The City has taken ove4 i Mr. Cannon's interest and Mr. Carrol Kelly owns the : : Hall wells. The City Attorney reviewed a portion of the i i agreement for the Council. Mrs. Betts informed the : Council there is a misunderstanding as to the interpreta- : i tion. It is her position that under the agreement the Kellip : have the right to water 15 acres of land, and they should : i pay for 15 acre of water. It is Mr. Kelly's understanding: : that the 15 acres of water is free. There is now a golf cobrse i on this land. i A meeting was held with Mr. Kelly and his attorney, to i ; see if an agreement could be reached. Mr. Kelly is of ; i the opinion there should be an annual minimum payment. i I We is thinking in terms of $2,000 per year. This would : I mean 287 acre feet of water would be used per year. If i I the water table is not sufficient then this would be cancel- : : led. Also if the water were not usable then it would be ; i cancelled. I I i This water is not too good but could be used for agricultu*. : Assuming that there is a demand for this water this would: i be a wise investment. There would be a maintenance cost! i tut it is felt it would be less than $29.00 per acre foot : : which we are paying for Colorado River Water. 1 I I If the City cannot use the water or sell it then the City will i have to look at this matter in a different light.
