Helton, Robinson and Ledgerwood; City Manager. Nelson, City Clerk Ewald, City Attorney Smith, Public Works Director Anthony, Police Chief Palkowski, and Fire Chief Hardin. Cmn. Helton moved the approval of the minutes of June 19, 1956, with two minor corrections. Seconded by Cmn. Ledgerwood. All ayes, motion carried, Cmn. Robinson moved approval of -the minutes of the adjourned meeting of June 25, 1956, ,with the insertion of the rate 'r14n for Firemen, and de- letion of "Step" letters after each rate, as agreed upon. Seconded by Cmn. Helton. All ayes, motion carried, IRITTEN CORRESPONDENCE. Letter from the San Diego County Boundary Commis- sion was read, :re: the intention of the City of Oceanside to annex.,cer- tain territory ,as delineated on an attached map. City Manager Nelson . outlined on the wall map the -area referred to 0- roughly about 300 acres lying southerly of Vista Way and northerly of the northtasterl-y bound- ary of the Car1,sbad Municipal Water District. Since no protest is con- templated, the letter was Piled without action. Letter from the San Diego County Farm Bureau, and reply by City Manager Nelson inviting the group to attend this meeting of the City Council for the purpose of discussing the proposed uniform sales tax ordinance, was read, Action was deferred, pending possible later arrival of Farm Bureau representtatives. PLANNING COMMISSION. City Manager Nelson announced that a meeting had been set up for July 9th at 3:OO P. M. .at the City Hall, to which rep- resentatives of the San Diego Gas b Electric Company had been invited to meet with the Planning.. Commission, Mr. Kalicka and Mr. Whitnall, City Attorney Smith innd himself, for the purpose of discussing the request of the Gas Compinny for creation of a U-zone to include their industrial property in South Carl &ad. All Councilmen were invited to attend the meeting, and the City Clerk was requested to remind the 'members by phone early Monday , .r Mr. Nelson reported that the second public hearing held by the Planning Commission, to discuss proposed zoning of the area east of the Freeway, was much better attended than the earlier one inviting discussion of the area west off the Freeway, with most of the protests centering around the proposal to reduce building sites from 30,000 square feet to 7,500 square feet in the east central area, and the proposed R-3 zon- ing of the areas adjacent to the new high school site. City Clerk Ewald suggested that regulations controlling the raising of chickens and farm animals under the new ordinance be thoroughly clarified by the Planning Commission before City Council hearings on the proposed zoning are scheduled. HARBOR COMMISSIQ. City Manager Nelson reported that the Commission has been working on rules and regulations concerning use of the harbor, but as yet have no concrete recommendations for the Council. City Attorney Smith reported t,hat Col. Dunne, chairman of the Commission, is meeting with Mr, Charles Forward, attorney for the Sain Diego Gas €3 Electric Corn- ' pany, to discuss; points of difference as regards the recreational lease -- mainly the termination clause which in its present form is unaccept- able to the Commission -- and that a revised draft of the lease will be prepared as soon as agreement can be reached. Regarding City liabiliky, rihder present conditions, City Attorney Smith stated that the only way the City could remain entirely' free of liability would be to require a signed release from every individual using the lagoon, each time he used it. PARKS &'RECREATION COMMISSION. Mr. Nelson asked the Council's feeling toward holding another WCity Picnic" at Holiday Park, celebrating tho fourth anniversary of incorporation, inviting the citizenry to bring their families to the Park on Sunday, July lSth, at 3 P. M. for a pro- gram and refreshments, with City Councilmen and officials as hosts. All expressed approval of the idea and Mr. Nelson was appointed chair- man in charge of arrangements. Mr. Nelson reported that the six picnic tables for the Park had arrived and the Junior Woman's Club had scheduled a party for 12:OO noon Wed- nesday, July 4th, to dedicate the Children's Playground. The Mayor suggested that all Council and administrative officials who were free at that time put in a brief appearance. LIBRARY COMMISSION. City Manager Nelson reported that the City Library would open on Monday, July 9th, as scheduled, and that Mrs. McLean has been hired as Library Aide for two hours per day. POLICE DEPARTMENT. LC$ 4% -e 2 I. I Mr. Nelson announced the addition of two additional patrolmen, John E. Bertics and Floyd Hollowell, and two full-time secretaries, Arlene Lgdnard and Natalie Vermilyea, to the Police Department. Robinson moved that the election of officers of tho Fire Department, held on June 25, 1956, be confirmed. Seconded by Cmn. Helton. All ayes, motion car- ried. Fire Chief Hardin reported that Floyd Hollowell had been transferred- fr'om the Fire Department to the Police Department; that William Hill had been hired as of July 1st and the two additional new men .will as- sume their duties on July 15th. He i'nvited members of the Council and other City' personnel to a picnic to be given by' the Fire Department at the lagoon (Pirate's Cove) on July 30th. PUBLIC WORKS DEPARTMENT. Mr. Anthony reported that Mr. Phelps had gone ' ofcr the disposal.plant and approved it; that the