The Council considered the claim of John H. Grant of Schnapps Shop for refund on 1956 business license by reason of his failure to segregate
liquor sales from gross sales in reporting income. After discussion,
Cmn. Baird moved that the overpayment of $20;.00 by Mr. Grant on his 1956
business license be refunded. Seconded by Cmn. Robinson, All ayes, mo-
tion carried.

DAMAGE CLAIM -. CROSTHWAITE: Mr. and Mrs. Angel Crosthwaite's claim
against the City for property damage at 245 Tamarack, resulting from water damage, was considered. The City Attorney stated that claims of
this nature must be submitted within sixty days of occurrence. Mr. Nel- son brought out the point that the City had no control over development of property across the street, The City Attorney recommended against ac- cepting liability for the claim and that same be referred to the City in- surance carrier, = Crnn. Baird moved that,the City Council reject the claim of Mr. and Mrs. Angel Crosthwaite, and that same be referred to the in-
) surance carrier. Seconded by Cmn. Helton. Four ayes, no nays, Cmn. Rob-
$ inson abstaining. Motion carried; > t Mr. Nelson reported that at the next Planning Commission meeting a rep- 1 resentation would be made recommending adoption of interim zoning of an ' area under consideration for a commercial shopping center, under which
the. City would have an opportunity of reviewing each structure as it "
comes up, The City Attorney was asked to study the StatesLaw and be
ready to discuss the proposition at the adjourned meeting.
The City Attorney asked for reaffirmation of the Council re: assessing
business license against outside real estate operators. By common con-
sent, the City Attorney was asked to check into the ordinance and .see if
this provision is adequately covered,
Mayor Castorena stated he had had a call from Mr. Lilley inviting City
officials to the dedication of the new County Building at 2:OO P. M.
Friday, May 24th.
Cmn. Baird moved authorization of payment of bills from May 2nd to 21st, in the amount of $3968.95, as certified by the City Hanager and approved
by the Auditing Committee. Seconded by Cmn. Robinson. All ayes, motion carried .
Cmn. I3aird moved ratification of the payroll for the first half of May in the amount of $6812.34, as certified by the Director of Finance and approved by the Auditing Committee. Seconded by Cmn. Robinson. All ayes, motion carried.
Cmn. Helton moved that the meeting be adjourned to Monday, May 27th, at 7:OO P. M, Seconded by Cmn. Baird. All ayes, meeting adjourned at 10:50

May 27, 1957
Meeting called to order art 7:04 P. M. by Mayor Castorena. Present.be-
sides the Mayor were Councilmen Helton, Rotbinson, Baird, Ledgerwood
(7210 P. M.); City Manager Nelson, City Attorney Smith, City Engineer
Kubota .
Considerable discussion of the amount of the inclusion fee to be,charged the "non-stocked" lands, and other related questions, was held for- one
hour and ten minutes. Mayor Castorena asked Cmn. Ba5rd to confer with
those persons who are opposed to the present policies of the City Council
No mot'ions were presented to the Council,
Project Stateme:nt No. 1,for Gas Tax Funds involving the improvement of
Chestnut Avenue between El Camino Real and Westhaven Drive, was discussed.
The City Manager was instructed to consult with Cmn. Helton on the mat- ter and proceed to process the statement.
City,Attorney Smith discussed the possibilities of urgency interim zon- ing as related to the possible shopping center. The City Attorney re-
marked that the letter of the law would allow the urgency-interim zon- ing 'as contemplated by Kay Kalicka.
The meeting was declared adjourned at 8230 P. M.

Meeting called to order at 7:OO P. M. by Mayor Castarena. Present be-

ten. Seconded by Cmn. Ledgerwood. All ayes, motion carried.

27th as written. Seconde'd by Cmn. Helton. All ayes, motion carried.
PLANNING COMMISS!. , Mr. Nelson road Resolution #16 of the Planning
Commission recommending adoption of urgency interim ordinance applying
C-2 zoning to the northeast corner of the City of Carlsbad, more parti-
cularly described as the area bounded on the north by Vista Way, on the
east by El Camin,o Real, on the west by the Hosp Tract, and on the south
by a parallel line approximately 1700 feet south of Vista Way, subject
to the following conditions:
(1) that within one year the applicant shall apply for a permanent
(2) that before there is any development in the area, a precise plan.
(3) that the applicant secure and file with the City written consent
zone change;
1 shall be submitted 'for approval by the City;
of the record owners of the property i,.n question.
City Attorney Smith explained a provision of State law allowing the adop- tion of interim urgency zoning without notice and hearing as an emerghncy
measure, where studies are under way or about to bk undertaken to deter-
mine the proper ultimate zoning for a particular area, thereby preserving the status quo for a specific use. He mentioned as being now in prog-
ress or soon to Ibe undertaken (1) study by the Highway Department re: traffic interchange at Vista Way and E1 Camino Real;' (2) Flood Control
studies of Buena Vista Creek; (3) sewe; studihs by Brown and Caidwell; and (4) Master Street Plan of the City of Carlsbad; all of which wili be
affected and influenced by the: type of land use applied to the area.
Mr. G. V. Eisenhower of Eisenhower Enterprises was introduced and out- lined plans of his organization to construct a major shopping facility at that location:, explaining factors determining selection of the site,
such as freeway access from all nearby communities, favorable climatic
conditions, availtability of a large enough parcel of land, and a proper
trowth pattern. Further discussion was postponed until later in the
meeting.
:20 P M. REARING - VACATION OF CHESTNUT AVENUE. Mr. Nelson read Notice
<f Intintion to \iacate Chestnut Avenue between Harding and Jefferson Streets, and the alley between Palm and Chestnut Avenues. No one appear-
ed in protest, and there were no written objections. Cmn. Helton-moved
the adoption of R.esolution #265 as read. Seconded by Cmn. Baird. 'Five
ayes, no nays, Resolution adopted.
