Place of Meeting: Council Chambers ROLL CALL - 7:OO P:M. INVOCATION was offered by Mayor Dunne. ALLEGIANCE TO THE FLAG was given. 4- APPROVAL OF MINUTES: (a) Minutes of the regular meeting held October 20, 1970 were approved as submitted. I .5- COUNCIL COMMITTEE REPORTS. I I [28] (a) last two scheduled meetincrs had not been held due I Water Committee. Cmn. McComas reported the " to the lack of a quorum. Mayor Dunne requested that letters be sent to the absent members of the committee to determine their ability to attend scheduled meetings in order to maintain a quorum to conduct business. I [28] (b) Mayor's Youth Committee. Cmn. Lewis report- ed the organizational meeting of the Youth Com- mittee would be heldThursday, November 5th at 7 P.M. at the Council Chamber. It was noted that Mr. Tony-Howard Jones, Mayor Dunne and City Manager would meet with Cmn. Lewis and 15 student; to organize the committee. 6- HOUSING AUTHORITY. Upon written request of Mr. Olinghouse, the regular meeting of the housing authority was deferred to 11/17/70 so as to coincide with items to be reported on the Leased Housing program. 7- PUBLIC HEARINGS: 7:30 P.M. [30] (a) Agenda Bill #254. To consider'the adoption of the 1970 Edition of, the Uniform Building Code and the Uniform Mechanical Code: Vol . 11. The Deputy City Clerk presented Affidavit of. Pub1 ication and announced no wri tfen correspond- ence had been received. Mr. Dick Osburn-addressed the Council stating the proposed ordinance for addptidn would increase City revenue and as well as update the code and make it uniform with.other jurisdictions in the 1 County. There being no other oral communications the public hearing was closed at 7:42 P.M. and the following ordinance was presented. Ordinance No. 8055. AN ORDINANCE OF THE CITY OF 'CARLSBAD ADOPTING THE UNIFORM BUILDING CODE, AND PROVIDING PENALTIES FOR VIOLATION THEREOF, AND REPEALING CERTAIN ORDINANCES, was given a first reading by title only and further reading waived. 1970 EDITION (UNIFORM BUILDING CODE VOLUME 11) 8 .- ORDINANCES FOR ADOPTION. November .4, 1976. - ' ORDINANCE OF THE CITY OF CARLSBAD AMENDING ORDINANCE NO. 9060, RECLASSIFYING FOR RD-M (RESIDENTIAL DENSITY-MULTIPLE) PURPOSES, ON PROPERTY LOCATED BETWEEN TAMARACK AVENUE, AGUA HEDIONDA LAGOON, A.T.& S.F. RAILROAD AND CARLSBAD BOULEVARD was given a seconded reading by title only, further reading waived, and adopted. 9- ORDINANCES- FOR INTRODUCTION. Mayor Dunne adjourned the Council to an Executive Session for the purpose of discussing personnel, at 7:lO P.M. and the Council reconvened with four Councilmen present. [29] (a) Agenda Bill #271. Ordinance #1129, amending Ordinance #1126-A regarding final budget for Fiscal Year 1970-71 (Reclassification and Range adjustment for Planning Director. At the close of the Executive Session, Mayor Dunnc announced the Council had agreed that the Director of Planning and Special Director would be retainec at the recommended salary and the following Ordinance was presented: Ordinance No. 1129. . AN ORDINANCE OF THE CrTY OF CARLSBAD AMENDING ORDINANCE NO. 1126-A REGARDING FINAL BUDGET FOR FISCAL YEAR 1970-71 was given a first reading by title only and further reading Motion X waived.. Ayes xx (b) Agenda Bill #287. Ordinance #3088, regul at- ing Parks, Beaches and Navigable Waters. At the request of the City Attorney and Mayor Dunne, Agenda Bill #287 was deferred to the meet- ing of November 17 as it was felt regulation of ,navigable waters should be a separate ordinance, E701 10 CONSENT CALENDAR. 1 A. Correspondence - Advisory. c961 Mayor Dunne presented two letters from residents of the Carlsbad By The Sea Retirement home commending the city for the upgrading of the signal at Carlsbad Blvd. and Elm and Grand Ave. B. Correspondence - for referral. cw Agenda Bill #289. Request for permission to ' operate a variety jewelry exc.hange store, to- in- clude jewelry manufacturing, pawn shop, show room . and factory representation of Eastern and Western firms. The City Manager stated the request had been referred to the staff for report. j CITY OF CARLSBAD COUNCI LM E B \'' -3- . tor; Bj Mr. John Hamamy, 1238 Kirmar Place, Oceanside, the applicant, addressed the Council stating the request on the central location in the area for an exchange. He plans on representing 8 to 10 jewelry firms and would. incorporate several entities in one building. The City Attorney advised the Council' no CUP woul be required as the business is covered under the busi ness 1 i cense ordinance. After discussion by the Council as to the feasi- bility of allowing a pawn shop to be opened in conjunction with the business, th'e matter was deferred to the meeting of November 17 pending study and report from the staff. 