MINUTES OF ADJOURNED MEETING OF CARLSBAD CITY .COUNCIL August 16, 1956
Meeting called to order by Mayor Castorena at 8:05 P. M. Present besides
the Mayor were Councilmen Ledgerwood, Robinson, Helton, Bair'd; City Man-
ager Nelson, City Attorney Smith, Public Works Director Anthony, Police
Chief Palkowski, Fire Chief Hardin, Civil Defense Director Whipple..
Frank Chase, Superintendent of Oceanside-Carlsbad Union High School Dis-

trict, was present and presented a complete picture, using plans and esti-
mated figures, of the Carlsbad High School which is proposed to be opened
in September, 1957. He stated the District now holds title to 29 acres
of. the 38-acre site, bounded by Valley, Chestnut, Monroe, and Basswood, and will acquire the balance as fast as it becomes availqble and funds
for purchase are on hand, He stated construction is to begin in Septem-
ber or October of this year on five units, to accommodate 500 students
(expected enrollment in September, 1957, 400 students). The overall mas:
ter plan, includes all facilities, indoor and out, for 1200 students. He
outlined with thg aid of floor plans, the classroom, laboratory, cafeter-
ia, auditorium and field facilities to be built, including very modern
features throughout, Floor area, 52,000 square feet, at a total cost of
$1,084,000, to be built at this time.
Mr. Nelson read a letter from Mr. ,Millington, owner of the property ad-
joining the City Hall site on the north, accepting the City's offer of
$9500.00 net to him for the ,466 acre.parce1, including buildings. After
some discussion, Cmn, Robinson moved that -the City Manager be authorized
to sign the necessary escrow papers to consummate the transaction, at a
cost of approximately $9,600.00 including escrow fees. Seconded by Cmn.
Baird. All ayes, motion carried. There were some suggestions as to what
use the building could be put -0 including a temporary site for the li-
brary -- and Mr. Nelson stated he would have the Librarian inspect the building to see if it would be suitable.
Mr. Nelson reported that he .wrote to the Carlsbad Union Elementary School
District, advising them that Mr.Kalicka had recommended that the City
consider making a playground or park out of the property, and asking that
they delay sale proceedings until the matter could be studied further;
and that they replied that due to their long range plans, it would be
necessary for them to go ahead with the proceedings but that they would
be glad to meet with the City planning bodies if desired. Mr. Nelson was
asked to arrange a meeting between the School District, Councilmen, rep-
resentatives from the Planning Commission and Parks & Recreation Commis-
sion, and Mr. Kalicka if available.
Eddie and Alice Vasqu,ez, property owners at 2340 Ocean, adjoining the W.
D. Garrett lot on which a duplix-is under construction which does not
comply with the variance granted, were present and asked the Council to
take action to stop construction on the building until ordinance and var- iance requirements are met. Mr. Nelson stated.that on a previous com- plaint Mr. Garrett had been ordered to move the house back three feet and had done so, but had left the garage setting forward the three feet. The Planning Commission minutes of April loth, setting forth the Commission's recommendation to the Council, were read and considerable discussion cen= tered around the intent of the Commission in using the phrase '!any por- tion of the structure". Mr. Nelson stated that he, Mr . Ewald, Mr. Anth-
ony, and City Attorney Smith had taken measurements, determining that .the
front foundation of the house sets back 74 feet from the curb, in conform-
ity with the terms of the variance, but that the garage projects three feet closer to the curb. The Vasquea' argued that the builder was viola- ting the terms of the variance in not complying llsubstantiallyfq with the plot plan submitted, The City Attorney stated that the variance, once given, constitutes a vested property right and as such cou3.d not be re- voked, but that it could be conditionally amended.

Mr. Rood, adjoining property owner on the other-side, was also present ai stated that should the Garretts want to dispose of the lot, he would pay
them what the property had cost them,
Cmn. Baird moved that the variance granted to Mr. and Mrs. Garrett be COJ ditionally amended to provide as follows: that the-variance be granted as proposed, provided that no portion of the exterior foundation of the house shall come closer than seven (7) feet from the front property line that said amendment be granted only upon the condition that the Garretts move the garage towards the rear of the premises a distance of three (3)
feet so as to have the building conform to the exterior pattern of the floor plan:.as submitted in the application for building permit . Secondec by Cmn. .Robinson. All ayes, no nays,.motion carried,
A, H, Glissman, 4509 Adams Street, owner of Whitey's Boat Landing, was present to protest the closing of the harbor during the wee-end of Augusl 18-19 for boat races, and asked the support of the Council to keep the Harbor open. He was advised that since it is all private property and the City has signed no lease, the City has no control and ,any arrange- ments would necessarily have to be on a voluntary basis through agree- ment between the parties, He was assured that the Council will make no attempt to close the whole harbor at this time since it has no jurisdic-
tion, although a letter had been addressed to the Harbor Commission by
the Carlsbad Boat and Ski Club requesting a recommendation to that effecl

The Council again took up the budget discussion and general agreement was
reached on all figures, .but no action was taken.

August 21, 1956
Meeting called to order at 7:05 P. M. by Mayor Castorena., Present be-
sides the Mayor were Councilmen Robinson, Ledgerwood, Baird, Helton; City
Manager Nelson, City Attorney Smith, Public Works Director Anthony, Polic
Chief Palkowski, Civil Defense Director Whipple.
Cmn, Helton moved approval of the minutes of August 7th as corrected. Seconded by Cmn. Baird. All ayes, motion carried.
WRITTEN CORRESPONDENCE.
(1) Letter from the Carlsbad Chamber of Commerce requesting use of. the
City-owned Ford Station Wagon in the San Luis Rey Days Parade on Sunday,
September 2nd. The City Attorney was consulted and stated there was no
legal reason why the station wagon could not be loaned for this type of
activity. Cmn. Robinson moved the authorization of the use of the City-
owned Ford Station Wagon by the Carlsbad Chamber of Commerce in the .San Luis Rey Days Parade on Sunday, September 2nd, subject to the approval of
the Fire Chief. Seconded by Cmn. Ledgerwood. All ayes, motion carried.

Letter from Mrs. W. D, Garrett, Orange, California, stating that she
be present at the meeting to discuss the problem arising out of building operations on Lot 44, Granville Park,' in the 2300 block
Ocean Street. Mrs. Garrett was present and stated she was prepared: to
submit revised plans showing the eaves reduced so that no portion of the
building would protrude into the 7' setback .required by the terms of the
variance, She asked whether she would be safe in proceeding with the
construction according to the new pXans, and was advised to.have City
Building Inspector Ewald check the plans and act according to his advice.
(3) Letter from the State Employees' Retirement System enclosing form
of contract for the actuarial study ion miscellaneous employees of the
City (all employees other than police officers and firemen) at a cost to
the City of $113.50 , After a brief discussion, Cmn. Helton moved that
