i MS. D. 8. DlZNIUS, was present and stated he owned i i property at 468 Tamarack Avenue. Se purchased this : ; property approximately two years ago from Lois Fry, an4 i was assured by Mrs. Fry there were no sewer assessmenp ; against the property. He has rented this property and has; i had considerable trouble with the cesspool this past year, 3 : and instructed the lessee to come into the City and apply ; I for a sewer connection. He received a letter from the : : City stating he would have to pay for the front foot cost of i : the sewer, which has never been paid, before he would be: : allowed to connect to the sewer line. I I
; Considerable time has been spent with the City trying to i i clarify this matter. The City records show the line costs: : were paid up to his property on both sides. Mr. Coe, whq i did the books for Mr. Fry stated he was sure it had been : : paid, however, Mr. Fry's books were destroyed after his! ! death. I
i The Council was informed that the records show 148. 35' i ! on the original property owned by the Frys was paid for : ; by cash, however, it does not indicate what portion of the i i original frontage this applied to. The original plat showed ; that 195' benefited by this cash sewer main installed in i i 1957. Presuming this 148. 35' was to be accredited to thii : 195', this would leave a balance of 47' not paid. Mr. I i Dinius is willing to pay the cost of the 47' at $4.00 a front! : foot. t
i It was also pointed out that Mr. Dinius's property purchask i ed from Mrs. Fry, with 92' of street frontage and requir-:
; ed area, has never been approved by the City of Carlsbad.; i Mrs. Fry furnished the Engineering Department with the i : plat some six months ago, showing that she had had it . ; I surveyed and mo.mrnented by Mr. Weeks, Licensed Sur- i ; vteyor. The City's re~cords show that it had not been ap- ; i proved and recorded by the City of Carlsbad. The Ehgin- i i eering Department found the monumentations of subjecx" i : lot and measured the westerly side yard and fo~nd.it to be i : 5-35', and the zoned area requires 9.2' side yard. The : i City notified Mr. Dinius by letter that this Would have to ! : be processed by a variance application through the plan- : i ning Commission. I