11- CONTINUED BUSINESS. [79] (a) ' Agenda Bi 11 #242. Pol icy #2 concerning "Travel 'I. Due to the absence of and at the request of Cmn. Jardine, Agenda Bill #242 was deferred to the next Council- meeting. The Council adjourned to Executive Session at ,7:53 P.M. to discuss the appointment to the Planning Commission. The Council meeting recon- vened at 8:31 with four Cmn. present. [76] (b) Agenda Bill #284 . Appointment to the Planning Commission. Mayor Dunne announced that no decision was'made at the Executive Session and would be deferred in order for the Council to consider other candi- dates for the appointment. 12- CURRENT BUSINE.SS: d [Sl] (a) Agenda Bill #288. Resolution #1806, request- ing utilization of surplus military-aircraft'in . the fighting of forest fires. It was noted by 'the City Attorney that the reso- lution was merely a request at this point and the following resolution was presented: Resolution No. 1806. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD REQUESTING UTILIZATION OF SURPLUS MILITARY AIRCRAFT IN THE FIGHTING OF FOREST FIRES was adopted by title Motion only and further reading waived. Ayes X I [SO] (b) Agenda Bill #290. Proclaiming November IO and 11 , 1970, as "Flag Button Day" At the request of Cyril A. Cory, Commander, V.W.W.1. Barracks 649 of Oceanside, Mayor Dunne proclaimed November 10 and 11, 1970 as "Flag Button Day" and the following resolution was presented. f /: 1 % X . A RESOLUTION OF THE CITY .COUNCIL OF THE CITY OF CARLSBAD RE: REPATRIATION OF THE CAPTURED AMERICAN AND ALLIED FIGHTING MEN was adopted by title only and further reading [go] (a) The City Manager reported that he had met with County officials. Discussion was. held regard- ing drainage plans and he was sure the development would be beneficial to the City. Mr. Arnold stated the results of the p1annin.g and recommendations would be presented to the Council at a later date. [22] (b) Mr. Arnold noted that the proposed airport . . expansion was discussed and details would be pre- sent'kd to the Council at a later date. [28] (c) Mayor Dunne presented a letter of resignatior from Professor Larry E. Ruff of the Environmental Pollution Commission and instructed the staff to send a letter of gratitude to Dr. Ruff. [871 (c) The Mayor requested that United.Crusade donations be turned in to Mr. Baldwin and urged participation in the Crusade. [34] (d) It was announced that donations to the Xmas Bureau could be made to Mr. Vickery at the Cham- ber of - Commerce. [62] (e) Mayor Dunne requested the City Attorney to report to the Council on all legis1,ation recently passed or rejected which would effect the city. [28](f) Mr. Harry Truax addressed the Council statinc the Underground Utilities Committee had met with the City Engineer, S.D.'G. & E, and the Pacific Telephone Co. representatives.. A field trip of the downtown area was taken and a master plan is being developed for consideration. - The commi.ttee has scheduled another meeting prior 'to the CBDAC meeting in December and a report on the proposed ten year plan wil.1 be submitted to the Council in January. [28] (9) Mayor Dunne reported that a study is being made through the League of Cities Traffic Safety Committee regarding the installation of signs designating two or four way stops at stop signs. 14- RATIFICATION OF BILLS AND PAYROLL: Ratification was given for payment of bills for 'the General Fund in the amount of $46,373.63 and the Water Department of $6,851.29, totalling $53,224.92 for the period October 16 to November 1, 1970, as certified by the Director of Finance xx Ayes and approved by the Auditing Committee. Motion B CITY OF CARLSBAD COUNCILME -5- Ratification was given for the payment of the payroll for $50,620.61 for the period October 16 15- ADJOURNMENT By proper motion the meeting was adjourned at 8:49 P.M.
