carried.
Cmn. Robinson moved approval of the bills in the amount of $10,455.73,
covering'the period August 7th to Zlst, 1956, as certified by the City
Treasurer and a-pproved by the Auditing Committee. Seconded by Cmn.
Baird. All ayes, motion carried.
Cmn. Robinson moved ratification of the payroll of the first half of
August, 1956; 'seconded by Cmn. Baird;" all ayes, motion carried.
At 11~20 P. X., Cmn. Helton moved that the meeting be adjourned to
Tuesday, August 28th, at 7:OO f. M.

August 28, 1956
Meeting called to order by-Mayor Castorens at 7:OO P. M. Present be-
sides the Mayor were Councilmen Robinson, Baird,. Helton, City Manager Helson, City Attorney Smith, Absent, Councilman Ledgerwood.
Proposed Ordinance #1046, setting tax rate for the City of Carlsbad at 804 per $100.00 valuation, and City of Carlsbad Sewer District #2 at
.OO for the fiscal year 1956-57, was read in full. Cmn. Baird moved the
adoption of Ordinance #1046. Seconded by Cmn. Robinson. Four ayes, no
nays, Crnn. Ledgerwood absent. Ordinance adopted.
Kesolution #217 accepting thi dedication of easement and right-of-way
on Grand Avenue,+ was summarized by City Manager Nelson. The City At-
torney pointed out that although this acceptance is contrary to the
present policy, the matter has been in progress for about three years.
Cmn. Robinson moved adoption of Resolution 8217. Seconded by Cmn.'
Belton. Four ayes, no nays, Cmn. Ledgerwood absent. Resolution adopt-
ed.
Kayor Castorena stated that in order to obtain proper credit in the
survey being made by the Fire Underwriters' of the Pacific, it is neces-
sary that the Civil Defense fire truck be entirely paid off, which
would require reimbursement of the $5500.00 originagly paid by the
State of California. He emphasized that the item is not a bill in any
sense and the City is not obligated to pay it,, but unless the City be-
comes sole owner of the truck, full credit will not be allowed by the
Fire Underwriteps. City Manager Xelson stated the money was budgeted
last year in anticipation of such a possibility and funds for payment are on hand. Cmn. Baird uoved that the City Manager be authorized to
pay off the white truck, in the amount of $5,5OO,C?O. Seconded by Cmn.
Helton. All ayes, motion carried.
It was announced that second read.ing of the sales tax ordinance would be held in abeyance until Friday, pending action of the County Board of Supervisors.

PLANNING COMMISSION.
(1) Memorandu:m from the Planning Commission dated August 29th was read, recommenlding that the City Council establish a policj. of permit- ting no lot-splitting' on Highland Drive wh2ch would result in any lot ' having street .Frontage of less than 75 feet'. After discussion, Cmn. Helton moved tihat. the Pecommendation of the Planning Commission be ac-
cepted as the City's policy regarding lot-splitting on Highland Drive,
Seconded by Cmn. Ledgerwood. All ayes, motion carried.
(2) Memorandulm from the Planning Commission dated August 29th was
read, recommending granting to Roy Ellsworth and Pauline Drace a var-
iance. to permit reducti-on in street frontage on portions of Lots 4
and 5, Block E, Bella Vista, subject t.6 provisions as set forth there-
in. Also read was a letter of protest signed by C. D. McClellan,
pointing out tlhat the application does not adequately set forth a statement of need and justification, that adjoining resident owners strongly oppose granting of the variance, and that, although having a street frontage of 53.03 feet, the lot at that point is actually only 47 feet wide; ;3nd for these reasons urging that the matter be returned
to the Planning Commission for rehearing and furthef. study.
Chairman Swirslry of the Planning Commission was present and explained that the hearing on this application was adjourned to' permit members
.an opportunity to personnally visit the property and study the problem;
that Mr. Kaliclta, Planning Consultant, recommended granting'of the var-
iance because of the peculiar topographic condition; and that restric-
tions placed 011 the granting of the variance will insure aiainst'deval-
uation of the property itself or of adjoining lots, Mr. Nelson veri-
fied that the frontage figure of 53.03 feet checks with the dimension
shown on the County Assessor's map.4. Mr. Glenn Feist, attorney, spoke
in support of Mr. McClellan's protest, stating he believed ft would be wise to return thematter to the Planning Commission for rehearing and further clarification insofar as neighboring property'owners are con- cerned. Mrs. Sonneman'was asked whether- sh& felt a delay of two weeks or so would work a particular hardship on the applicant,"and replied
that the owner is rather anxious to have a decision on the matter so he
may plan accordingly .
After considerable discussion, Cmn. Helton moved that the application
of Roy Ellsworth and Paul Drace to permit reduction in street frontage
on property on Hillside Drive be referred back to the Planning Commis- sion for rehearing and further study, with the suggestion that the no- tice be published this week with hearing set for Tuesday, September 11th. Seconded by Cmn, Baird. All ayes, motion carried.
