees Retirement hrjd and presented the Actuaries &port which was requested by the Councj.1 lasl April. Charges to the City for such a program for the Police and Pire Departments will be approxniately $3OO.OO per year for each employee or $2jO0000 per year. He stated he had discussed it; with the Chief of Police and he is very much in favor of such a plan and reoommended it be put’ intc effeot after January I, 1956 at which time employees of the Department receive 8 regular pay increase and the cost to the employee would be ab- sorbed by this pay increase. It was the decision of the Council that the retirement plan should be initiated for the Police and Fire Departments and, at a later date, Social Security Benefits could be arranged for other employees of the City. By common consent, the Council instructed the City Manager to complete the form for the State Employees detirement Fund and forward it to the agency. City Iqenager Nelson reported that Mr. Potter has agreed to go ahead with tentat’ive plans for the Olive Drive Sewer with the present sub- division; 3h0, &. Yourell has purchased a tract on Pi0 Pic0 Blvd. which will be included in the sewer colleotions. Original estimate on‘ the pro- ject was $12,000.00 but, after conducting a preliminary survey, Mr. Byrl helps Ms advised that the cost of such a line would be approxmiately $p15,895.00. Mr. Thelps feels some good bids might be received and 8.1~0 the City will re-double its efforts to get more signatures c?@ the peti- tions-. It was pointed’out that, If the bids are too high, the City would not be obligated to go ahead with the construction of the sewer. By common consent the Cd.uncil instructed the City Attorney to proceed with the Invitation for Bids on the Olive Drive sewer line with advertising to continue for a period of two weeks with bids .to be opened and processed at the November 8th meeting. of Highways stating that $2,000.00 from the Oas.Tax konds have been allocated to the City of Carlsbad with the sti ulation that the funds must; be expended -for engineering on street def P ciencies , with a budget listing proposed expenditures, to be submitted prior to the release Of such funds, Possible expenditures discussed were: Parttime services of a City Engineer, preparation of plans for streets, ariel survey for master plan, It was pointed out in discussion that, if the Council SO w3shesy the funds could be accuinulated. to be emended at a futAwe date . City PIdnager Nelson announced receipt of a letter from the Division for a. major improvement, The City Il'ianager and Director of Public Works were instructed to study all possible expenditures and report back to the Council their recommendations. Can. Sutton moved approval of the payment of the bills for the period October 4th to 18th, in the amount of $3,831.19, as certified by the City Clerk and approved by the Auditing Committee. Seconded by Cmn. Castorena. All ayes. Motion carried. Cmn. Xobinson moved rat-ification of' the payroll as of October 1.5 , 1955, as certified by the City Clerk and approved by the Auditing Com- mittee, Seconded by Cmn. Ca.storena. All ayes. Motion carried. Sutton was present after 7:2O P. PI. The Council immediately proceeded to the opening of the bids for the Olive Drive. Sewer seheduled for 7:OO P. iyI. City Clerk Ewald opened the sealed bids and announced the Contractor and each bid In quantity and amount in the order listed: Don Hubbard, L. Castillo and Russell Thibado, Vista, Walter H. Barbor, Dorco General Engineering and Construction, Oceansj.de, and Shaffer and Stower, San Diego, The bids were then turned over to the City Attorney for tabulation and approval of form. Cm. Castorena moved the approval of the minutes of the regular meeting of October 18th, as written, with indicated connection. seconded by Crnn'. Robinson . All ayes. Motion carried. Crnn, Robinson moved approval of the minutes of the regular meeting of November 1st. Seconded by Castorena. All ayes. Wotion carried. C2 City Clerk bald read the corpespondence as follows: (1) Letter from California. Safety Council addressed to the Mayor requesting he issue a proclamation desigmting December 1st as "Safe Driving Day." Cmn. Castorena moved the adoptlon of a resolution pro- claiming December 1st as "Safe Driving Day. n Seconded by Cm Robinson. All ayes. Motion carried. Nagor Ede announced that Chief of Police Palkowski, Safety Day Zhairman, has forwarded letters to all City organ- izations asking for their support and literature has been distributed through the schools. (2) Letter dated November 2, 1955 from Mr. Ben p. pugate-, United Nations Day Chairman, expressing:.appreciation for Xayor Ede's participa- tion in the United Nations Day ceremonies.
