I referred to his department at the last meeting, They had : studied this matter and do not feel it would be to the best i : interest of the City to vacate this portion of Palm Avenue : i for the following reasons: (1) In connection with the I I i improvement of Warding Street, they are contemplating a i : cul de sac in Palm Avenue; (2) Storm drainage pipes 24" ; 1 in diameter discharge into both sides of Palm Avenue at i : this point. In addition, the City operates and maintains ; i a water main across the freeway; and (3) The area in : i question is not sufficient in size or depth to become a : I' buildable lot; hence, the additional assessed valuation i : created would be insignificant. i Proposed annexation. Two maps were presented for the I ; Council's review of a proposed annexation, one map show: i ing a larger area than the other. This larger area would : : depend on the consent of one property owner, The City i ! Mr. Ecke feels : ! very strongly there should be an interchange or access i

She felt Mr. : Greek should be complimented on the manner in which ! i these bonds have been handled. I
I Mayor McPherson stated he would pass this information i i on to Mr. Greek.
I Kelly water problem. When the City purhcased the I. I ; -rnpany they purchased the rights as i I well as the obligations. One of the agreements was be- : : tween Mr. Cannon and the Halls. The City has taken ove4 i Mr. Cannon's interest and Mr. Carrol Kelly owns the : : Hall wells. The City Attorney reviewed a portion of the i i agreement for the Council. Mrs. Betts informed the : Council there is a misunderstanding as to the interpreta- : i tion. It is her position that under the agreement the Kellip : have the right to water 15 acres of land, and they should : i pay for 15 acre of water. It is Mr. Kelly's understanding: : that the 15 acres of water is free. There is now a golf cobrse i on this land.
i A meeting was held with Mr. Kelly and his attorney, to i ; see if an agreement could be reached. Mr. Kelly is of ; i the opinion there should be an annual minimum payment. i
I We is thinking in terms of $2,000 per year. This would : I mean 287 acre feet of water would be used per year. If i
I the water table is not sufficient then this would be cancel- : : led. Also if the water were not usable then it would be ; i cancelled. I I
i This water is not too good but could be used for agricultu*. : Assuming that there is a demand for this water this would: i be a wise investment. There would be a maintenance cost! i tut it is felt it would be less than $29.00 per acre foot : : which we are paying for Colorado River Water. 1 I
I If the City cannot use the water or sell it then the City will i have to look at this matter in a different light. The City i : staff is checking out certain factors so we can proceed. :