chlorinator men will be up shortly to move the chzorinator into the new building, and that they feel that within six months it will be necessary to .use very little, if any chlorine, in the sewage treatment. He reported that -the Department is still without a blade operator but that he is making every effort to find one. City Attorney Smith reviewed the case of A. L, Everette, operating a wrecking'and junk yard at 2653 Roosevelt (his residence) in violation of the zoning ordinance, emphasizing that Mr. ESverette had been noti- fied of the non-conforming'use by letter some months ago and giwn 10 days in which to abate it, and had flatly refused to do SO. He sug- gested that the Council authorize either civil or criminal action against Mr. Everette, recommending the latter as it involved less time and expense. After some discussion, Cmn. Robinson moved that Auda L. Everette be given written notice allowing him 10 days within which to cease his non-conforming operations, after which time the City Attorney is instructed .to take whatever action is necessary to enforce compli- ance, Seconded by,Cmn. Helton. All ayes, motion carried. Copies of an outline of important steps to be taken regard,ing harbor development, prepared by City Clerk Ewald, were passed to Council mem- bers. Mr. Ewald explained the ideas brought out, expanding on the outline somewhat, and there was a short discussion , Cmn. Robinson moved that letters and resolutions as proposed in the outline be pre- pared for the next meeting, for forwarding to State and United States elected representatives, urging that Carlsbad Harbor be given top pri- ority with the Corps of Engineers, U. S. Army. Seconded by Crnn. Baird. All ayes, motion carried, Nayor Castorena suggested that a letter be sent to Mr. Robert Watson expressing the City's appreciation for his servicd in constructing the public rest rooms at Holiday Park at minimum cost to the City. All members agreed. City Manager Nelson reported that James Montgomery Company has finished the extra work in connection with the Water Company appraisal, but have not had time to get a letter in, Hr. Nelson announced the meeting of the League of California Cities on Friday, July 20th, 7:15 P. M,, at the Fireside Inn in Escondido, at which the new City of Imperial Be'ach will be welcomed into the League, He stated that Dewey Mcclellan has been aske-d to give a short talk re- linquishing' Carlsbad position' as th'e youngest City in the County, and 1 also tell the nerdcomers something of the trials and tribulations of 9 new City. Proposed Ordinancce #3019, amending Ordinance '#3005 , Prohibiting Parking on Adams Street csast of the Glissman property On Saturdays, Sundays and holidays, was explained by Chief Palkowslti. He stated that the amendment had &come necessary due .to the growing traffic problem created by ex- panded use of tht? lagoon; that he had contacted Property Owners i.n tlk area who would be affected and they are agreeable to the restriction. cm. Robinson m<rved that reading of title and number constitute first reading of propo;sed Ordinancd #3019. Seconded by Cmn. LedgerWood. All ayes, motion carried. Proposed Ordinance #9051, amending Ordinance #9050, providing for the imposition of fees for checking improvsment plans, was briefly discussed. Nr. Nelson explained that the proposed or-dinance cures an omission in Ordinance #go50 ;and is necessary in order 'to bring the subdivision or- dinance up to its full intent,' 'Cmn. Robinson moved that reading of title and number constitute first reading of proposed Ordinance.#9051. Seconded .by Cmn. Helton. All ayes, motion carried. City Attorney Sm:ith quoted a League of California Cities' report that many people are failing to register their trailers. He suggested that a ' police check be made on the' situation, as one-third of such registration fees accrue to the City. Cmn. Robinson moved approval of payment of bills, amounting to $5,168.81, for the period June 19th to July 3rd, as certified by the City Clerk and approved by the Auditing Committee. Seconded by Cmn. Baird. All ayes, motion carried. Cmn. It was noted thatt no representative from the San Diego Farm Bureau ap- peared in response to the invitation to attend this meeting to discuss the uniform sales tax proposal. After a 15-minute recess, the Council reconvened for informal discussion of the 1956-57 budget. The tentative budget was discussed, department by department, but final action was deferred to a later meeting. The meeting was declared adjourned at ll:25 P. M. WRITTEN COMMUNICATIONS, The following communications were read: Letter from Mr. Roy Boyer of Personal Service Laundry, requesting that a change be made in the business license fee schedule affecting laundry trucks operating in Carlsbad. Cmn. Ledgerwood suggested Chat the City Manager answer Mr. Boyer's letter, advising him of plans to meet with Oceanside and Escondido City officials for the purpose of attempting to work out an equitable fee schedule during thepresent calendar year. Letter from Mr. John A. Hier, 1430 Forest, requesting refund of the un- used portion of a rezoning application fee, During discussion it was pointed out that the City had expended $3.38' for publication of one No- tice of Public Hearing. Cmn. Helton moved that the unused portion of the application fee be returned to Mr. Hier. Seconded by Cmn. Robinson. All ayes, motion carried.
